HomeMy WebLinkAbout2013-10-10 PC Recommending Resolution A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY,MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY BARRY SCHALKE, REPRESENTING MINNESOTA OUTDOOR SHOOTING SPORTS, FOR DESIGN STANDARDS/SITE PLAN REVIEW AND A SIGN VARIANCE, TO REPURPOSE THE BUILDING AND SITE AT 12969 60TH STREET NORTH TO A SPORTING GOODS STORE AND INDOOR GUN SHOULD BE APPROVED WITH CONDITIONS WHEREAS,the City of Oak Park Heights has received a request from Barry Schalke,representing Minnesota Outdoor Shooting Sports, for Design Standards/Site Plan review and a Sign Variance,to repurpose the building and site at 12969 60th Street North to a . sporting goods store and indoor gun range, and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property is zoned B-2 General Business District in which retail stores and commercial recreation such as the indoor firearms range is a permitted use; and 4. The sign variance is required to allow a 40 foot freestanding sign in the Destination Retail Highway Sign District; and 5. Design Guideline/Site Plan approval is required for the building remodel and site improvements; and 6. City staff prepared a planning report dated October 2, 2013 reviewing the request; and 7. Said report recommended approval of the Design Guideline/Site Plan review and the sign variance subject to the fulfillment of conditions; and 8. The Planning Commission held a public hearing at their October 10, 2013 meeting,took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW,THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted from Barry Schalke, representing Minnesota Outdoor Shooting Sports, for Desin Standards/Site Plan review and a Sign Variance, to repurpose the building and site at 12969 60ffi Street North to a sporting goods store and indoor gun range, affecting the real property as follows: SEE ATTACHMENT A The Planning Commission recommends to the City Council of the City of Oak Park Heights approval of the variance for the freestanding sign height subject to the following findings of fact: 1. The variance criteria in Section 401.04 of the Zoning Ordinance have been reviewed and it has been determined by the Planning Commission and City Council that the variance criteria for the additional sign height is justified. 2. Due to the location of this business in that the building will have limited visibility from Highway 36, allowing only a 30 foot sign would cause an undue hardship for the business and the ability of the customers to locate the building. 3. The additional sign height will ensure visibility and identification of the business from both east and west bound traffic on Highway 36. The approvals are subject to the following conditions recommended by the Planning Commission: 1. All grading, drainage, erosion control, and utility plans are subject to review and approval of the City Engineer. Storm water plans are also subject to review and approval of the Valley Branch Watershed District. 2. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. 3. The plans shall be revised to indicate which fixtures are to remain and which are being replaced. A photometric plan is required for City staff review and approval. 2 4. The Planning Commission was favorable to the building design and building materials. The applicant shall provide building material samples for City Council review. 5. Plans shall be provided for the trash enclosure gates subject to review and approval of City staff. 6. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 7. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. 8. The Planning Commission recommended approval of the request for the 40 foot pylon sign variance. 9. The Applicant shall remove one of the proposed wall signs on the west elevation or apply for a sign variance. 10. The Applicant shall provide pedestrian access through the site from the 60th Street or Neal Avenue trail to the front entrance of the building. 11. Outdoor lighting for the parking areas shall be turned off one hour after closing, except for approved security lighting. 12. All signs shall be designed to comply with the Zoning Ordinance requirements for internal illumination. 13. The landscape plan shall be subject to the review and approval of the City Arborist. 14. The site plan shall be subject to review and approval of the Fire Marshal. 15. The plan should be revised to include at least four disability stalls adjacent to the building. 16. A bike rack should be identified on the site plan and placed on site. 17. Sound levels generated from the site shall be in compliance with Section 401.15.B.11 of the City Zoning Ordinance. All of the gun range activity is to be conducted indoors. There will be no range activity outside of the building. City Council 4/5 Variance—Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the variance shall become null and void twelve(12)months after the date of approval,unless the property owner or applicant has substantially started the construction of any building structure, addition or alteration, or use requested as part of this variance. The property owner shall have the right to submit an application to extend the approval of a variance to the Zoning Administrator not less than thirty(30) days before the expiration of said approval.
