Background/Justification(Please indicate if any previous action has been taken or if other public

Every three years the City of Oak Park Heights must submit to the MN Dept of Labor a Pay
Equity Compliance Report. This mandated report attempts to compare job classifications,
assigned responsibilities and pay ranges between male and female staff in an effort to ensure that
cities are paying equalized amounts for various positions and across gender lines.
Attached is the Pay Equity Compliance Report for 2013. The requirement set by the State of
Minnesota Department of Labor is that the Underpayment Ratio and the Salary Range Test
results be 80 or more. You will note that the 2013 results are 93.75 and 91.67, respectively.
Therefore, the City of Oak Park Heights is in compliance with pay equity.
Recommendation/Action requested:
Approve Pay Equity Compliance Report for 2013 and authorize staff to submit the report
to the Minnesota Department of Labor.

Policy on City Hall Use(DRAFT)
1. To the extent meeting rooms adjacent to the City Hall entrance rotunda may be unoccupied
the City will make such rooms available for use by the public. However, in all situations Non-
city meetings shall always remain subordinate to the use of any and all spaces being required
for use the City Council, its Commissions or subcommittee or use by City staff.
2. No rooms may be utilized by firms, individuals or organizations that are "for-profit"in nature,
for sales of goods or services or for private celebrations or parties. Use of rooms shall be for
the sole purposes of conducting a meeting. Use of rooms,by political parties, condominium
organizations, religious organizations or other non-profit entities may use a meeting room. No
party may use the room more than once quarterly,subject to availability.
3. The maximum group size is limited to 12 total persons.
4. Any group wishing to use a meeting room shall coordinate with the Deputy Clerk not less than
24 hours in advance of the proposed meeting to determine availability. Unless special
arrangements are pre-approved approved by the Deputy Clerk no meetings may begin prior to
9:00 am and shall cease, with all participants leaving the City Hall by 4:00 pm.
5. During evening and specific time periods when there is a regularly scheduled City Park Board
Meeting or a Planning Commission meeting, (excluding City Council meetings)a group may
utilize an available meeting room. However,such use shall be subject to the conditions found
in this policy and shall cease, with all participants leaving the City Hall premises at the closure
of the City function.
6. At no time may any meetings interfere with the business to be carried out by the City and as
determined solely by the City.Should this occur the City may terminate the use of a meeting
room by an outside party immediately and for any reason.
* Food or refreshments may be brought in, but the group is solely responsible to clean-up all
materials and dispose of any garbage or recyclables and removal from the building. No food
or refreshments may be brought in that could disturb the proper functioning of the City.
* The City does not provide sinks, coffee makers, cups, dishes, utensils,phones,printing,
copying, etc.for use;each group must supply all their own materials.
9. Any chairs and tables that are moved shall be relocated to their original position prior to the
party's use.
10. Any party wishing to utilize the City Hall for a meeting shall first contact the City Deputy Clerk
to discuss availability and permissions.
11. The Party will be held liable for damages should any occur as a result of their use.

Due to a recent change in State Statute; 116.202,that prohibits the use of coal tar based
products such as in driveway coatings, the City may adopt a local ordinance that would allow
the City to enforce this prohibition.This is similar to the State Building Code where the City
may also enforce this,but would need to adopt an ordinance for such enforcement
The LMC has prepared a model ordinance and has been generally tailored to meet city
formatting.Please take a look through the document and consider if this enforcement is of
value to the City.
Considering that the City may be responsible for water/pond treatment,reducing any
chemical exposure that may leach from the use of this type of material to such basins would
appear to be a reasonable step. The City could have increased costs for dredge disposal if such
material was contaminated with coal-sourced chemicals.
From a timing standpoint,the City will also want to ensure that this regulation is included in
the City specifications and related to any private party that is also anticipating redoing their
surfaces in conjunction with the City's project.
Accordingly, Staff would recommend adoption of this Ordinance as proposed.

116.202 COAL TAR SEALANT USE AND SALE PROHIBITED.
Subdivision 1.DWinitions.The following terms have the meanings given.
(a)"Coal tar sealant product"means a surface applied sealing product containing coal tar,
coal tar pitch,coal tar pitch volatiles,or any variation assigned the Chemical Abstracts Service
(CAS)number 65996-93-2,6599649-6,or 800745-2.
(b)"Commissioner"means the commissioner of the Pollution Control Agency.
Subd.2.Use prohibited.Except as provided in subdivision 4,a person shall not apply coal
tar sealant products on asphalt paved surfaces.

Subd.4.Exemptions.The commissioner may exempt a person from this section if the

(2)the person is developing an alternative technology and the use of a coal tar sealant
product is required for research or development.
A request for exemption must be made to the commissioner in writing, including an
explanation of why the exemption is needed for research or the development of an alternative
technology.
Subd.5.Compliance and enforcement.Local units of government may adopt by reference
and enforce the provisions of this section.The commissioner may provide technical support to
local units of government for compliance and enforcement of this section. The commissioner
may respond to oomplianoe and enforcement oases transcending jurisdictional boundaries,uses
requiring statewide corrective actions,or requests for assistance or referral from local units
of government.

