RE: Oak Park Heights - Zoning Ordinance Amendment - Parking Lot Surfacing
and Curbing in Kern Center

The City has received requests from Kern Center businesses for exceptions from Zoning
Ordinance standards for parking lot surfacing and curb and gutter.
Zoning Ordinance Section 401. 5. F.4. h.13 reads as follows:
Surfacing. All areas intended to be utilized for parking space and driveways shall
be hard surfaced with materials suitable to control dust and drainage. Plans for
surfacing and drainage of driveways and stalls for five (5) or more vehicles shall be
submitted to the City Engineer for review and the final drainage plan shall be
subject to written approval.
Zoning Ordinance Section 401.15. F.4. h.17 reads as follows:
Curbing and Landscaping. Except for single and two - family dwellings, all open, off -
street parking shall have a continuous concrete perimeter curb barrier around the
entire parking lot; said curb barrier shall not be closer than ten (10) feet to any lot
line. Grass plantings and landscaping shall be provided in ail areas bordering the
parking area.
Staff recommends that an exception be made regarding curb and gutter, but not surfacing.
This recommendation is made considering the City's decision not to provide curb and
gutter along Memorial Avenue and 58 Street as part of the roadway reconstruction
occurring this summer. All parking and drive areas should be surfaced with asphalt or
concrete to control dust and drainage. There would be no reason to support an exception
to the paving requirement, and a precedent could be set for redevelopment/development
throughout the City.

The following amendment to Section 401.15.F.4.h.17 of the Zoning Ordinance is proposed
to allow flexibility with curb and gutter requirements in the Kern Center:
Curbing and Landscaping. Except for single and two - family dwellings, all open, off -
street parking shall have a continuous concrete perimeter curb barrier around the
entire parking lot; said curb barrier shall not be closer than ten (10) feet to any lot
line. Grass plantings and landscaping shall be provided in all areas bordering the
parking area.
Alt provisions of Section 401.15.F., Off Street Parking Requirements, shall
apply to Kern Center properties except that the concrete curb barrier
requirements of Section 401415.E.4.ha17 may be waived for rear and interior
side yards of existing and proposed building sites legally described as Kern
Center or Kern Center 2nd Addition if the City Engineer determines from a
review of the drainage plans that drainage will not enter onto adjacent sites
or that erosion problems will not occur.
