Manor McComber: She reported that she, Councilmember Liljegren, and City Administrator Johnson met with the Governor's office,the Commissioner, and Jon Chiglo of MNDOT on March 21. She also reported that the Parks Commission meeting was set for April 21, and she reminded the City Council of the League of Local Government meeting at the Lake Elmo Event Center on March 31. B. St. Croix River Crossing Project: Mayor McComber reported that she, Councilmember Liljegren, and City Administrator Johnson met with Deputy Governor Domfeld, Commissioner Zelle, and Jon Chiglo regarding Oakgreen Avenue utilities and engineering costs. City Administrator Johnson provided the City Councilmembers with spreadsheets outlining project engineering costs. Councilmember Swenson, seconded by Councilmember Liljegren, moved that the City will pay up to $140,000 additionally for engineering fees bringing City expense up to $675,687; to inform MNDOT that they needed to pay what was owed to the City in outstanding bills; that the Oakgreen water main issue be deemed by MNDOT as not a betterment; that the cost savings be calculated separately; and to direct that the City Attorney work with the MNDOT Attorney on this matter and take it off the City staff. Carried 5-0. B. Osgood Ave Trail Update and Requested Actions: City Administrator Johnson requested that the City Council approve expenses up to $3,000 for securing trail easements, approve entering into a Cooperative Agreement with Washington County, authorize the City to enter into any final necessary agreements that may be required from Washington County or HUD related to the terms and conditions of the CBDG funding, and approve engineering costs not to exceed $16,800. Mayor McComber, seconded by Councilmember Runk, moved to approve the trail update and the requested actions, and that the contracts be signed. Carried 5-0. Hall and Hall Properties LLC—Conditional Use Permit and Design Guidelines Review— 13999 60'Street North: City Planner Richards reviewed his planning report which was included in the City Council meeting packet for that evening. Councilmember Runk, seconded by Councilmember Dougherty,moved to approve the Resolution. Roll call vote taken. Carried 5-0. B. Approve Agreement Authorizing Ironman Bicycle Ride—2014: Councilmember Swenson, seconded by Councilmember Liljegren,moved to approve the agreement. Carried 5-0. C. Interim Use Permits—Clarification of Xcel Energy Permit Extension for SCRCP: City Administrator Johnson reported that the City received a request from Xcel Energy to allow the use of their river access property by the State of Minnesota's contractor, Lunda-Ames, for staging and river access to continue construction of the St. Croix River Crossing. He stated the City had previously issued an Interim Use Permit to Xcel Energy for a similar purpose, and staff viewed the request as a continuation of the current IUP. Councilmember Runk, seconded by Councilmember Swenson,moved to clarify that the proposed use of the Xcel Energy site was not a material change from the existing IUP and there was no objection to such use by Lunda-Ames subject to similar terms and conditions as issued in the IUP or as may be deemed necessary by the City Planner and City Attorney. Carried 5-0. D. Approve Starting Hiring Process—Replacement Officer: Police Chief DeRosier requested approval to initiate the hiring process outlined in his council action request in the meeting packet. Councilmember Runk, seconded by Mayor McComber,moved to appoint Councilmember Liljegren to the hiring committee. Carried 5-0. E. Consider Possible NO PARKING Area—Nolan Parkway: Councilmember Runk, seconded by Councilmember Swenson,moved to direct staff to prepare a Resolution for a No Parking Area on the east side of Nolan Parkway from 5260 Nolan Parkway to Norwich Parkway. Carried 5-0. F. Consider Additional Pedestrian Crossing Signals at Nova Scotia Ave and 58t` Street: Councilmember Runk, seconded by Councilmember Swenson, moved to send to the Parks Commission to look at adding a crossing light Page 6 of 70 City Council Meeting Minutes March 25, 2014 Page 4 of 6 at Nova Scotia and report back to the City Council. Carried 5-0. Councilmember Swenson stated he was concerned because those signals give pedestrians a false sense of security. Mayor McComber suggested including that on the cover memo for the Parks Commission. Councilmember Runk stated the Parks Commission could seek input from Police Chief DeRosier. Runk requested that Public Works Director Kegley get a sign that says to use caution when crossing the street. G. DNR Groundwater Rules and Aquifer Impacts: City Administrator Johnson reported that the ability of the City to continue to draw water from an aquifer was becoming less clear and could have substantial restrictions in the future. He stated that several Washington County cities have been meeting at staff levels to monitor and