Bloomington, MN 55431 White Bear Lake, MN 55110 Re: McDonald's #2288 @ 14545 60th St. N., Oak Park Heights, MN 55082 Dear Mr. Shimek and Duval: Several items remain outstanding and in need of attention with regard to the Oak Park Heights McDonald's location referenced above. Compliance items to the Temporary Certificate of Occupancy issued were due to the City prior to July 1, 2013 and remain outstanding. The following are to be provided and/or addressed by July 31, 2014: 1. Provide me with the energy envelope compliance certificate of the new building; 2. Provide me with the prefabricated building panel inspection approval document(s); 3. Provide me with the "As-Built" Certificate of Survey for this building; and 4. Contact Fire Marshal, Mike Bell at 651.775.5561 to coordinate key placement to the Rapid Entry lock box that was installed and has not yet been secured for rapid entry by the Fire Department. The landscaping deficiency that was brought to your attention in August of 2013 (see enclosed email communication)remains unresolved. Please communicate how the operator wishes to proceed on this via submission of a revised landscape plan or remittance of cash in lieu of tree replacement payment of$1,400,payable to the City of Oak Park Heights. The development account for the project (City Account No. 45770) currently has an outstanding balance of$52.00. Tree City U.S.A. Lastly, enclosed you will find a copy of the original Metropolitan Council SAC determination letter of September 12, 2012, clearly indicating that the addition of outdoor seating would be subject to SAC evaluation. Remit your outside seating plan, including dimensions of seating area and number of seats to Metropolitan Council for SAC review prior to June 30, 2014. SAC review submission forms can be found at their website www.metrocouncil.org under the wastewater and water tab. At such time, this business has not received a final Certificate of Occupancy. Please note that if all of the above items are not sufficiently addressed in total by July 31, 2014, the City will be required to revoke the Temporary Certificate of Occupancy until such time all items are fully addressed and completed, including any payments related to the SAC review for the outdoor seating. Most of the trees which were included on the plan dated 8/3/12 (date of submittal to city)were not installed as part of the current landscaping on site.According to my report on the landscape plan and tree replacement requirement for this project dated 9/11/12, based on the inventory of significant trees on the site,which I completed, the tree replacement requirement was 99 in. of replacement trees. In the approved landscape plan,they proposed to plant 33 in. of replacement trees, leaving a tree replacement requirement of 66 in.. The actual inches of replacement trees planted is 5 inches(1 spruce in front, 1 crab in back). Consequently, in addition to the original cash in lieu of tree replacement of$3300.,the project now owes an additional $1400. since the trees shown in the approved plan were not planted. There are shrub and perennial beds around the building and parking lot which somewhat resemble the beds indicated on the approved landscape plan and the landscaping which was installed looks fine. 1 It Metropolitan Council Environmental Services Jim Butler September 12,2012 Building Official City of Oak Park Heights 14168 Oak Park Blvd PO Box 2007 Oak Park Heights,MN 55082-2007 Dear Mr.Butler: The Metropolitan Council Environmental Services(MCES)Division has determined the SAC to be charged for the wastewater capacity demand for McDonald's to be located at 14545 60th Street N.within the City of Oak Park Heights. - The City will be charged 5 SAC Units for this project,as determined below. SAC Units Charges: Restaurant(includes future demolition) Indoor seating 93 seats in new plan—48 seats(paid 11/85)=45 seats 45 seats @ 10 seats/SAC Unit= 4.50 or 5 It is the Council's understanding there will be no outdoor seating. If at any time outdoor seating is added a determination should be made,as it is also subject to SAC evaluation. Please be aware that the demolition credit is being taken ahead of the actual building demolition and no other credit will be available. At the time of the actual building demolition note on your SAC-D form that the credit has already been applied to a new use. Also keep in mind all demolitions must be reported within one month of the end of the calendar year during which the demolition occurred,in order for the prior use to be eligible for any credit on the property. The business information was provided to MCES by the applicant at this time. It is the City's responsibility to substantiate the business use and size at the time of the final inspection. If there is a change in use or size,a redetermination will need to be made.
