recycle and to increase fire prevention awareness, the City rewards two
residents each month with their choice of an award of $25.00 or a fire
extinguisher and/or smoke detectors).

had your recycling bin out with your regular garbage. Your recycling was out

CITY COUNCIL MEETING MINUTES
I. Call to Order/Pledge of Allesiance/Approval of Agenda: Mayor McComber
called the meeting to order at 7:05 p.m. Present: Councilmembers Dougherty,
Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson, City
Attorney Vierling, City Engineer Long, and Police Chief DeRosier. Absent: City
Planner Richards.
Councilmember Swenson, seconded by Councilmember Liljegren,moved to
approve the Agenda. Carried 5-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported that the Minnesota Depoartment of
Corrections Community Advisory meeting was set for May 29, the MCES
Municipal Customer Forum was set for May 29, the St. Croix River
Crossing Project Tour was set for May 30, and the Parks Commission
meeting was set for June 16 at 7 p.m. with a worksession at 6 p.m.
B. Councilmember Dougherty: No report.
C. Councilmember Liljegren: No report.
D. Councilmember Runk: No report.
E. Councilmember Swenson: He reported that he attended the Cable
Commission meeting and there was discussion on the franchise agreement
relating to the sale of Comcast. He stated that more updates were
forthcoming.
F. Staff. Deputy Clerk Pinski reported that Frederico Banales of 5554 Novak
Avenue North was chosen as the recycling award winner.

Councilmember Swenson, seconded by Councilmember Dougherty, moved to
approve the Consent Agenda. Roll call vote taken. Carried 5-0.
V. Public Hearings:
None
VI. Old Business:
A. St. Croix River Crossing Project: No updates.
B. Advanced Warning Flashers—Nova Scotia and 58"' Street:
Councilmember Runk, seconded by Councilmember Dougherty, moved to
approve installation of advanced warning flashers at Nova Scotia and 58'
Street at a cost of$11,905 with funds coming from the Park and Trail
Dedication Fund. Carried 5-0.
C. Establish TIF Area 1-2 and Related Ehlers Agreement—Revised Schedule
and Updated Resolution: Councilmember Swenson, seconded by
Councilmember Liljegren, moved to table the item. Carried 5-0.
VIL New Business:
A. Authorize Torch Run and 5K Event Upon City Properties—Special
Olym2ics: Councilmember Swenson, seconded by Councilmember
Dougherty,moved to authorize the event and waive the$500 impact fee.
Carried 5-0.
B. SRO Position—Stillwater Area High School: Tom Lehmann, School
Board Chairperson,was present at the meeting and stated that the school
district was in a budget situation and was looking at ways to reduce costs.
He stated that safety was important and was taken seriously. He said that
the goal was to work out a solution. Mayor McComber questioned
whether the school district was looking at eliminating the position, or if
they were looking at reducing the position to part-time. Lehmann
responded that it was not his advice as School Board Chairperson,but he
did not believe there were looking at completely eliminating the position.
He stated his thought was that having an officer present at the high school
was a deterrent and was beneficial.
Dr. Ryan Laager, Director of Curriculum and Secondary Education came
forward and stated that the high school did have a four-person security
team. He stated they were going to build a vestibule at the administration

office that would control the entrance. He stated they were looking to cut
$70,000 from the budget and had approached Police Chief DeRosier about
reducing the school resource officer position to part-time.
Councilmember Swenson stated that the City could not afford to have that
position taken away. Councilmember Runk stated that the school district
would have to understand that any calls received would be priority ranked,
and if there wasn't a full-time SRO, their calls may not be responded to as
quickly as they were currently. Mayor McComber stated she would not
have voted to pass the levy if the school district was going to cut security.
Dr. Laager stated they would like to propose a three-year part time
proposal contract. He stated they were looking at grant opportunities, and
they did speak with the mayor of Stillwater for support. He stated they
were not looking at eliminating the position, but rather wanted a reduction.
Lehmann reported that the next school board meeting was set for June 12.
Councilmember Swenson, seconded by Councilmember Liljegren, moved
to authorize staff to draft a Resolution for the next meeting outlining the
City Council's thoughts on the matter. Carried 5-0.
VIII. Other Council Items or Announcements
Mayor McComber wished Officer Fred Kropidlowski well and good luck for his
retirement.
IX. Adiournment
Councilmember Swenson, seconded by Councilmember Dougherty,moved to
adjourn at 7:45 p.m. Carried 5-0.

