CONTINUED CITY COUNCIL MEETING MINUTES
I. Call to Order: The meeting was reconvened at 5:00 p.m. by Mayor Beaudet.
Present: Councilmembers Abrahamson, Doerr and McComber. Staff present:
Administrator Johnson and City Attorney Vivian. Absent: Councilmember
Swenson.
Mayor Beaudet, seconded by Councilmember Doerr, moved to add "Budget" to
the agenda. Carried 4 — 0.
City Administrator Johnson read a statement into the record concerning the
Executive Session that was held at the previous meeting:
"Following the City Council Meeting of July 11, 2006, the City Council
for the City of Oak Park Heights, acting upon the request and advice of the
City Attorney, conducted a closed session meeting, pursuant to Minn. Stat.
§13D.01, et. seq. and 595.02(b), to discuss matters of pending or
threatened litigation involving Gladstone Construction Company.
• The closed meeting was attended by all city council members, Eric
Johnson, the City Administrator, and Mark Vierling, City Attorney.
The City Council reviewed status of the matter with the city attorney and
provided direction on strategy. No additional formal action was direction
by the council during the meeting other to formally commence the action."
H. Autumn Hills Park Shelter
Councilmember Abrahamson, seconded by Councilmember McComber, moved
to approve the Resolution allowing Gladstone Construction to withdraw their bid
without prejudice. Roll call vote taken; carried 4 — 0.
City Administrator Johnson explained that the project architect discussed the bids
for alternates 1 and 2 with DNR Construction and found that DNR made a clerical
error on that portion of the bid document. Councilmember McComber, seconded
by Councilmember Abrahamson, moved to approve the Resolution allowing DNR
Construction to change their bid on alternates 1 and 2. Roll call vote taken;
carried 4 — 0.
Mayor Beaudet, seconded by Councilmember Doerr, moved to reject bids from
• bidders who did not bid on alternate 5 as incomplete bids. Carried 4 — 0.

is Mayor Beaudet stated that DNR Construction was the low bidder on the project.
Discussion was held concerning funding for the project with Administrator
Johnson noting that the City is in possession of a check from VS SA for $100,000
to go toward the project.
Councilmember Doerr, seconded by Councilmember Abrahamson, moved to
accept DNR Construction as the low bidder and to include alternates 1, 2, 4 and 5.
Roll call vote taken. Carried 3 — 1, Mayor Beaudet opposed.
III. Comments on Final EIS — St. Croix River Crossing /STH 36 Proiect
Mayor Beaudet, seconded by Councilmember Doerr, moved to approve the letter
to MnDOT as prepared by the City Attorney. Carried 4 — 0.
Mayor Beaudet, seconded by Councilmember Doerr, moved to approve the
Resolution on comments to the EIS. Roll call vote taken. Carried 3 — 1,
Councilmember McComber opposed.
IV. Budget
Councilmember Abrahamson, seconded by Councilmember McComber, moved
• to direct staff to prepare the draft 2007 budget with cost of living adjustments
outlined in labor agreements, increase for fuel costs and with the current capital
policy in place. Carried 4 — 0.
VIII. Adiournment.
Councilmember Abrahamson, seconded by Councilmember McComber, moved
to adjourn at 5:27 p.m. Carried 4 — 0.
