Andersen Co - Trail Time: 3 minutes A Placement Co ld Business Ori Department/Re Eric Jo Re Si Action Re ve Citv Administrator Back (Please 'indicate if an previous action has been taken or if other public bodies have advised): 0 0 After much discussion and examinin potential commitments and expenditures to satisf the terms of the Andersen's Amended PUD Permit re the installation of acceptable trail infrastructure the followin is the current proposal. Andersen would commit $50,000 to a total project. A portion of the proceeds would fund and install a 4 foot wide g ravel, "soft" trail between their western parkin lot, then westwardl to Swa Park — approximat0 350 linear feet. The balance of the funds would be dedicated to the Cit for the pavin of the Swa Park parkin lot. I would recommend approval of this concept and re that the attached resolution be approved so that work ma commence this summer on the trail connection. Resolution A resolution FM* alizm* g S.C. Mall's (Andersen Corporation) 'Trail Construction Commitment WBEREAS, On March 25 2003, the City Council approved a PUD Amendment for SC Mall, (Andersen Corporation.) for various Mall Ih provements; and, WHEREAS, that 2003 PUID Amendment reserved/postponed a condition. that SC Mall install a trail at its southern boundary P ending final discussion by the Parrs and Planning Commission. and ultimately the City Council; anal, WHEREAS, on Ma 27 2003 the City received and approved the recommendation from staff and the Pans Commission that required the "installation of an S foot wide, separated grade trail at the south bound 'of the SC Mall Property, And that the cost of such trail would be a 50150 cost share between the City and SC Mall (Andersen Corporation), and that this was to be installed by 2008 and outlined in an appropriate Memorandum of Understanding (MOU) between the City and SC Mall (Andersen Corporation) WHEREAS, since that time Staff has been engaged in a discussion with SC Mall (Andersen. Corporation) staff, Mr. Bill Moore regarding the terms of that MOU, but SC Mall (Andersen Corp oration) has since requested that the City con sider an alternative commitment; and WHE REAS, such alternative would be the connnitment of $50,000 to install a trail connection from Swa er Parr to the Andersen campus' ring road, see "E�bit A" incorporated to this resolution, with '^' a ° the balance of funds being provided to the City for the purposes of nnprovjn g the Swager Parr parking lot. Now, THEREFORE BE I'T` RE SOLVED, that the City does generally accept the proposal from SC Mall (Andersen Corporation) and directs staff to work with SC Mall (Andersen Corporation.) staff to finalize an appropriate agreement that outlines and implements the alternative plan; and, E IT FURTHER SOLVEI , that once this alternative concept is completed SC Mall (Andersen Corporation) will have fulfilled its responsibilities for the trail elements of the PUD Amenchnent as approved by the City on March 25 2003.