Quotes for Removal & Pruning of Trees in Brekke Park
615/14
1. Woodchuck Tree Service=$3,560.
2. St. Croix Tree Service (now St. Croix SavATree) = $ 6,315.
3. S&S Tree & Landscape Specialists= $13,500.
Quote request was sent to five tree services who work in this area. Three quotes were
received as of closing time(4:00 p.m.) and date(615114). The work includes removal of
60 dead/dying or risk trees from Brekke Park. Work also includes pruning several trees
and removing a tall stump. Work is to commence after 6111114 and be completed by the
end of July 2014. This work is within the city's budget for contracted tree work for 2014.
Woodchuck Tree Service has submitted the lowest quote for the work. To my
knowledge, this company has not done work for the city in the past. I recommend that
Woodchuck Tree Service be awarded this work, contingent upon checking of references,
confirming details re: removal of debris, and procurement of a Tree Worker's Licence for
the City of Oak Park Heights. If, for some reason,the company with the lowest quote is
not approved, or withdraws their quote, the work would be awarded to the next lowest
quote, which in this case is St. Croix SavATree.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY,MINNESOTA
RESOLUTION AUTHORIZING THE RCEIPT OF A DONATION
FROM RESIDENT JIM KREMER
WHEREAS, Oak Park Heights Resident Jim Kremer was randomly selected to
receive the City's bi-monthly recycling award for the first recycling day in May based on
his participation in the City's recycling program; and
WHEREAS, recycling award winners are given the choice to receive a fire
extinguisher, a smoke detector, or a$25.00 award for participating in the City's recycling
program; and
WHEREAS, Mr. Kremer wishes to donate the $25.00 award to the City of Oak
Park Heights to be used toward installing something in the roundabout outside the City
Hall's main entrance.
WHEREAS, the City of Oak Park Heights is grateful for Mr. Kremer's donation
and concern for his community.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the City shall accept Mr. Kremer's donation of$25.00 and that the City is
authorized to expend such funds for the purposes of installing something in the
roundabout outside the City HalI's main entrance.

LMCIT requires that a Liability Coverage Waiver Form is adopted annually by the City
Council.
The City has waived the monetary limits on tort liability for many years. We purchase liability
coverage of$1,500,000 per occurrence (statutory limit), in addition, we purchase excess
liability coverage of$1,000,000.
I have reviewed this option with the insurance representative and with legal counsel and
would recommend that the City continue to waive the statutory limits.

SECTION I: LIABILITY COVERAGE WAIVER FORM
Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide
whether or not to waive the statutory tort liability limits to the extent of the coverage purchased. The
decision to waive or not to waive the statutory limits has the following effects:
If the city does not waive the statutory tort limits, an individual claimant would be able to recover no
more than $500,000. on any claim to which the statutory tort limits apply. The total which all claimants
would be able to recover for a single occurrence to which the statutory tort limits apply would be
limited to$1,500,000. These statutory tort limits would apply regardless of whether or not the city
purchases the optional excess liability coverage.
If the city waives the statutory tort limits and does not purchase excess liability coverage, a single
claimant could potentially recover up to$1,500,000. on a single occurrence. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to $1,500,000., regardless of the number of claimants.
If the city waives the statutory fort limits and purchases excess liability coverage, a single claimant
could potentially recover an amount up to the limit of the coverage purchased. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to the amount of coverage purchased, regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.
This decision must be made by the city council. Cities purchasing coverage must complete and
return this form to LMCIT before the effective date of the coverage. For further information, contact
LMCIT. You may also wish to discuss these issues with your city attorney.

In 2013,the City Council and Park Commission discussed the possibility of installing soda machines at City Parks,
being Brekke and Autumn Hills(inside). Staff has outreached to a local vendor Mr. Henry Gullickson who is a Pepsi
representative and who could supply the machines,maintain these and keep them in proper condition. Mr.
Gullickson also works with the City of Stillwater. During the 2013 year, Mr. Gullickson did have such machines
installed the following was his sales figures—May thru October 2013.