participate in the state agency activities regarding ground water sustainability and access issues. He reported that in order to continue meeting at a staff level, it would be appropriate for the City Council to enter into an Intergovernmental Agreement,which was enclosed in the City Council meeting packet for that evening. Councilmember Runk, seconded by Councilmember Liljegren,moved to authorize the City Administrator to enter, on behalf of the City,the Intergovernmental Agreement regarding water supply. Carried 5-0. H. Public Works Equipment Needs: Public Works Director Kegley stated that he wanted to update the City Council on equipment needs. He reported that the attachments for the current Kubota tractor needed to be upgraded to Kubota-specific equipment. He stated the department would likely seek approval from the City Council to trade in the existing equipment. Kegley also reported that there would be a need for another piece of commercial equipment for trail maintenance. He stated staff was researching options, and the potential cost would be$80,000 to $200,000. Kegley reported that the Public Works Department would need to purchase a light-duty vehicle which had already been funded in the budget. He stated staff was researching options and would come back to the City Council to request final approval. Councilmember Swenson, seconded by Councilmember Runk,moved to allow the Public Works Director to use the $30,000 that was saved for a truck plus the equipment trade-in amount to get equipment designed for the Kubota. Carried 5-0. I. Washington County--Pickett Ave. Proj.—Wetland Replacement: City Administrator Johnson reported that the City was the Wetland Conservation Act local agent which required the City to make a finding on Page 7 of 70 City Council Meeting Minutes March 25, 2014 Page 5 of 6 the local wetland projects. He stated that Washington County estimated that .22 acres of wetlands were impacted with the realignment of Picket Avenue as it approached Highway 95. Johnson stated that Washington County requested that the City approve the proposed plan to purchase .44 acres of wetlands from a wetland bank located in the same major watershed and within Washington County. He stated that the City Engineer recommended that the City Council approve the WCA Replacement Plan Application. Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the WCA Replacement Plan Application. Carried 5-0. J. St. Croix River Crossing--Work Order#8: City Administrator Johnson reported that Jon Chiglo of MNDOT requested that the City execute Work Order#8 which the City had not signed because it expressed costs that are inconsistent with the Agreements executed between the City and the State. Johnson stated that if the City did not sign Work Order 48,MNDOT may still proceed subject to the dispute resolution process incorporated in the Master Utility Agreement. Johnson reported that there were two options for the City Council to consider: Option A was to continue to hold on the execution of Work Order#8 until revisions were made to the document that were consistent with the Agreements and the City invoices were paid; and Option B was to insert a distinct provision in the document that the City did not concur with the figures included and the City reserved its rights to not make payments in the future relative to such amounts. Johnson stated the language would be subject to the City Attorney's and the City Engineer's requirements, and that option included a provision that MNDOT make payment to the City for invoices sent to date prior to Work Order#8 being executed. Mayor McComber, seconded by Councilmember Swenson,moved to approve Work Order 48 with the language in Option B and payment first as a caveat. Carried 4-1, Runk opposed. VIII. Labor Negotiations: City Attorney Pratt reported that the City Council would go into closed session pursuant to Minnesota Statute 13.D.03 regarding labor negotiations. Councilmember Swenson, seconded by Councilmember Liljegren,moved to adjourn to closed session. Carried 5- 0. City Attorney Pratt reported that the City Council discussed issues related to labor negotiations in the closed session and they were ready to take action in the option session. Greentouch charges an hourly rate of$28.50 per hour, a rate that has not changed for the past three years. The company has experience mowing City parks and property and responds quickly to requests for added work, or corrective action. City staff has a good working relationship with Greentouch staff, and the Company provides quality service. The answer the City must give is "YES"so as to possibly improve the City's Bond Rating. Attached is a map that outlines some very generic options to future street reconstruction cycles and would be known as the Street Reconstruction Management Plan. The document does not outline how these improvements are paid for,what the scope of a given project would