HomeMy WebLinkAbout1998-11-10 OPH City Ordinance 98-301-08AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION OCCUPANCY, EQUIPMENT USE, HEIGHTS, AREA, AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF OAK PARK HEIGHTS: PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; DECLARING AND ESTABLISHING FIRE DISTRICT AND REQUIRING SUMP PUMPS IN RESIDENTIAL BUILDINGS: PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, DOES ORDAIN: SECTION ONE: Section 301 of Chapter 301 of the code of ordinances for the City of Oak Park Heights is hereby amended by deleting the same in its entirety, substituting the following therefor: 301.01 ORDINANCE NO. 98-301_ 0 8 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY MINNESOTA State Building Code Ado ted. The 1997 Minnesota State Building Code, established pursuant to Minnesota Statute 16B.59 through 16B.75 and published in Minnesota Rules Chapters 1300 through 1370 and incorporating the Minnesota Plumbing Code and the Minnesota Energy Code, Chapters 4715 and 7670, respectively, of Minnesota Rules, is hereby adopted y � as the building code for the City of Oak Park Heights and is incorporated into this Ordinance as if set out in full, subject to the following specifications: A. Mandatory Enforcement Provisions. The following chapters of Minnesota Rules shall be enforced and administered without change by the City as mandatory provisions of the Minnesota State Building Code: 1 Chapter 1300 -- Minnesota State Building Code 2. Chapter 1301 Building Official Certification 3. Chapter 1302 - State Building construction approvals 1 4. Chapter 1305 5. Chapter 1307 6. Chapter 1315 7. Chapter 1325 8. Chapter 1330 9. Chapter 1335 10. Chapter 1340 11. Chapter 1346 12. Chapter 1350 13. Chapter 1360 14. Chapter 1361 15. Chapter 1370 16. Chapter 4715 Amendments to the Uniform Building Code (UBC) (Adoption of the 1997 Uniform Building Code). The adoption of this chapter specifically includes UBC Appendix Chapters: 3, Division I "Detention and Correctional Facilities "; 12, Division II "Sound Transmission Control "; 15 Reroofing; 16 Division I snowload design; 29 minimum plumbing features; 31 Division 1I Membrane structures and optional UBC Appendix chapters under section 1305.0020 shall be indicated in Subdivision 2 of this Ordinance. Elevators, and Related Devices Electrical Code (Adoption of 1996 National Electric Code (NEC)) Solar Energy Systems Fallout Shelters Floodproofing Regulations Facilities for the Handicapped Uniform Mechanical Code ( 1991) Manufactured Homes Prefabricated Buildings Industrialized/Modular Buildings Storm Shelters (Manufactured Home Parks) Minnesota Plumbing Code 17. Chapter 7670 Minnesota Energy Code (1994 edition) B. Optional Enforcement of Provisions Adopted. 1. The following chapters of Minnesota Rules, representing optional provisions of the Minnesota State Building Code, as provided in Chapter 1300.2900, are hereby adopted by the City without change and shall be enforced and administered by the City as a part of the State Building Code for the City: a. Chapter 1306 Special Fire Protection Systems. The City shall enforce Subpart 3 (8) "Group M mercantile, S storage, or F factory occupancies with two thousand (2,000) or more gross square feet of floor area of three (3) or more stories in height." b. Chapter 1310 Building Security 2. The following Appendix Chapters of the 1994 Uniform Building Code representing optional provisions of the Minnesota State Building Code, as provided in Chapter 1305.0020 of Minnesota Rules, are hereby adopted by the City and shall be enforced and administered by the City without change, except to the extent that the City may adopt by resolution revised fee schedules and bonding requirements under UBC Appendix Chapter 33, as a part of the State Building Code for the City: a. UBC Appendix Chapter 3, Division III b. UBC Appendix Chapter 15 - Reroofing c. UBC Appendix Chapter 19 - Requirements for Group R, Division 3 Occupancies Protection of Residential Concrete Exposed to Freezing and Thawing 301.011 301.02 301.03 301.04 d. UBC Appendix Chapter 31 Division II e. UBC Appendix Chapter 33 4 Membrane Structures Excavating and Grading Automatic Fire Suppression Systems. Optional Appendix E, Automatic Fire Suppression pp Systems as the same has been adopted by the State Department of Administration and filed with the Secretary of State and Commissioner of Administration on April 25, 1983, is hereby adopted pte d and shall be in full force and effect in the City of Oak Park Heights. At least three hree copies of Optional Appendix E, Automatic Fire Suppression Systems shall y be filed in the office of the City Clerk of the City of Oak Park Heights and shall be open pen to public inspection during regular business hours. Application. Administration. and Enforcement. The application, administration, and enforcement of the Minnesota State Building i Code in the City shall be in accordance with Minnesota Statutes Chapter 16B and nd Minnesota Rules Part 1300.2 100. The City Council. pursuant to Minnesota Statutes 16B.65. shall appoint a Building Official who shall attend to all aspects of Building g Code administration. Additional members of a City Building Department shall be authorized by the City Council as needed. Organization of the City's Building g Department shall be established by Chapter 1 of the 1996 Uniform Buildin g Code as amended by Minnesota Rules. The Minnesota State Buildin g Code shall be enforced within the incorporated limits permitted by Minnesota Statutes 16B.62. Permits. Inspections. and Fees. Permits shall be issued. inspections conducted. and fees collected as rovided for in Minnesota P esota Statutes 16B . 62, Chapter 1 of the UBC, and Minnesota Rules 13 05.0106 and 1305.017. Surcharge. In addition to the permit fee required under Section 3 above, the applicant for a buildin permit shall pay a surcharge to be remitted to the Minnesota Department of Administration as prescribed by Minnesota Statutes 16B.70. 301.05 Repeal. All ordinances in conflict or inconsistent with the provisions of this Ordinance are hereby repealed; specifically Ordinance 301.01 and 301.03. SECTION TWO: This ordinance shall be in full force and effect following its passage and publication according to law.