If the City Council does desire to again allow these machines in the City Parks,I have taken the opportunity to draft
a short agreement that would again outline the general parameters of the relationship for liability,safety,cleanliness
and removal of such equipment.The proposed agreement does not allocate any dollars to the City as part of any
earned revenue;however the City would have no responsibility for machine maintenance or to protect it from
damages. The essential risk lies almost entirely with the Vendor. However,the benefit to park visitors would be this
vending option.
Staff has not had any service or other issues of note to date with these machines or locations
The City Council is again generally comfortable with the concept,it may desire to have the City staff'and City
Attorney finalize the Agreement with Mr.Gullickson and have these units installed for the upcoming season.
(Please note that Mr.Gullickson did donate two bicycles for the 2013 Party in the Park event—raffle).

Vending Agreement
Agreement,dated as of May 1st, 2014 between Mr.Henry Gullickson("The Vendor")and the City of Oak Park Heights(the
"City'):
WHEREAS, VENDOR desires to provide certain vending machines at Park facilities owned and/or operated by City
consisting of refreshment and other vending services,and
WHEREAS, City desires to engage the services of VENDOR as the non-exclusive provider of said vending services at
designated Locations;
NOW,THEREFORE,for the reasons set forth above,and in consideration of the mutual promises and agreements herein
set forth,VENDOR and City agree as follows:
1. VENDOR shall install, maintain and service all vending equipment("Machines")and is limited to a single soda-
vending machine only and at designated City Locations, Brekke Park and Autumn Hills Park, (See Exhibit A).At
no time shall the Machines be deemed the possession of City;they are,and will remain,under the control of
VENDOR.All equipment shall be maintained in good working condition.
2. City shall have the right to approveldisapprove of the specific placement of Machines at Locations in City sole
discretion. During the term of this Agreement, VENDOR shall pay City Facility Rental Income(FRI)as follows:
$0.00.There shall be no minimum revenues guaranteed by the City.
3. Water shall be vending choice in all machines and shall be kept stocked with appropriate product and in a volume
reasonably similar to all other offerings.At all times,the machines shall be kept clean and in good appearance
without any broken facing or graffiti,free of debris,dirt,etc.The machines shall not be internally lit if they directly
face a residential area.
4. The VENDOR shall place a clearly marked label or sign on all machines that provides a phone number so that
machine users are able to seek any applicable refunds directly from the VENDOR.The VENDOR is directly
responsible for and shall appropriately manage any refunds requested by park patrons.
5. The VENDOR during the term of this Agreement,shall not be required to pay a commission to the City which is
typically equal to a percentage of all gross revenues(less applicable State imposed sales tax and deposits)
collected from the sale of beverages vended from the Machines.
6. The initial term of this Agreement shall be twelve(12)months commencing as of the date written above.
Thereafter,the term may be extended for an additional twelve(12)month period at the sole discretion of the City
conveyed to the Vendor by written notice.Either party may terminate this Agreement without penalty providing the
other party with by thirty days written notice of such discontinuation.
7. The machines are anticipated to remain at their locations through the off-seasons.The Vendor shall however be
obligated to remove the machines should the City request such removal. In some circumstances,these machines
may not be accessible to the general public during periods in which park shelters may be closed.
8. VENDOR will provide City with a full accounting of all revenues received from Machines at City Locations.

9. If VENDOR undertakes to deliver a required vended service at designated City Locations, i.e.,beverages,snacks,
cold food etc.,City shall not permit competing vendors to operate at said designated Locations.This provision
shall not apply to beverage products brought onto the premises by patrons or groups using park facilities.
10. City shall allow VENDOR and its contracted personnel access to City Locations during normal business hours to
install,fill,and service the Machines at said Locations.
11. City may elect to give VENDOR detailed notice of non-performance hereunder. Upon the receipt of such written
notice,VENDOR shall have at least ten(10)days to remedy or cure the facts giving rise to such alleged non-
performance hereunder. If VENDOR has not affected such a remedy or cure within the prescribed time period,
City may terminate this Agreement if said non-performance is material in nature.Said termination shall be
effective ten(10)days after City's issuance of written termination for cause.
12. Upon any form of contract termination,the VENDOR shall,at the Vendor's sole expense,remove all equipment
and/or machines from the City's premises.
13. The VENDOR may not assign their responsibilities as outlined in the Agreement to a third-party without the City's
written permission.
14. Except for willful or knowingly negligent acts on the part of the City,the City is not responsible for any damages to
the VENDOR'S property.The VENDOR does hereby indemnify,will defend and holds harmless the City and its
agents from any loss or liability sustained as a result of the use of the property by the VENDOR.The City makes
no warranty or guaranty of suitability for the placement of any machines, Use of City locations is at the
VENDOR'S own risk.
15. If any term or portion of this Agreement shall be deemed invalid or unenforceable,the remainder of this
Agreement shall not be affected. No waiver by VENDOR of any breach by City hereof shall be construed as a
waiver of any other breach.This contract is binding upon the heirs,successors and assigns of both parties.This
contract shall be construed under the laws of the State of Minnesota.

