Oak Park Heights, MN 55082 Re: Early Morning Deliveries—City Nuisance Ordinance 1109.4 Dear David, As you may recall from our conversation of this past August, deliveries are not to occur to your home based business prior to 7 a.m. At that time, you were going to contact your suppliers to notify them that deliveries prior to 7 a.m.are not permitted. Deliveries or other peace disturbing activities are a violation of City Nuisance Ordinance (enclosed) 1109.4.Z that described such a violation as "All unnecessary noises which tend to disturb the peace and repose of neighboring property owners." When you were issued your home occupation permit in 2007, you were specifically advised that the permit was being issued for a home based business that did not generate retail traffic and that at such time your business changed in its composition in that you would generate retail traffic, you would wish to stock regular inventory beyond the items needed to prepare your merchandise or experience such a change that the business goes beyond that of a home based administrated business, you would be required to reapply for an amended Home Occupation permit as a Conditional Use to your residential property. With this letter, I am directing that you immediately take all necessary steps to notify your delivery people that no deliveries are to be made to your home based business until 7 a.m.or later. Please note that if activity continues, that is found to disturb the peace and repose of your neighboring property owners, such as deliveries or any other peace disturbing activity prior to 7 a.m., it is likely that your home occupation license will be reviewed for approval compliance. Such a review may result in your needed to reapply for your license as a Conditional Use to the residential property and potentially revocation of your home occupation permit.