B. No person shall sell a coal tar sealant product that is formulated or marketed for
application on asphalt-paved surer within the City of Oak Park Heights.
C. No person shall allow a coal tar sealant product to be applied upon property that is
under that person's ownership or control.
D. No person shall contract with any commercial sealer product applicator,residential or
commercial developer,or any other person for the application of any coal tar sealant
product to any driveway,parking lot,or other surface within the City.
E. No commercial sealer product applicator,residential or commercial developer,or
other similar individual or organization shall direct any employee,independent
contractor,volunteer,or other person to apply any coal tar sealant product to any
driveway,parking lot,or other surface within the City.
Section 4. EXEMPTION: Upon the express written approval from the MPCA and in
accordance with Minnesota Statutes section 116.202,a person who conducts research on the
environmental effects of coal tar sealant product or when the use of coal tar sealant product is
necessary in the development of an alternative technology shall be exempt from the prohibitions
pinovided in Section 3.Any person that is,grad approval by the MPCA must provide a copy of
the written approval from the MPCA to the City of Oak Park Heights,Minnesota twenty days
before conducting the research.
Scodan,5...ASPHALT BASED SEALCOAT PRODUCTS: The provisions of this ordinance
shall only apply to coal tar sealant products in the City and shall not affect the use of asphalt
based sealer products within the City.
Section 6.PENALTY: Any person convicted of violating any provision of this ordinance is
guilty of a misdemeanor and shall be punished by a fine not to exceed one thousand dollars
($1,000.00)or imprisonment for not more than ninety(90)days,or both,plus the costs of
prosecution in either case.
Section 7. SEVERABILI'TY: If any provision of this ordinance is found to be invalid for any
reason by a court of competent jurisdiction,the validity of the remaining provisions shall not be
affected..
Section 8.EFFECTIVE DATE: This ordinance becomes effective on the date of its publication,
or upon the publication of a summary of the ordinance as provided by Mtnwsota Statutes section
412.191,sated.4,as it may be amended from time to time,which nimU the regWreme of

Staff recommends the approval the 2014 Fire Protection and Rescue Services Agreement for$216,197
with the Bayport Fire Department.The Agreement is attached for review.The 2014 amount is a
$26,803 increase from 2013,and is a 14.15%percent increase;approximately 8.03%per year since
2003.
The contract is similar in all respects to previous years,except that language is added and listing of
billable rates that will be utilized by the BFD to bill consumers of the emergency services,such as
when there are incidents on STH 36, STH 95 or other non-City generated impacts.The City of Oak
Park Heights is not required to pay these amounts, nor bill for these,rather authorize the BFD to do so
subject to the stated rates for equipment. The amounts are not intended to be billed for routine and
anticipated responses to City homes,businesses,etc.
Also note that the funding is based on a Fair Share formula which takes into account two items of each
of the four participating cities:a five-year history of fire run data and tax capacity.

5. Qpqrogons. The operation of the vehicle(s)and the direction of their use at the scene of
the fire or medical rescue emergency, together with said equipment, shall be directed by the Chief, or
Assistant Chief, of the Bayport Fire Department if they are present at the fire or medical rescue
emergency. Otherwise, said operation and direction shall be in the charge of the driver of said vehicle(s)
deployed to the fire or medical rescue emergency.
6. Insurance Coverage. Bayport shall maintain general liability insurance for its services
rendered under this Agreement and shall include Oak Park Heights as an additional insured for the term
of this Agreement and any extension thereof. Bayport shall maintain insurance equal to or greater than
the maximum liability applicable to municipalities as set forth in Minnesota Statutes, Section 466.04,
Subdivision 1, as amended. Bayport shall also maintain inland marine, automobile, and property
insurance coverage. Bayport shall provide Oak Park Heights proof of such insurance coverage and the
additional insured endorsement naming Oak Park Heights annually, by the anniversary date of this
Agreement. Bayport shall also maintain workers'compensation coverage as required by law.
7. Indemnification. Bayport agrees to defend and indemnify Oak Park Heights against any
claims brought or actions filed against Oak Park Heights or any officer, employee, or volunteer of Oak
Park Heights for injury to,death of,or damage to the property of any third person or persons,arising from
Bayport's performance of services under this Agreement. Under no circumstances, however, shall
Bayport be required to pay on behalf of itself and Oak Park Heights, any amounts in excess.of the limits
on liability established in Minnesota Statutes, Chapter 466, applicable to any one party. The limits of
liability for Oak Park Heights and Bayport may not be added together to determine the maximum amount
of liability for Bayport The intent of this subdivision is to impose on Bayport a limited duty to defend
and indemnify Oak Park Heights for claims arising out of the performance of this Agreement subject to
the limits of liability under Minnesota Statutes,Chapter 466. The purpose of creating this duty to defend
and indemnify is to simplify the defense of claims by eliminating conflicts between the parties and to
permit liability claims against both parties for a single occurrence to be defended by a single attorney.
8. No Waiver. Nothing herein shall be construed to waive or limit any immunity from, or
limitation on, liability available to either party, whether set forth in Minnesota Statutes, Chapter 466 or
otherwise.