A RESOLUTION BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS
OUTLINING THE CITY COUNCIL'S POSITION ON THE ALLOCATION OF
NECESSARY RESOURCES BY THE STILLWATER AREA SCHOOL DISTRICT TO
CONTINUE THE FULL-TIME PRESENCE OF THE SCHOOL RESOURCE OFFICER
Whereas at the time of the construction of the Stillwater Area High School located at the
southeast corner of STH 5 and 58"' street in 1990, the City of Oak Park Heights (the "City") and
the Stillwater Area School District (The "District") agreed upon a specific provision to allocate a
part-time police officer to the High School to provide a positive law enforcement presence, and;
Whereas, at that time the City and the District agreed that twenty-five percent of any allocated
School Resource Officer("SRO") costs would be paid for by the District, and;
Whereas, over the past fifteen years, the City and the District have worked together to develop
that SRO into a positive, effective full-time presence and for which the District agreed to
increase the annual funding to cover substantially the costs of the position, and;
Whereas, the City must carefully consider the safety of 4,000 students and staff at the High
School and as such the City dedicates an officer, the SRO, to that purpose and which includes
extensive training and engagement, and;
Whereas, the SRO typically handles more than 150 documented calls for service from the High
School and which is in addition to the assistance provided to staff and students that are not
documented and which likely saves other District staff valuable time, and;
Whereas, given the recent history of escalating school violence nationwide, the SRO position
offers a balanced deterrent to possible, although unlikely, violent situations, and;
Whereas, the District has informed the City of Oak Park Heights of a tentative plan to eliminate
the full-time funding of the SRO, and instead rely on alternative security programs such as
private security agencies at the entrances of the property;
NOW THEREFORE BE IT RESOLVED that the City Council for the City of Oak Park Heights
does state the formal position that the SRO position should remain a full-time, sworn peace —
officer role and that the District should provide the adequate funding for such position as has
been historically provided.

BE IT FURTHER RESOLVED that should the District not maintain the necessary full-time
funding for the position, the City would formally inform the District that the City's Police
Department could not respond to the High School for calls for services in any higher regard than
other calls for services from others in the City.
BE IT FURTHER RESOLVED that the District must acknowledge that the City cannot provide
a full-time SRO in one year, a part-time the next year, etc.; rather a long-term written
commitment to the SRO position should be forged between the City and the District so as to
guaranty that such SRO presence, in a full-time capacity, remains vital and highly visible.

The City would ultimately seek full removal and abatement of such items from the Property and would be based on the
'Final Report`to be provided by the Contractor under this RFQ to the City.Accordingly, a comprehensive review and
report must be prepared that identifies areas that are in need of abatement prior to the demolition of the structure. R is
anticipated that as.a result of any future abatement, all materials would be permitted to be disposed of at a
"demolition4type°landfill without the need for separate handling or use of a hazardous materials disposal site.
FOR EACH PROPERTY. General Conditions and Requirements:
The Contractor shall perform a Property study and investigation for the presence of asbestos and/or lead
contamination.The Contractor shall follow all Minnesota Department of Health ( MDH) , Environmental
Protection Agency (EPA) , and Nationa# Emissions Standards for Hazardous Air Pollutants ( NESHAP)
standards and protocols for asbestos and lead inspection and will fully survey the Property. The term
Property includes all buildings,garages,sheds,etc.
Representative samples of materials will be collected for analysis and such analysis shall be completed
promptly. Suspect asbestos and lead containing materials will be identified, quantified and in sufficient
detail so as to provide an abatement firm dear and direct information as to what Items shall be
removed.
• it is understood that the Property may not be vacant, but the Property is readily accessible. It is
understood that building materials may be damaged as reasonably necessary to collect samples,
walls anchor ceilings may be penetrated to inspect for hidden materials. Reasonable care shall be
taken to ensure that excessive or unnecessary damage does not occur.

