Dear Mayor and City Council members:
Please see the attached design drawing for a new gravel roadway as provided by MNDOT that would address the
Peabody Ave. situation. This of course is the topic of the discussion tomorrow night at 6 pm. (and on May 29`h)
The City Council essentially is being asked to approve the plan in concept and submit a Permit Application to the State
(MNDOT/SHPO) as it deals with an impact to the adjacent Historical Elements of the Scenic Overlook.
As we know,the City has currently scheduled a neighborhood meeting at 6 pm on May 291h where this plan could be
presented in a formal sense for input, however unless there is some significant unknown issue that would present itself
at that meeting,the plan appears to address the concerns the neighborhood has stated, providing an assured year
round access way and supplies emergency vehicles with similar appropriate access.
MNDOT has indicted that leaving the roadway gravel would be their preference and would possibly result in fewer
historic mitigations, if any, are needed. My understanding at this time would be that MNDOT will not request
compensation for use of the State property but it would be the City's cost to develop the roadway which would be
minimal if it r mains gravel as before.
Mr. Chi will be p esent at the meeting to aid in this discussion further, however the above is a general summary of
anticip ted issues.

As you likely know, after a number of decades, The State of Minnesota has removed the access way
from Peabody Ave. northward through the Scenic Overlook to Lookout Trail. Naturally, the City is
concerned with this action and would hope to work with the State to find alternative options to ensure
the access to your homes are secure and that
all emergency and other public services
remain wholly viable in this area. � "
Accordingly, the City would like to invite you

Restoration of the Lake St. Croix Overlook, emergency turn-around

Dear Kristen:
Jackie Sluss sent us plans for an emergency turn-around to serve Peabody Street, within the area of
potential effect for the above-referenced project. Because Jackie has since retired, I am responding
to you as representative of the MnDOT Cultural Resources Unit and Federal Highways. The new
emergency turn-around plans have been reviewed pursuant to the responsibilities given the State
Historic Preservation Officer by the National Historic Preservation Act of 1966 (36CR800) and per
the terms of the Programmatic Agreement between the FHWA and the Minnesota SHPO.
As noted previously, the Lake St. Croix Overlook is listed in the National Register of Historic Places
and therefore all work must meet the Secretary of the Interior's Standards for the Treatment of
Historic Properties (Standards). The 90% complete plans you sent us last November for the
overlook differed from the earlier 60% plans, in that the later plans showed elimination of Peabody
Street within MnDOT-owned right-of-way at the overlook. The change was explained by noting that
Peabody had contributed to the deterioration of historic materials of the overlook, and that it was a
"rogue" (ie unauthorized) street. Bollards and landscape plantings were added to the plans to
discourage further use of the Peabody Street access to the overlook.
At the time our office reviewed the 90% plans, we agreed that the plans had no adverse effect on
the overlook. But we were not then made aware of the effect the revised plans would have on
residents living along Peabody Street. Since the project was let and barricades were erected by
MnDOT to block off the Peabody exit route, we have heard from the City of Oak Park Heights and
from several residents. The City and residents alike are very concerned about the problem of safe
access to and from home during winter, when reportedly the steeply sloped south end of Peabody is
covered with ice and snow. Callers were also worried about the safety risks of a dead-end street,
with no practical way to turn around emergency vehicles or trucks. Finally, there seems to be an
encroachment of MnDOT ROW by the last house on the block, so the proposed bollards and
plantings are located in what one resident thought was his yard.
During a number of frank telephone and in-office discussions, I have assured concerned callers that
ouc office would be willing to work with MnDOT to come up with a compromise street design to
protect historic aspects of the overlook, while accommodating safe access to homes along Peabody
Street. More specifically, I suggested looking at alternative designs that might bring Peabody Street
back to Lookout Trail within current MnDOT right-of-way, but south of the National Register
boundary.
The design Jackie sent over for the"emergency"turn-around is located on MnDOT property, but
outside the National Register boundary. While I have no objection to this approach as a temporary
measure, and I do not think it adversely affects the National Register property, I don't believe it fully
resolves the problems presented to us by the neighbors and the City of Oak Park Heights. The
drawings I received did not actually show a revised location for the bollards, although the letter
mentioned that bollards would be relocated 70 feet north of their earlier placement. Nor did the new
plans show where exactly the landscape plantings shown in the 90% plans would now be placed. As
a practical matter, I question the wisdom of doing any plantings or placing any permanent bollards
near the emergency turn-around, until negotiations about Peabody Street's ultimate legalization,
location and design are complete. I would hate to see bollards and plantings go in this season, only
to be removed next year once a legal street with an acceptable design has been agreed upon.
In summary, we will be happy to discuss alternative designs for Peabody Street that do not harm the
National Register overlook. Feel free to arrange a meeting about this, or send draft plans over here
