Over the past few months we have received correspondence from the Middle St. Croix
WMO regarding these projects. 1 would like to be updated as to the action take by the
City Engineer to bring these projects into compliance with the WMO rules and city
ordinances.

Per your request, I am sending this letter as a confirmation that the Middle St. Croix
Valley Water Management Organization as well as Brown's Creek Watershed District and the City
of Oak Park Heights are all governed by the time regulations imposed by statute that the cities and
the government entities process their permits and either forward the applicant a final decision within
60 days or 120 days, if extended, as required by law. Once that time period has lapsed, if either
political subdivision fails to do so, and the permit is regulated in the nature of that which is specified
within the statute, the permit is deemed to be automatically granted.
The City has received conunentary from Middle St. Croix Valley Water
Management Organization and Brown's Creek regarding permits that have already been long since
issued, and are well beyond the 120 day limit as extended by the City, for each applicant. Although
those commentaries may be forwarded on to the applicant, and they may be certainly invited to
respond or otherwise modify their plans to incorporate them, neither the City nor the Watershed
Management Organization or District is in the position to force or impose those obligations on the
applicant if, indeed, those comments are submitted beyond the regul

Dear Mayor Beaudet:
The Middle St. Croix Watershed Management Organization (MSCWMO) reviewed its prior comments
provided for this project (via the Washington SWCD). During this review, an additional concern was identified
by the MSCWMO. MO. Specifcally, it was noted by the MSCWMO that Section 5 Grading and Drainage of the

Oak Park Heights zoning ordinance provides:
"No land shall be developed and no use shall be permitted that results in •water runo
causing flooding, erosion, or deposit of minerals on adjacent properties. Such runoff
shall be properly channeled into a storm drain, water course, ponding area or other
public facilities subject to the review and approval of the City Engineer."
In the case of the Sigstad Carpet project, the proposed stormwater pond discharges onto private property with no
improved drainage facilities. It is the concern of the MSCWMO that the increase frequency and duration of stormwater discharges onto this adjacent property could cause negative impacts and soil erosion. It is the desire
of the MSCWMO that the City resolve this drainage concern prior to the construction of the Sigstad project. If

site visit was conducted. Since our agency has no direct approval authority over the project, our review being

made on behalf of the Middle St. Croix Watershed Management Organization. Based upon the conditions

The first . major concern with this site is the apparent undersizing of the permanent pool volume (dead storage)
for the pond. The permanent pool volume is that area below the outlet. Calculations provided by the applicant
show that 14,520 cubic feet is required. Yet only 8,867 cubic feet are provided. We would recommend that the

The other concern is the incremental change in runoff volume that is proposed to be discharged onto
neighboring properties to the south. Based on observations at the site and the proposed plan, a few
modifications of the proposed stormwater pond could minimize the incremental increases in stormwater runoff
volume from this site. It is our recommendation that the live storage area of the pond (the area above the outlet)
be oversized to mirdmi.ie discharges. The outlet control structure could be modified to further slow o &tfiow by
placing a three inch PVC on the structure rather than the proposed four inch PVC. In situations of consecutive
storms, discharge rates and volumes would be reduced if the three inch PVC was also ,placed at a lower
elevation on the outlet control structure.
2) . Grading and Erosion Control
Although the plan specifies that geotextile silt fence be installed around the perimeter of the project area, we
would recommend that the contractor be prepared to install additional erosion control measures in the event that
concentrated flow leaves the site. These measures may include the placement of an additional row of silt'. fence
in low areas to minimize sediment from leaving the site. Silt fence along the project perimeter should remain in
place until the site is restored and stabilized.

proposal associated with Iand development for the Sigstad Carpet Business. He
indicated the City of Oak Park Heights has approved the Sigstad Carpet
Proposal, however he believes the Sigstad Carpet Proposal has a significant
impact on adjoining property because it changes the current storm water pattern
so that water will now drain to the south onto the adjacent private property. He
indicated that he recognized the MSCWMO missed its 60 day review period.
However, he believes there would be some advantage for Mark Doneux of the
Washington County Soil & Water Conservation District to review the Sigstad
Carpet Proposal and forward on his report to the MSCWMO and the Oak Park
Heights City Council.