• Materials considered suspect for lead or asbestos that the City anticipates being identified and
subsequently sampled include, but not limited to roofing, flooring, flooring adhesive, sheetrock,
wall-ceiling texture, tiie grout, caulking, sealants, insulation, exterior siding, 'transite', and
thermal insuiat€on (Le., Moiler, piping, or duct),etc. And throughout the entire Property.
• All subsequent oollecUon, testing, analysis and reporting shall follow all EPA, MDH,American
Industrial Hygiene Association (AIHA) protocols including the use of an accredited laboratory
(AIHA, NVIAP) for any and all testing,

• This investigation and testing must similarly follow all state and federal protocols that govern the
testing for,reporting on and the consideration of future abatement of asbestos or lead-based paint or

• It Is anticipated that no excavation will be performed as part of Contractor's Inspection. If
requested, arrangements may be made for further Inspection during excavation activities and on a
'time and materials' basis consistent with prevailing industry standards.
• It remains the responsibility of the Contractor to immediately advise the City of the discovery of
other hazardous materials (other than asbestos and/or lead) that may be discovered while
performing the investigation and study of the Property, The Contractor's communication in this
regard to the City may be Immediately verbal, but must be followed by written notice within 24
hours of any such discovery.
• Upon completion of the inspection and receipt of analytical results, the Contractor will complete
and shall provide to the City a Final Report, which will include a detailed summary of survey
activities, metfhods, and results of all Investigations, samples and will also Include a detailed listing
of required abatements for asbestos and/or lead—This Final Report is a"Deliverable'and shall
be used to guide specific abatement activities.
• Irrfonnation regarding discovered asbestos material type, lotion, approximate quantity,and the
EPA NESHAP categorization (Friable, Non-f=riable Category I or Category II) shall also be
provided In the Final Report. This lnformatkm will assist with the determination of handling the
materials during demolition planning. Current state and federal regulations will be referenced. The
Final Report shall also include a summary section that recites in non-technical forms, the needed
actions on the part of the City to fully abate the hazardous materials found in the Property.The
final and awarded contractor shall provide proof of general liability insurance in an amount not less than
$1,0130,0DO naming the City as an insured party In the event of failure on the part of the contractor to
correctly ideality conditions that will be require abatement and dispose of the materials in fashions allowed
by law and shall fully indemnify the City from loss and/or liability.
• Upon the execution of a final contract document that will incorporate the terms and conditions of this RFQ
and unless otherwise agreed to in writing,the City will require that all on-site work be completed w€thin two
weeks of Notice of Project Award and an acceptable Final Report to be provided to the City within ten(10)
basirM dam complete of the on-site investigations. Failure to provide the City and able
Final Report within the specified timetnes will allow the City to withhold up to 5 percent of the quoted pka.

The League of Mn Cities Summary of Legislative Changes is expected to be published June 16,
2014. This is a summary of the changes and legislative actions that will affect cities and the
budgets.
Changes for 2015 will include a possible change to health insurance that will be beneficial to the
employees as well as help reduce the City's expenditure. I am unsure of the status of this change
at this time but will calculate the cost for the 2015 budget when it is available.
Some preliminary calculations for the 2015 budget, based on legislature and league estimates,
will result in the following:
• Local Government Aid—No change. Still not a recipient.
• Levy Limits -None for 2015
• Filing of Proposed Tax Levy with the County changed from 9115 to 9/30.
• Increase in General Plan Pension(PERA) by .25% - Increase of$2,500
• Increase in Pension for Police 15.3%to 16.2%..........Increase of$8,250.
• Change in Health Insurance—unknown at this time.
• Implicit Price Deflator based on 1ST quarter 2014 is 1.315% (Based on 2014 Expenses-
$29,000 increase in General Fund Expenses)
• Salary Increases based on Contracts 2.75%- $52,000 estimated increase

The Code shall be enforced within the extraterritorial limits provided by Minnesota Statute
§16B.62, Subd. 1,when so established by this ordinance.