be, etc. rather is just a proposed plan that bond rating companies might like to see. The document is wholly revisable, is subject to many unique circumstances and by itself is not an approval to proceed with any project or plan. Generally speaking,the City approaches street reconstruction in a fashion that may be unique compared to other cities due to the relative value of commercial and industrial property versus residential values and from which the City attempts to accrue substantial funds to perform street reconstruction versus larger direct street assessment. While this funding reality can balance out total costs, it does leave out the formulation of a systematic timeline for better predicting when a certain street may be addressed and which would typically match bond issuance and pay-off cycles. The Street Reconstruction Project of 2014-2015 will require the City to issue bonds to fund a portion of the street improvements that will be paid by special assessments and to finance a portion of the storm water improvements. This will require a Bond Issuance of approximately $3,910,000. The Bond will be paid back over a term of 10-20 years based on the Council decision on how they would like to structure the bond issue. I have attached 2 projections C--3 which would be a 20 year bond issue and Projection D, which is a 10 year general obligation and a 15 year revenue bond. Steve Mattson will explain these at the scheduled workshop. The difference in the two issues is reflected in the tax levy that will be required along with the amount of water revenue needed each year until the bonds are paid. This will be further explained during the workshop. The Resolution that is attached is the same type of resolution that the City has adopted for prior bond issues. It allows the City Administrator and the Mayor to approve the sale of the bonds and for Northland Securities to execute the bond purchase agreement. Apparently this is generating considerable noise in the area. In contacting MNDOT,they indicated that the City must follow their signage procedure request, see enclosed,which includes the passage of a resolution and that the City must pay for the signs. Recall,the City did review this in 2006 and did the installation of VEHICLE NOISE LAWS ENFORCED signs in a few areas. My memo from that time is enclosed. If the City Council would like to address this matter in the above area,the enclosed resolution should be discussed and adopted as the first step. Please note however that the cost of the signs and the installation is nominal,however enforcement is the challenge.Noise meters must be purchased, calibrated and appropriately utilized in order for such citations to be effectively prosecuted should a subsequent violation occur. So,perhaps the City starts with the signs and attempts enforcement as resources and results allow. Signing may be permitted on two-lane two-way trunk highways and on non-freeway segments of expressways (no freeway type interchanges)where adequate space is available.Noise enforcement signing is not permitted on freeways. 2. Only one sign shall be allowed per trunk highway approach into a community. 3. The sign panel shall be black lettering on a white background and display the message "VEHICLE NOISE LAWS ENFORCED". The size of the sign shall be determined based on the posted speed limit. 4. The Mn/DOT traffic engineer shall determine if there is adequate space along the roadway for each sign. 5. The permit holder must comply with all applicable laws and regulations, including Worker's Compensation laws. 2. If work to be done lies within a city or platted town,permission must also be obtained from such city or town. 3. Where work on or near the traveled roadway is necessary, proper traffic signs,channelizing devices,warning lights, and barricades shall be erected to protect traffic,employees,and pedestrians. To date, attached is the list of accounts that will need to be adjusted for water usage due to the running of water to avoid freezing services. 33 customers called and 19 of them utilized more water than their history reflects for normal usage. Because of this, staff is requesting that the usage for these accounts be adjusted to minimum usage for the winter quarter. 685,000+gallons were utilized; minimum billing would bill 285,000 gallons. This is 340,000 gallons of unbilled water, or approximately$970.00 in total water costs. This adjustment should be made also to reduce the sewer bill for this period. Winter quarter is the usage that we use for determining the sewer charges for residents for the next 3 quarters. This adjustment results in a loss of sewer charges of$1,800; (340,000 gallons at the appropriate rates) for this winter quarter. Requested Action: Authorize the rebates as discussed above and permit the City Staff to make necessary future adjustments to residential units should they be in the same order of magnitude.