A question has arisen relative to the authority of stormwater management within the
City of Oak Park Heights in terms of which government entity has the current jurisdiction to
determine stormwater flows, etc. within the community.
Although there is an appeal pending with the Minnesota Court of Appeals relative to
the orders of the Minnesota Board of Water and Soil Resources of January 24, 2001, the Board of
Water and Soil Resources orders are, nonetheless, jurisdictional and effective until such time as they
would be reversed by the Court of Appeals. Consequently, their order assigning the City of Oak
Park Heights to Brown's Creek Watershed District for purposes of watershed authority is effective
and does assign stormwater management issues to Brown's Creek Watershed District for purposes
of authority at the present time. Obviously, that directive could change should the Court of Appeals
issue its order in a manner so as to reverse that directive; however, until such time as that would
occur the Board of Water and Soil Resources is the jurisdictional authority on stormwater
management issues within the community.

The City of O.ak Park Heights has received a development application from
Sigstad Carpets to construct a 24,979 square foot retail facility on 2.24 acres of
land. Our City Attorney has advised me that under theBOWSR order, Browns
Creek Watershed District has jurisdictional authority over development in this .
area.
Enclosed with this letter, please find copies of the drainage calculations the
applicant has provided to the City as well as site plans including grading and
drainage. The applicant is proposing on -site ponding to accommodate their
current needs, as well as a phase 2 retail development should a larger
stormwater pond, be . created in the future in the immediate area. •

Our office has received and reviewed the construction plans, dated August 23 and revised September 28, 2001
and November 14, 2001, for the proposed Routson Parking Lot expansion project. The project site is located at
the existing Routson Motors, in Section 33, Town 30 North, Range 20 West, City of Oak Park Heights. This
project involves creating new parking lot and stormwater ponding facilities on existing Routson property. As
part of our review we visited the site. The Washington SWCD CD has no direct regulatory authority over this
project and our review is being made on behalf of the Middle St. Croix Watershed Management Organization.
Based upon the site conditions observed and the proposed plans we would offer the following additional
comments:
1) Storrnwater Management
The project proposes to create approximately one acre of new parking lot (impervious surface) from existing
vacant land (pervious surface). Water quantity and quality ponding is currently proposed along the eastern edge
of this site. While the applicant appears to document adequate storage and rate control for the pond, we still
have a concern for the off -site drainage going to the landlocked basin on the northeast end of the proposed pond.
The City of Oak Park Heights must be prepared for the eventuality that runoff WILL occur from this pond
during frozen ground conditions, back -to -back storms or after siltation has occurred in the pond sealing its
bottom from infiltration. The as ■ licant should also document where off-site draina • e :oes and wh this will not
cause erosion problems. Further, it should be determined when, how or if this off -site drainage will be
connected into a public drainage system. I hope that these comments will assist you with the review and

RE: Proposed Routson Parking Lot Expansion project City of Oak Park Heights
Our office has received and reviewed the construction plans, dated August 23 and revised September 28, 2001,
for the proposed Routson Parking Lot expansion project. The project site is located at the existing Routson
Motors, in Section 33, Town 30 North, Range 20 West, City of Oak Park Heights. This project involves
creating new parking lot and stormwater ponding facilities on existing Routson property. As part of our review
we visited the site and discussed the plans with project representative, Rich Revering of Ulteig Engineers, Inc.
The Washington SWCD has no direct regulatory authority over this project and our review is being made on
behalf of the Middle St. Croix Watershed Management Organization. Based upon the site conditions observed
and the proposed plans we would offer the following comments:
The project proposes to create approximately one acre of new parking lot (impervious surface) from existing
vacant land (pervious surface). Water quantity and quality ponding is currently proposed along the eastern edge

2) Grading and Erosion Control
Since much of the site work is located adjacent to impervious areas and/or fragile soils, erosion cont

requirements will need to be closely followed to minimize soil erosion. If a straw mulch is used for temporary
p ry
protection, it must be weed and seed free. In the event of concentrated flow leaving the site, we would

recommend that the contractor be prepared to place an additional row of silt fence in low areas to minimize
sediment from leaving the site. Silt fence along the project perimeter should remain in place until the site is
restored and stabilized. The specifications should require the mechanical anchorin g of straw mulch on the
contour, however, most equipment can not operate safely on slopes steeper that 4 :1. Therefore, we recommend
that all slopes steeper that 4:1 be covered with erosion control matting, such as a wood fiber blanket instead of
straw mulch.