The code enforcement agency of this municipality is called the City of Oak Park
Heights. This Code shall be enforced by the Minnesota Certified Building
Official designated by the City to administer the Code as provided by Minnesota
Statutes §16B.65, Subd. 1.
301.03 Permits,Inspections,and Fees. The issuance of permits and the collection of fees shall be as
authorized by Minnesota Statute§ 16B.62,Subd. 1. Permit fees shall be assessed for work
governed by the Minnesota State Building Code in accordance with the fee scheduled adopted by
the City of Oak Park Heights and is hereby incorporated by reference herein.Said fee schedule is
subject to change and is made part of this ordinance by reference herein. In addition,a surcharge
fee may be collected on all permits issued for work governed by the Minnesota State Building
Code in accordance with the provisions of Minnesota Statutes§16B.70.
301.04 Violation and Penalties.By the provisions of Minnesota Statute § 16B.69 and Minnesota Rules
Chapter 1300,a violation of the Code is a misdemeanor.
301.05 Repeal.All ordinances in conflict or inconsistent with the provisions of this Ordinance are hereby

BACKGROUND
At their April 10, 2014 meeting, the Planning Commission discussed setbacks for
parking areas adjacent to lot lines and right of way lines. The Planning Commission
agreed to the language that had been proposed by City Staff to clarify the intent of the
Zoning Ordinance. It was determined that a public hearing should be scheduled for the
May meeting.
The Planning Commission, at their March 13, 2014 meeting, held the public hearing and
discussed the site layout and the proposed building at 13999 601h Street North referred
to as the Gateway Building. At the meeting, Commissioner Thurmes asked where the
right of way easement line was on the east side of the property. The actual property
line is approximately 32 feet from the east edge of the proposed parking lot, but the
survey and the layout plans do not identify the right of way line. The Planning
Commission discussed whether the 10 foot setback for the parking lot was addressed in
the proposed plan, In that the location of the right of way line was not identified on the
survey or plans, the Planning Commission added a condition that the Applicant provides
a plan showing that information and for City Staff to determine if a variance is required.
The Applicant provided a revised layout plan indicating the Minnesota Department of
Transportation easement. It is directly adjacent to the east line of the proposed parking
lot. City Staff has reviewed the Zoning Ordinance and determined that a variance was
not required in this case. The Zoning Ordinance states in Section 401.15,E the
following:

17) Curbing and Landscaping. Except for single and two family dwellings, all open, off
street parking shall have a continuous concrete perimeter curb barrier around the entire
parking lot; said curb barrier shall not be closer than 10 (ten) feet to any lot line. Grass
plantings and landscaping shall be provided in all areas bordering the parking area.
The language indicates that the setback for the parking area is 10 feet from a lot line. In
this case the parking lot is set back 32 feet from the lot line. The new frontage road and
trail in this area will be more than 25 feet from the proposed parking lot curb. The
setback was satisfied in terms of the Zoning Ordinance language. This issue was
addressed with the City Council when they considered the application for the Gateway
Building at their March 25, 2014 meeting. They agreed that a variance was not required
in this case, but the language should be clarified.
ANALYSIS
City Staff would suggest revised language that not only addresses property lines but
also right of way easement lines within Section 401.15.F.17 relating to parking lot
setbacks. Please find as follows the proposed new language that was reviewed by the
Planning Commission at the April meeting:

CONCLUSION/RECOMMENDATION
The Planning Commission should open the public hearing at the May meeting, take any
public comment, make any changes as necessary to the language and recommend the
Zoning Ordinance amendment to the City Council.

WHEREAS, City Staff requested that the Planning Commission consider an Ordinance
amendment to Section 401.15.F.17 of the Zoning Ordinance relating to setback
requirements for parking areas adjacent to lot lines and right of ways, and having
conducted a public hearing relative thereto, the Planning Commission of Oak Park
Heights makes the following findings of fact:
l. The Planning Comrnissim has reviewed the Zoning Ordinance at its April
10, 2014 meeting and has determined that an amendment to Section 401.15.F.17 of the
parking regulations related to parking setbacks is justified to require the 10 feet setback to
be applied to both lot lines and right of way; and
2. City Staff prepared a draft Zoning Ordinance amendment which was
reviewed by the Planning Commission; and
3. The Planning Commission held a public hearing at a May 15, 2014
meeting,took comments from the public and recommended amendments to the Zoning
Ordinance as found as follows; and
4. Section 401.15.F.17 of the parking regulations of the Zoning Ordinance, is
recommended to be amended to include the following. The proposed language is found
in bold print:
