SUBJECT MATTER: Petitioners request the annexation :of certain

The territory included within this petition consists -
of three parcels of land owned by three freeholders, all of
whom are individuals. The undersigned, constituting a majority
of the owners of the real property, hereby petition and request
the City Council of the City of Oak Park Heights, Washington
County, Minnesota, to annex the land legally described as
follows, to-wit:
The West Four Hundred (400) feet of the "Eatt -
Seven Hundred Thirteen (713) feet of the North
Three Hundred Twenty-five (325) feet of the
North Half of the Northeast Quarter (Nh of NEB)
of Section Five (5) , Township Twenty-nine (29) ,
Range Twenty (20) , and the. West Three Hundred
Thirteen (313) ,feet of the North Five Hundred
Sixty-five (565) ' feet Of Section ;Fi're:
Township Twenty-nine (29) , Range Twenty, (20) ,
all subject to existing highways and easements.
to the City of Oak Park Heights, and to extend the city
boundaries to include the same. The above-de scribed' property
is now owned as three separate parcels of land which, are
legally described on Exhibit A attached hereto.
In support of this petition, the undersigned
respectfully state:
1. That the aforementioned land to be annexed is
unpiatted land and does not exceed 200 acres in area.
2. That the property to be annexed is now or about
to become urban or suburban in character.
3 . That the land hereby petitioned to be annexed,
is now or about to be developed into commercial uses, and that

municipal government is required to protect the public
health, welfare and safety and to protect the future develop-
ments of the area.
4. That the annexation of the aforementioned land
is in the best interests of the City of Oak Park Heights in
that it will provide for planning and controlled developments
of utilities, provide room for expansion, and is in an area
which can reasonably be served for current fire, police and
general government facilities of the city.
5. A. That there are no residents residing in the
area to be annexed and that the population of the City of Oak
Park Heights is approximately 1, 940
B. That the area proposed to be annexed is
approximately 71 acres and that the area of the City of Oak
Park Heights is approximately 625 acres.
C. That the assessed valuation of the area to be
annexed.. is as follows: land $30,925.00, buildings $110,180.00,
total $141,1(0.00:- That the total assessed valuation of the
City of Oak a •-ark Heights is :$310,086,639.00 .
D. That the City of Oak Park Heights has grown
from a pop lotion of 332 iP 1960. to a population of 1,238
according, to the 1970 census. The present population is
estimated :to -be 1,940 . There have been substantial private
and public improvements within the city in the last 10 years.
The city is it the metropolitan area and under the jurisdiction
of the Metropolitan Council. Further population increase and
substantial construction is anticipated.
E. That the area to be annexed abuts upon the
westerly boundary of the City of Oak Park Heights and the
owners anticipate further development of the area within the.
very near future.
F. That the taxes in the area proposed to be
annexed will increase as the City of Oak- Park Heights has a
higher mill rate than the adjoining unincorporated townships,

but in turn the property owners: will obtain polic4jprotection, :
zoning and subdivision controls, utilities, and general
administrative services which will be'proportional to the
expected tax increase and will inure to- the benefit of your
petitioners and the area proposed to be annexed.
G. That it is feasible and practical that the afore-
mentioned municipal services be provided by the City of Oak
Park Heights.
H. That the property is presently located in the
Town of Baytown, but that the existence and continuation of
the said town will not be affected by the annexation of the
aforementioned property.
I. That the township form of government is not
able to cope with the aforementioned problems relating to the
public health, safety and welfare and the development of the
property as an urban or suburban area.
6. Attached hereto and marked Exhibit '`B is a detailed
map which reflects in outline the aforedescribed territory
which your petitioners request be annexed to the City of Oak
Park Heights.
7. The undersigned owners constitute a majority of the
owners and freeholders of the property proposed to be annexed.
8. That none of the territory proposed to be annexed is
presently included within the corporate limits of any
incorporated city, village or borough.
The undersigned freeholders petition the annexation of
the aforedescribed property to the City of Oak Park Heights
because we believe that these properties need municipal
government and municipal services which are not available
under the township form of government and are available from
and by the existing City of Oak Park Heights. We further

believe that the annexation of these properties will aid and
assist us in the planning and economic development of our
properties,

that Parcel No. II is owned by George N. Croft and is being
purchased on a Contract for Deed by David C. Linguist and
Leighton Johnson; that Parcel No, III is owned by David C.
Linguist. •

Dear Ken:
Since I last talked to you, I have had an opportunity
to check the Tract Index at the Register of Deeds ' office and
also our files regarding the question of whether Oak Park Heights
abuts on the property owned by Anderson Interiors, Inc. , which
is one of the parcels included in the above annexation.
According to my investigation, the only acquisition of
property by the City of Oak Park Heights in the area near the
proposed annexation was the condemnation of the property owned
by Bill Pauley, et al, which took place in 1974. In that regard,
please find enclosed a copy of the Partial Final Certificate and
the Quit Claim Deed which are of record in the office of the
Register of Deeds. It is my understanding, however, that this
condemnation has never been completed since Oak Park Heights has
not adopted the required ordinance. If it is the desire of the
City to acquire this property, such an ordinance should be
adopted.
In any event, it does not appear that this property
abuts any of the property included in the petition for annexation.
The property owned by Anderson Interiors, Inc , includes the North
565 feet of the NE a of the NE a of Section 5, Township 29 North,
Range 20 West. The most Northerly point of the property acquired
in the above described condemnation would be located approximately
657 feet from the North line of the NW4 of the NW4 of Section 4,
Township 29 North, Range 20 West. Accordingly, although both
parcels abut on Oakgreen Avenue, there is approximately a 100 foot
gap between the Anderson parcel and the parcel included in the
condemnation proceeding.

By copy of this letter to Anderson, Linguist and
Johnson, I am advising them of this fact. If they wish to
proceed with the proposed annexation, it would be necessary
that they amend the petition so as to include property located
South of Anderson Interiors, Inc. , which would abut on the
property acquired by condemnation. It would also, of course,
be necessary that Oak Park Heights complete the acquisition
of that property by adoption of the proper ordinance.
If the petitioners are unable or unwilling to amend
their petition, but still desire sewer and water extended to
their property, I would suggest that they submit a petition
to that effect.

PETITION FOR ANNEXATION
IN THE MATTER
OF THE PETITION OF CERTAIN
FREEHOLDERS FOR THE ANNEXATION OF LAND TO THE
CITY OF OAK PARK HEIGHTS , WASHINGTON COUNTY,
MINNESOTA
SUBJECT MATTER : Petitioners request the annexation of
certain lands located in the North Half
of the Northeast Quarter (N2 of NE4 ) of
Section 5 , and the Northwest Quarter of
the Northwest Quarter (NW'-4 of NWf of
Section 4 , all in Township 29 , Range e 20
Washington County, Minnesota, to the City
of Oak Park Heights .
The territory included within this Petition
consists of nine parcels of land owned by thirteen free-
holders , all of whom are individuals . The undersigned ,
constituting a majority of the owners of the real property,
hereby petition and request the City Council of the City
of Oak Park Heights , Washington County, Minnesota, to annex
the land legally described on Exhibit "A" attached hereto -
to the City of Oak Park Heights , and to extend the City
boundaries to include the same. The above-described
property is now owned as nine separate parcels of land.
The ownership interests and legal descriptions are set
forth on said Exhibit "A" .
In support of this Petition, the undersigned
respectfully state :
1 . That the aforementioned land to be annexed
is unplatted and does not exceed 200 acres in area.
2. That the property to be annexed is now or
about to become urban or suburban in character .
3 . That the land hereby petitioned to be annexed
is now or about to be developed into commercial uses , and
that municipal government is required to protect the public
health, welfare and safety and to protect the future devel-
opment of the area.

4 . That the annexation of the aforementioned
land is in the best interests of the City of Oak Park
Heights in that it will provide for the planning and
controlled developments of utilities , provide room for
expansion, and is in an area which can reasonably be served
for current fire, police and general government facilities
of the City.
5 . a. That there are three residences in the
area to be annexed and that the population of the City of
Oak Park Heights is approximately 2 , 591 .
b . That the area proposed to be annexed is
approximately 18 acres , and that the area of the City of
Oak Park Heights is approximately 1 , 400 acres .
c. That the total assessed valuation of the
area to be annexed is $158 , 222 .00 and the assessor' s
market valuation is $544 ,335 .00. That the total assessed
valuation of the City of Oak Park Heights is $43 , 343 , 294 .00
with personal property and $42 , 657 , 078 .00 without personal
property.
-d. That the City of Oak Park Heights has
grown from a population of 332 in 1960 to a population of
2 , 591 according to the 1980 census . There have been sub-
stantial private and public improvements within the City
in the last 10 years. The City is in the metropolitan area
and under the jurisdiction of the Metropolitan Council .
Further population increase and substantial construction
is anticipated.
e . That the area to be annexed abuts upon
the westerly boundary of the City of Oak Park Heights and
the owners anticipate further development of the area
within the very near future.

f. That the taxes in the area proposed to
be annexed will increase as the City of Oak Park Heights
has a higher mill 'rate than the adjoining unincorporated
townships , but in turn the property owners will obtain
police protection, zoning and subdivision controls , utili-
ties , and general administrative services which will be
proportional to the expected tax increase and will inure
to the benefit of your petitioners and the area proposed
to be annexed.
g. That it is feasible and practical that
the aforementioned municipal services be provided by the
City of Oak Park Heights . That Parcels No. 1 and 2 as
shown on Exhibit "B" are already hooked up to the Oak Park
Heights sanitary sewer system.
h. That the property is presently located
in the Town of Baytown, but that the existence and con-
tinuation of the said town will not be affected by the
annexation of the aforementioned property.
i . That the township form of government is
not able to cope with the aforementioned problems relating
to the public health, safety and welfare and the develop-
ment of the property as an urban or suburban area. That
the area is in need of storm sewer and sanitary sewer which
the Town of Baytown cannot provide.
6 . Attached hereto and marked Exhibit "B" is
a detailed map which reflects in outline the aforedescribed
territory which your petitioners request be annexed to the
City of Oak Park Heights .
7 . The undersigned owners constitute a majority
of the owners and freeholders of the property proposed to
be annexed; that the parties entitled to notice of this
Petition are : City of Oak Park Heights , Washington County,
Washington County Planning Commission, Baytown Township ,
and Baytown Township Planning Commission.

8 . That none of the territory proposed to be
annexed is presently included within the corporate limits
of any incorporated city, village or borough.
The undersigned freeholders petition the annexa-
tion of the aforedescribed property to the City of Oak Park
Heights because we believe that these properties need
municipal government and municipal services which are not
available under the township form of government and are
available from and by the existing City of Oak Park Heights .
We further believe that the annexation of these
properties will aid and assist us in the planning and eco-
nomic development of our properties .

Seggelke moved to hold a special meeting Tuesday, June 9th at
7 : 00 P.M. with Chaves, NSP, City Attorney, Planner and Engineer.

Lang moved to adjourn the HRA meeting, seconded by Seggelke.

Seggelke moved to return Abrahamson Nurseries bid bond in the

The Minnesota Municipal Board acknowledges receipt of your petition
for annexation. Please refer to the above docket number in future com-
munications regarding this proposed annexation.
It is the responsibility of the initiating party to meet all necessary
requirements before the board can accept the annexation ordinance for
filing. [Under Minnesota Statute 414.033, Subdivision 5, the city may
assist the petitioners in complying with these requirements.] In cases
where the procedure is initiated by service of a petition on a municipality
or by service of notice of intent on a town board, the ordinance must not
be passed until 90 days after the township has been served, unless the
town board signs a waiver stating they have no objection to the annexation.
The following checked requirements need to be met:
X The petition must be accompanied by a certification showing that
it was served upon the town board, county board, the council of any
abutting municipality, and the date filed. A petition must be served
upon s id parties within 10 days after filing the petition with the

X Under M.S. 414.033, Subd. 5, if the petition is not signed by all the
property owners of the land proposed to be annexed, the ordinance shall

proposed annexation after at least 30 days mailed notice to all pro-
perty owners within the area to be annexed.
The Department of Transportation Mapping Section will review the pro-
perty description, and you will be contacted if there are any problems.

On May 20, 1981, the Council of the City of Oak
Park Heights passed a Resolution supporting the above-referenced
Petition for Annexation, a copy of which is enclosed herewith
for your information. That annexation Petition and Resolution
have been filed with the Minnesota Municipal Board, and have
been docketed as M.M.B. Docket No. A03824 . The Town of Baytown
has objected to the annexation, and it is my understanding that
the matter will probably be set on for hearing within the next
couple of months.
The purpose of my writing is to make inquiry concerning
an amendment to the Oak Park Heights Comprehensive Plan to
reflect this property as an area proposed for annexation. In
reviewing the original draft of the Comprehensive Plan, it does
not appear that the area included within our Petition was
designated as proposed for annexation. It would be appreciated
if you could advise me as to whether or not the area has now
been included, and if not, what steps are required to amend
the Comprehensive Plan to provide for this property.

Attached is a draft of the textual amendment to the Comprehensive Plan
addressing the City's position on the proposed Greeley and 36th Annexation
(Anderson/Lindquist). Due to the relatively small size of the subject
area, the development of a graphic plan for this area similar to the Stillwater
Township Annexation Area Plan is not needed. A general statement regarding
the desired effect of additional development and circulation in the area is
felt to be sufficient.
It is also recommended that a statement be added to the text regarding
annexation on pages 69-71 of the Development Framework portion of the Compre-
hensive Plan to the effect of the following:
"It should be emphasized that the areas specifically noted in this text are
not intended to be inclusive of all future annexations to Oak Park Heights,
and that the City remains open to consider all lands for which annexation
petitions are made. Proposals for annexation that arise in the future will
be studied individually and the position of the City will be included in
the appendix of this report. "

Baytown Township Annexation
The area lying southeast of Highway 36 (212) and Oakgreen which was addressed
in the land use section of the Comprehensive Plan as being a logical addition
to the City, has been formally proposed for annexation. Five parcels of land
on the west side of Oakgreen Avenue have also been included in the petition.
The area in question includes residential and commercial uses and some vacant
land. It is surrounded by residences on the east, residences and agricultural
land to the south, a commercial use and agricultural land to the west, and com-
mercial uses to the north fronting on Highway 36 (212).
Further development of the area is expected within the very near future, which
would benefit from public utilities. The extension of utilities from Oak Park
Heights is the most logical means of providing utilities. Part of the annexation
area is already served by the Oak Park Heights Sanitary Sewer System.
Mixed Usage such as office commercial and higher density housing has been

proposed in the Comprehensive Plan to protect low density homes from highway
associated impacts. The existing uses are of the type that are desired in the
area. Some vacant land still exists that could develop into office or higher
density housing.
At the onset of additional development proposals, access and circulatory design
of the specific projects should be studied comprehensively with consideration
for the rest of the parcels and surrounding area. Care should be taken that the
residences to the south are not adversely impacted by traffic, lights, noise,
etc.

Dear Ms. Wilson:
A hearing will be held by the Municipal Board on the above-proposed boundary
adjustment. Minnesota Statutes 414 requires the Municipal Board to consider
certain specified factors in arriving at its decision. It is important
that you are prepared to present adequate testimony so that the board can
arrive at the best decision for the total area. The evidence presented on
the record will serve as the basis for the order subsequently issued by
the board.
State aids to your governmental unit may be adjusted because of the board's
decision and will be based upon the evidence received at the hearing. One
example is that the Department of Revenue will adjust the Local Government
Aids distribution based on the data you present at the board hearing on the
following: (1) population breakdown of the territory proposed for annexation,
the city, and the township, (2) the assessed value of the property proposed
for annexation, the city, and the township, (3) the township mill levy, for
township purposes only, on the area proposed for annexation payable in the
year of the annexation.
The parties involved may jointly stipulate facts into the record to expedite
the proceeding. Enclosed with this letter is a possible format for preparing
a stipulation. This format may also serve as a guide for the presentation
of evidence at the hearing. The stipulation should not be regarded as
complete evidence for the proceeding, but rather as a useful tool to assist
in the preparation for the hearing. If complete and accurate information
and maps are presented at the hearing it will facilitate a more expeditious
decision.

HRA meeting called to order by Chairman Seggelke at 6 : 50 P.M.
Present: O'Neal, Westphal , Lana, Sommerfeldt, Vierling, Wilson,
and Licht.
Discussion held regarding HRA projects, with Mr. Licht informing
the council that the preliminary phasing plan -would be completed
for the council meeting October 26th, and that further discussion
on the Chaves matter ?mould be continued at that time.
Lang moved to close the hearing, with O'Neal seconding. 5 aye
votes. Carried.
Sommerfeldt called regular mee inr Order- -t_7 :00 P.M. and
opened public hearing on t]e_Anderson/Lindtu Annexation
ammendment to the city comprelieizsive pIan. Clerk read public
hearing notice and presented affidavit of publication. Lang
moved to adopt a resolution adopting the proposed annexation as
part of the comprehensive plan. Seconded by O'Neal . Roll call
vote taken with 5 aye votes. Adopted.
O'Neal moved to authorize the planner to submit the above
ammendment to Metro Council and to add a text ammendment to

PROPOSED TEXT ADDITION TO APPENDIX OF THE OAK PARK HEIGHTS POLICY PLAN/
DEVELOPMENT FRAMEWORK:
Baytown Township Annexation
The area lying southeast of Highway 36 (212) and Oakgreen which was addressed
in the land use section of the Comprehensive Plan as being a logical addition
to the City, has been formally proposed for annexation. Five parcels of land
on the west side of Oakgreen Avenue have also been included in the petition.
The area in question includes residential and commercial uses and some vacant
land. It is surrounded by residences on the east, residences and agricultural
land to the south, a commercial use and agricultural land to the west, and com-
mercial uses to the north fronting on Highway 36 (212).
Further development of the area is expected within the very near future, which
would benefit from public utilities. The extension of utilities from Oak Park
Heights is the most logical means of providing utilities. Part of the annexation
area is already served by the Oak Park Heights Sanitary Sewer System.
Mixed usage such as office commercial and higher density housing has been
proposed in the Comprehensive Plan to protect low density homes from highway
associated impacts. The existing uses are of the type that are desired in the
area. Some vacant land still exists that could develop into office or higher
density housing.
At the onset of additional development proposals, access and circulatory design
of the specific projects should be studied comprehensively with consideration
for the rest of the parcels and surrounding area. Care should be taken that the
residences to the south are not adversely impacted by traffic, lights, noise,
etc.

Annexation of Stillwater Township land located north of Highway 212/36
between the western border (Summit Park) of the City and Oasis Avenue has
been an issue for many years. The City of Oak Park Heights provides utility
services to a major portion of this area and has taken the position that addition
of this area to the City would be a logical boundary extension. This position is
furthered by the factor of similar uses developing in the Township area as
compared to uses adjacent within the City. As such, the area is felt to be
best governed by one unit which can exercise uniform control and thus.establish
compatible transitions between activities. Based upon the City's policy and
position regarding this tract, a detailed area plan has been prepared and is
contained in the appendix to this report.
In dispute, however, is the jurisdiction which should annex this tract of land.
The City of Stillwater has also proposed that the land be brought into its
jurisdiction and an orderly annexation process has been formally established
between Stillwater, Stillwater Township and Washington County. As a con-
sequence, hearings on the annexation of the tract in question have been held
before the Minnesota Municipal Commission, at which both Stillwater, through
the Orderly Annexation Joint Powers Committee, and Oak Park Heights have
presented their cases. It is anticipated that the Municipal Commission's decision
on the area's annexation will be reached in the near term future.
While not formally proposed for annexation, the small area lying within the
southeast quadrant of Highway 212 (36) and Oakgreen would appear to be a
logical addition to the City. Since urban services for this area would likely
be provided by the City and its future development could adversely impact the
City's transportation framework if not designed according to sound development
policies and standards, its annexation should be studied and pursued in the near
future.
It is anticipated that annexation questions will continue to be major issues
for sometime in the future. In this regard, the City should continue to
monitor development activities in adjacent areas in an attempt to open
and maintain communications with adjacent units of government. Discussions
have, in fact, been initiated with Baytown Township and these efforts should
be furthered and continued so that agreement and orderly development can be
achieved.

• Accompanying this letter is a proposal to amend the Comprehensive Plan of
the City of Oak Park Heights. Specifically, the City has resolved to annex
22 acres of land lying south of Highway 212 along the west boundary of the
City of Oak Park Heights. The area is addressed in the City's Comprehensive
Plan as a logical addition to the City. A mixed usage of office commercial
and medium to high density residential has been designated for the area in
the Comprehensive Plan. No specific development plans have been proposed
for the area at this time.
The amendment has been summarized on the worksheet specified by the Metro-
politan Council . Ten copies of this worksheet have been enclosed for your
review.
If additional information is needed, please contact our office or Mrs. LaVonne
Wilson at the City.

On Monday, November 2, 1981, Pat Pahl of the Metropolitan Council
contacted our office to inform us that the Metropolitan Council found
the Comprehensive Plan amendment for the proposed Greeley and 36th
Annexation (Anderson/Lindquist) to have impact on metropolitan systems
and that a 90 day review was necessary.
The system impact results over the provision of sewer service to the
proposed annexation area. Ms. Pahl noted that Oak Park Heights' re-
maining sewer capacity had been allocated to undeveloped areas within
the City which are proposed to develop at high densities. Reallocation
of the sewer capacity will require some revisions to the Comprehensive
Plan Development Framework and the Comprehensive Sewer Plan. I asked
her to notify all of the City staff directly of the 90 day review. Upon
receiving the Metropolitan Council 's comments we shall arrange a meeting
with Ms. Pahl to determine what needs to be done to resolve this matter.

relative to storm drainage was noted. It was indicated that this was
not a major factor, but one which should be considered. From a subse-
quent conversation with Bob Briggs, we understand that you are looking
into this matter. We would as a consequence, request that you keep us
advised of your findings on this potential problem.
At our meeting we also went into sewer discharge concerns and from initial
indications, have gained acceptance of figures suggesting we are within
assignement limits. Al Brixius and I will keep you posted of this aspect
of the case and will clear material with you prior to going further with
Metro.

The Metropolitan Council , in reviewing Oak Park Heights' Comprehensive Plan
amendment application for annexation, has questioned whether the additional
sewer flow generated from the annexation area would cause the City to exceed
the projected 1990 sewer flow of .426 mgd as noted in the City's Comprehensive
Sewer Plan. The following information includes the sewer flow calculations
for the major undeveloped areas and the smaller infill development areas within
the City that are expected to be developed by 1990. These flow projections,
along with the flow projections from the annexation area, have added to the
City's 1981 total flow estimate to produce a 1990 total sewer flow projection
for the City of Oak Park Heights.

INFILL DEVELOPMENT
Within the City of Oak Park Heights, there are scattered areas of undeveloped
land. In some instances, the property has development limitations that pro-
hibit any type of development to occur on the property. Two areas comprise
the majority of undevelopable land in Oak Park Heights. A 30 acre site at the
center of the City is currently the disposal site for NSP fly ash. This is a
very low area with steep slopes, however, with continual filling of this area
development is anticipated in the distant future. The second site is located
north of Highway 36 along Panama Street. This area is zoned R-2 Low and
Medium Density Residential , however, severe slopes in this area present
obstacles to development. The developable infill areas within the City are
anticipated to be fully developed in the next ten years. The acreages of the
infill areas have been identified below, along with the expected sewer flows.

SEWER FLOW CALCULATION METHOD FOR
THE CITY OF OAK PARK HEIGHTS
The sewer flows for the undeveloped areas of Oak Park Heights have been
calculated with the following method:
STEP 1
Acres x Density = Number of Units
Acres: The gross number of developable acres within a defined area.
No calculations for streets, utility easements or environmentally
sensitive area were subtracted. Acres in a particular area were
broken down by land use in areas of mixed land use.
Density: Units per acre. The densities used for flow calculations
are the averages of development that exists in the City of Oak Park
Heights.
Low Density R-1 Zoning District 2.2 units/acre
Medium Density R-2 Zoning District 3.7 units/acre
High Density R-3 Zoning District 5.0 units/acre
STEP 2
Number of Units x Persons/Unit = Projected Population
Number of units as calculated in Step 1 represents the total number
of units that is anticipated if the entire acreage of the developable
area is developed.
Persons/Unit represents the average household size by type and size
of unit.
Low Density R-1 Zoning District 3.2 persons/unit
Medium Density R-2 Zoning District 2.4 persons/unit

Projected Population x Gallons/Capita/Day = Gallons/Acre/Day
Projected population as calculated in Step 2 represents the estimated
population that is anticipated with full development of the gross
acreage of the developable area.
Gallons/Capita/Day: The gallons per capita per day is the estimated
flow generated by each household member on a daily basis.

Gallons/Area/Day = 1,000,000 = Million Gallons/Day
Gallons per area per day as calculated in Step 3 is the total daily
sewer flow generated if full development of the developable area was
to occur.
By dividing the gallons per area per day by 1,000,000 the area flows
are measured in million gallons per day which can be easily compared
to the City's existing sewer flows as well as its proposed future
flows.

WHEREAS, the Council has determined that the proposed Amendment has no impact

I. AUTHORITY TO REVIEW
The Metropolitan Land Planning Act of 1976 requires that amendments to
local comprehensive plans be prepared, submitted to the Metropolitan
Council for review and adopted in the same manner as the original plans.
Minn. Stat. 473.864, subd. 2 (1978) . Guidelines adopted pursuant to
Minn. Stat. 473.854 for reviewing proposed amendments provide a 90 day
review period for amendments potentially affecting one or more of the
metropolitan systems. Oak Park Heights submitted the proposed amendment
for review on October 23, 1981. On November 2, 1981, the Chairman
determined that the amendment presented a potential impact on
metropolitan systems. The 90 day deadline for review of the amendment
is January 21, 1982.
II. DESCRIPTION AND ISSUES
The City of Oak Park Heights is proposing to annex and provide sewer
service to approximately 22 acres of land adjacent to Highway 36. The
proposed addition is partially developed (approximately eight acres) and
already has City sewer service to two lots. The area is addressed in the
City's Comprehensive Plan as a logical addition to the City. A mixed
usage of office commercial and medium to high density residential has
been designated for the area in the Comprehensive Plan.
The issue raised in this proposed annexation is whether the additional
sewer flow generated from the proposed annexation will cause the City to
exceed the Council 's 1990 sewer flow forecast.
III. ANALYSIS
Oak Park Heights receives metropolitan sewer service through the
Stillwater Wastewater Treatment Plant. That plant also serves the City
of Stillwater and will serve the City of Bayport when the Bayport
treatment plant is closed. At the present time capacity in the
• Stillwater plant is limited and upgrading has been proposed; but no firm
time-table has been established nor have funds been committed to the
upgrading. Therefore flows exceeding the 1990 flow forecast represent a
potential impact on the metropolitan disposal system.

• The issue is especially critical because, at the present time, there are
three other pending or approved annexations of sewered areas which
would contribute sewage flow to the Stillwater plant when service is
extended to them. A letter has been received from the City of Stillwater
commenting on the impact of the Oak Park Heights proposed amendment on
the capacity of the treatment plant (Attachment 1) .
In response to staff co n cerns regarding the possible increased 1990 flow,
Oak Park Heights undertook an indepth analysis of its existing and
projected (1990) land uses. The City stated that, including the proposed
annexation, there would be approximately 133 acres of developable land
within the City's corporate limits. This includes both infill and major
undeveloped areas, as discussed in the City's Comprehensive Plan. Oak
Park Heights identified these areas by land use and by density. Based on
this information and using 80 gallons per capita per day for new domestic
flow and 1,500 gallons per day for commercial/industrial flows, a flow of
.113 mgd is obtained. Adding the 1981 metered flow ( .26 mgd), a 1990
total flow of .373 mgd is obtained. This projection is within the Water
Quality Management Policy Plan's 1990 flow estimate ( .38 mgd) .
Oak Park Heights should be aware, however, that with the proposed
annexation, the City will reach its allocated capacity. Any further
development (annexation) will exceed the 1990 flow forecast and could
represent an impact on the metropolitan disposal system.
No other issues were identified in the plan amendment review process.
Oak Park Heights should note that the City of Stillwater has commented in
Ill its letter (Attachment 1) on a need for ponding in the.area to handle
storm sewer flows when the area is developed.
IV. FINDINGS
The Oak Park Heights Plan Amendment has no impact on metropolitan
systems and is consistent with other adopted metropolitan development
guide chapters. However, the City should note that, with this annex-
ation, Oak Park Heights will reach its allocated 1990 sewer capacity and
any further annexation could represent an impact on the metropolitan
disposal system. In addition, Oak Park Heights should address any need
for ponding in the area to handle storm sewer flows when the area is
developed.

Dear Mr. Weaver:
The City of Stillwater has reviewed the proposed amendments to the
Oak Park Heights Comprehensive Plans and has the following concerns
regarding the amendments :
First, the plan amendment indicates a desire to annex property that
will require the extension of the Oak Park Heights urban service area
to provide sewer service to the annexed land. It should be determined
what sort of impact these annexations will have upon the existing
capacity in the Stillwater Treatment Plant.
Next, one of the proposed annexations includes part of the property
in a watershed contributory to the Greelef Street storm sewer. There
is no indication that the Oak Park Heights Plan Amendment addressses
the need for ponding on this area to properly handle storm sewer
flows in its developed state . Our Greeley Street downstream improve-

The Metropolitan Council is anticipated to take final action today on the
City's proposed Comprehensive Plan amendment adding the Greeley/36th
Annexation Area to the City. Based upon the staff's recommendation and
the action taken by the Physical Development Committee, we expect a
favorable decision by the full Metropolitan Council .
To conclude this matter now on the part of the City of Oak Park Heights,
final adoption of the plan amendment is recommended at your meeting on
Monday night. We have attached a draft resolution for this action. Due
to timing, Mr. Eckberg may have some modifications to present at your
meeting. We believe, however, some formal action is necessary, as the
Municipal Commission will be hearing this issue on Wednesday, 27 January
1982.

A RESOLUTION ADOPTING AN AMENDMENT TO THE OAK PARK HEIGHTS COMPREHENSIVE PLAN
POLICY PLAN/DEVELOPMENT FRAMEWORK
WHEREAS, the City of Oak Park Heights formally adopted its Comprehensive
Plan Policy Plan/Development Framework on 27 July 1981; and
WHEREAS, a request to amend the Comprehensive Plan was filed, duly
processed through public hearing, and approved on a preliminary basis by the
City Council ; and
WHEREAS, the Twin Cities Metropolitan Council on 21 January 1982 has
formally determined that the proposed amendment is in conformance with regional
plans and within the capacity of regional service systems.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OAK
PARK HEIGHTS:
The Comprehensive Plan - Policy Plan/Development Framework amendment,
a copy of which is attached and incorporated herein, is hereby formally adopted
and made part of the City's official development policy and plan.

Baytown Township Annexation
The area lying southeast of Highway 36 (212) and Oakgreen which was addressed
in the land use section of the Comprehensive Plan as being a logical addition
to the City, has been formally proposed for annexation. Five parcels of land
on the west side of Oakgreen Avenue have also been included in the petition.
The area in question includes residential and commercial uses and some vacant
land. It is surrounded by residences on the east, residences and agricultural
land to the south, a commercial use and agricultural land to the west, and com-
mercial uses to the north fronting on Highway 36 (212).
Further development of the area is expected within the very near future, which
would benefit from public utilities. The extension of utilities from Oak Park
Heights is the most logical means of providing utilities. Part of the annexation
area is already served by the Oak Park Heights Sanitary Sewer System.
Mixed usage such as office commercial and higher density housing has been
proposed in the Comprehensive Plan to protect low density homes from highway
associated impacts. The existing uses are of the type that are desired in the
area. Some vacant land still exists that could develop into office or higher
density housing.
At the onset of additional development proposals, access and circulatory design
of the specific projects should be studied comprehensively with consideration
for the rest of the parcels and surrounding area. Care should be taken that the
residences to the south are not adversely impacted by traffic, lights, noise,
etc.

The following text amendment is added to the Comprehensive Plan-
Policy Plan/Development Framework Section on Annexation (page 69-71) .
"It should be emphasized that the areas specifically noted in this
text are not intended to be inclusive of all future annexations to Oak
Park Heights, and that the City remains open to consider all lands for
which annexation petitions are made. Proposals for annexation that
arise in the future will be studied individually and the position of
the City will be included in the appendix to this report. "

I. AUTHORITY TO REVIEW
The Metropolitan Land Planning Act of 1976 requires that amendments to
local comprehensive plans be prepared, submitted to the Metropolitan
Council for review and adopted in the same manner as the original plans.
Minn. Stat. 473.864, subd. 2 (1978). Guidelines adopted pursuant to
Minn. Stat. 473.854 for reviewing proposed amendments provide a 90 day
review period for amendments potentially affecting one or more of the
metropolitan systems. Oak Park Heights submitted the proposed amendment
for review on October 23, 1981. On November 2, 1981, the Chairman
determined that the amendment presented a potential impact on
metropolitan systems. The 90 day deadline for review of the amendment
is January 21, 1982.
II. DESCRIPTION AND ISSUES
The City of Oak Park Heights is proposing to annex and provide sewer
service to approximately 22 acres of land adjacent to Highway 36. The
proposed addition is partially developed (approximately eight acres) and
already has City sewer service to two lots. The area is addressed in the _
City's Comprehensive Plan as a logical addition to the City. A mixed
usage of office commercial and medium to high density residential has
been designated for the area in the Comprehensive Plan.
The issue raised in this proposed annexation is whether the additional
sewer flow generated from the proposed annexation will cause the City to
exceed the Council 's 1990 sewer flow forecast.
III. ANALYSIS
Oak Park Heights receives metropolitan sewer service through the
Stillwater Wastewater Treatment Plant. That plant also serves the City
of Stillwater and will serve the City of Bayport when the Bayport
treatment plant is closed. At the present time capacity in the
Stillwater plant is limited and upgrading has been proposed; but no firm
time-table has been established nor have funds been committed to the
upgrading. Therefore flows exceeding the 1990 flow forecast represent a
potential impact on the metropolitan disposal system.

The City of Stillwater has reviewed the proposed amendments to the
Oak Park Heights Comprehensive Plans and has the fallowing concerns
regarding the amendments :
•
First, the plan amendment indicates a desire to annex property that
will require the extension of the Oak Park Heights urban service area
to provide sewer service to the annexed land. It should be determined
what sort of impact these annexations will have upon the existing
capacity in the Stillwater Treatment Plant.
• Next, one of the proposed annexations includes part of the property
in a watershed contributory to the Greer Street storm sewer. There
is no indication that the Oak Park Heights Plan Amendment addressses
the need for ponding on this area to properly handle storm sewer
flows in its developed state. Our Greeley Street downstream improve-
ments are predecated upon the flow under T. H. 36 not being substan-
tially increased.

township. At the annexation hearing held January 27 , Mr.
Turrentine requested that he be given an opportunity to make
a request on behalf of the township for a pro-rated deferral
of the tax loss which would accrue to the township if the
annexation is approved. After receiving that request, I
would appreciate it if you would place the matter on the
agenda for Council decision on February 8 . I will advise
the City' s attorney of the request and that it will be on
the agenda that evening.
Also, as indicated in my letter to Mr. Turrentine,
please obtain the Mayor' s signature on the Stipulation and
return it to me so I can forward it for filing with the
Municipal Commission. All of this must be completed prior

Baytown real estate tax loss as a result of the annexation

tax loss to the township and the manner in which you would

At its meeting on January 21, 1982, the Metropolitan Council considered the
proposed amendment to the Oak Park Heights Comprehensive Plan. This amendment
proposes to annex and provide sewer service to approximately 22 areas of land
adjacent to Highway 36.
This consideration was based on a report of the Physical Development Committee,
Referral Report No. 82-05 (copy attached) . The Council adopted this report as
presented and the following recommendations contained in the report:
A. That the Council find that the Oak Park Heights Plan Amendment has no
impact on metropolitan systems and is consistent with other adopted
Metropolitan Development Guide chapters.
B. That the City of Oak Park Heights be advised that with this
annexation, Oak Park Heights will reach its allocated 1990 sewer
capacity and any further annexation could represent an impact on the
metropolitan disposal system.
C. That Oak Park Heights should address any need for ponding in the area
to handle storm sewer flows when the area is developed.
The Council adopted Resolution No. 82-16 approving the Council 's review of this
proposed amendment to the Oak Park Heights Comprehensive Plan. A copy of the
resolution is attached.

Seggelke moved to adopt an ordinance to amend the 1980 code of
ordinances for •the City of Oak Park Heights by amending chapter
401 relating to zoning by adding section 401. 20 addressing
certificate of occupancy requirements for conditional use
permits and variances . Seconded by Westphal. Roll call vote
taken with 5 aye votes cast. Ordinance adopted.
Bob Post requested an eight foot variance for an addition to
the Erickson Post Service Station for a convenience store.

Mr. Strohbehn requested permission to construct a driveway off
Peacan Avenue to Lot #2 , Beaudettes Addition. Council approved
and found no objection to the driveway.
CB radios for the police department have been received by Custom
Communications. The VFW has offered to finance the cost of the
radios, antennacs and installation.

The above-entitled matter came on for hearing before the Minnesota Municipal
Board pursuant to Minnesota Statutes 414, as amended, on November 12th, 1981,
and continued from time to time at Oak Park Heights, Minnesota. The hearing
was conducted by Terrence A. Merritt, Executive Director and by Robert J. Ferderer,
Chairman, pursuant to Minnesota Statutes 414.01, Subd. 12. Also in attendance
were County CommissionersJoseph Fogarty and Lester Rydeen, ex-officio members
of the board. The City of Oak Park Heights made no appearance, the town of
Baytown appeared by and through Harold Turrentine and the petitioners appeared
by and through Robert Briggs. Testimony was heard and records and exhibits were
received.
After due and careful consideration of all evidence, together with all
records, files and proceedings, the Minnesota Municipal Board hereby makes and
files the following Findings of Fact, Conclusions of Law and Order.
FINDINGS OF FACT
I. On June 1st, 1981, a petition for annexation by the majority of the
property owners along with a resolution of the City of Oak Park Heights in support
of the petition, was filed with the Minnesota Municipal Board. The petition
contained all the information required by statute including a description of
the territory subject to annexation which is as follows:
All that part of the Northwest Quarter of the Northwest
Quarter (NW4 of NW4) of Section Four (4) , Township Twenty-
Nine ( 29 ) North of Range Twenty (20) West described as
follows , to-wit:
Commencing at the Northwest corner of said Section Four
(4) , thence East along the North line of said Section Four
(4) for Eight Hundred Thirty-Three ( 833 ) feet to the point
of beginning; thence continuing East along said North line
of Section Four (4) for One Hundred Forty ( 140) feet ;
thence South and parallel with the East line of said North-
west Quarter of Northwest Quarter (NW4 of NW4) for Five
' • Hundred Fifty-Five and Twenty-Six Hundredths ( 555 .26 ) feet ,
thence West and parallel with the North line for a distance

II. An objection to the proposed annexation was received by the Minnesota
Municipal Board from Baytown Township on August 3rd, 1981. The Minnesota
Municipal Board upon receipt of this objection conducted onducted further proceedings
in accordance with M.S. 414.031 as required by M.S. 414.033, Subd. 5.
III. Due, timely and adequato legal notice of the hearing was published,
served and filed.
IV. The area subject to annexation is unincorporated,p ed, approximatel

size and abuts the City of Oak Park Heights by approximately
30% of its border. The City of Oak Park Heights is

in size.
V. The natural terrain of the area
proposed for annexation is a rolling
topography with natural ponding area; coils are a silt-loam, mostly well drained,

well suited for building site development, fair to poor suitability for septic
tank absorption due to slow permeability of the soils.
VI. The population of the City of Oak Park Heights in the year 1980 was
2,591, the present estimated population is 2,591 and it is projected by the
year 1990 will have a population of 3,600.
VII . In the area subject to annexation, the present estimated population
is seven, which was the population in 1980.
VIII. In the Town of Baytown, in 1980 there were 850 residents, the present
estimated population is 850, and by 1990 it is projected that its population
will be 1,050.
IX. In the City of Oak Park Heights land is presently in use as follows:
approximately 292 acres for residential use, approximately 348 acres for
institutional use, approximately 77 acres for commercial use, approximately
254 acres for industrial use, and approximately 228 acres of land is presently
vacant or farmed.
X. Land in the City of Oak Park Heights remaining for various uses in
the following amounts: residential use, 179 acres, commercial use, 15 acres,
industrial use, 34 acres.
XI. In the area subject to annexation the land is used as follows:
approximately 15.1 acres for residential use, approximately 5.5 acres for
commercial use, and approximately 1.5 acres in vacant land.
In the anea subject to annexation there remains approximately 3.5 acres for
residential or commercial use, as some of the land in use is presently underutilized.
XII. There has been .failure of an on-site septic system within the area
subject to annexation. Further development requires the installat4on of
municipal sewer and water because of the area's soils.
XIII. The Township of Baytown has 6,500 acres and its land is used for
residential purposes, commercial purposes, utility property, and agricultural-
property.
XIV. The City of Oak Park Heights has a zoning ordinance, a subdivision
regulation, a comprehensive plan, an official map, a capital improvements
program, a fire code, a building inspector, a planning commission, and a
Housing and Redevelopment Authority.
XV. The Town of Baytown has zoning regulations, subdivision regulations,
an official map, a fire code, building a wilding inspector, and a planning commission.
The comprehensive plan of the Town of Baytown is not yet completed.
XVI. The County of Washington has a zoning ordinance, subdivision regulations,
a comprehensive plan, an official map, a capital improvements program, a fire code,
a building inspector, and a planning commission.

XVII. The Town of Baytown provides the area subject to annexation with fire
protection through a contact with the City of Bayport.
XVIII. The City of Oak Park Heights provides its residents with water service,
sewer service, police protection, street improvements and maintenance, recreational
opportunities, administrative services, as well as fire protection by a contract
with the City of Bayport.
XIX. The City of Oak Park Heights provides the area subject to annexation with
some t service er ser ice and some sewer service.
XX. The City of Oak Park Heights is willing to extend the services it
presently provides its residents to the area proposed for annexation should
that area be annexed.
XXI. The present transportation network in the City of Oak Park Heights
includes Highways 212 and 95 as well as numerous city streets and county roads.
The area proposed for annexation has a direct access to Highway 212.
XXII. The tax base in the City of Oak Park Heights includes the following:
residential property assessed in 1980 and payable in 1981 was established at $6,287,344,
generating $69,556 in taxes; commercial property assessed in 1980 and payable in
1981 was established at $3,946,511, generating $43,532 in taxes; industrial property
assessed in 1980 and payable in 1981 was established at $55,623, generating $473.10
in taxes; agricultural property assessed in 1980 and payable in 1981 was established
at $10,009, generating $94 in taxes; seasonal recreational property assessed in 1980
and payable in 1981 was established at $19,455, generating $189.27 in taxes;
utility property assessed in 1980 and payable in 1981 was established at $30,130,307,
generating $334,060.84 in taxes; blind classification property assessed in 1980
and payable in 1981 was established at $29,883, generating $283.90 in taxes;
National Housing Association property assessed in 1980 and payable in 1981 was
established at $1,052,172, generating $11,829.35 in taxes; multiple dwelling
property assessed in 1980 and payable in 1981 was established at $1,125,774,
generating $12,302 in taxes.
XXIII. The Town of Baytown's tax base includes the following: residential
property assessed in 1980 and payable in 1981 was established at $2,585,133,
generating $6,351 in taxes; commercial property assessed in 1980 and payable
in 1981 was established at $919,680, generating $2,259 in taxes; industrial
property assessed in 1980 and payable in 1981 was established at $0, generating
$0 in taxes; utility property assessed in 1980 and payable in 1981 was

established at $7,038, generating $17 in taxes; agricultural property assessed
in 1980 and payable in 1981 was established at $593,894, generating $1,459
in taxes.
XXIV. In the area subject to annexation the tax base includes the following:
residential property assessed in 1980 and payable in 1981 was established at
$101,510, generating $2,044 in taxes; commercial property assessed in 1980
and payable in 1981 was established at $296,790, generating $11,558.40 in
taxes; vacant land assessed in 1980 and payable in 1981 was established at
$19,380, generating $710.54 in taxes.
XXV. The City of Oak Park Heights has a mill rate in 1980 of 10.84 and
a bonded indebtedness of $1,760,000.
XXVI. The Town of Baytown in 1980 had a mill rate of 2.457 and no bonded
indebtedness.
XXVII. In '1980 the mill rate for the County of Washington was 26.330, for
the school district 43.288, and for the Metropolitan Council 4.007.
XXVIII. The land within the area subject to annexation is suitable for
development.
XXIX. The Town of Baytown is unable to deliver a full range of municipal
services to the area subject to annexation.
XXX. Annexation to the City of Oak Park Heights will not have an adverse
impact upon the City of Stillwater, which is adjacent to the area proposed
for annexation.
XXXI. The Town of Baytown can continue to function without the area subject
to annexation, without undue hardship.
XXXII. There is no evidence that the annexation of the area subject to
annexation to the City of Oak Park Heights will have any adverse impact on
the area school district.
CONCLUSIONS OF LAW
I. The Minnesota Municipal Board duly acquired and now has jurisdiction
of the within proceeding.
II. The area subject to annexation is now or is about to become urban or
suburban in nature and the annexing municipality is capable of providing the
services required by the area within a reasonable time.
III. Municipal government is required to protect the public health,
safety, and welfare in the area subject to annexation.

IV. The best interest of the area subject to annexation will be furthered
by annexation.
V. The remainder of the Town of Baytown can carry on the functions of
government without undue hardship.
VI. There is a reasonable relationship between the increase in revenues
for the City of Oak Park Heights and the value of benefits conferred upon the
area subject to annexation.
VII. Annexation of all or a part of the property to an adjacent municipality
would not better serve the interests of the residents who reside in the area
subject to annexation.
VIII. Two years will be required to effectively provide full municipal
services to the annexed area.
IX. This Minnesota Municipal Board order is not subject an annexation
election.
X. An order should be issued by the Minnesota Municipal Board annexing
the area described herein.
O R D E R
I. IT IS HEREBY ORDERED: That the property described in Findings of
Fact II in the Findings of Fact, Conclusions of Law, and Order be and

same is hereby annexed to the City of Oak Park Heights, Minnesota the same
as if it had been originally made a part thereof.
II. IT IS FURTHER ORDERED: That the population of the City of Oak Park
Heights has increased by 7.
III. IT IS FURTHER ORDERED: That the population of the Town of Baytown
is decreased by 7.
IV. IT IS FURTHER ORDERED: That the mill levy of the City of Oak Park
Heights on the property herein ordered annexed shall be increased in
substantially equal proportions over a period of two years to equality
with the mill levy of the property already within the city.
V. IT IS FURTHER ORDERED: That the effective date of this order is
April 15, 1982.

Gentlemen and Madam:
As you no doubt know, the Minnesota Municipal
Board on April 15 , 1982 , issued its order providing that
certain property located in the Town of Baytown abutting
the Northwest portion of the City near Oakgreen and 60th
Street North be annexed to the City of Oak Park Heights.
Now that the annexation has been successfully concluded,
I am again representing certain property owners from that
area in connection with two requests they would like
considered at your next meeting scheduled for April 26,
1982 . The first request concerns partial reimbursement
for annexation expenses and the second request concerns
the extension of municipal services to the newly annexed
area.
During the course of the annexation proceeding,
the property owners whose names appear on the Petition
for Public Improvement enclosed, reimbursed the City of
Oak Park Heights for all of the expenses incurred in
connection with the annexation proceedings. A substantial
portion of those expenses involve fees from the City
Planning office, Northwest Associated Consultants , Inc. ,
which total $2 ,286.77. In discussing these fees with Dennis
Licht, he indicated that a substantial part of the fees were
incurred in connection with studies and reviews which were
of general benefit to the City of Oak Park Heights. To
the extent that those expenses were of general benefit to
the City, my clients would like consideration given to
reimbursement from the general fund. To the extent that
the fees represent services which were of benefit only to
the area which was annexed, we understand that those expenses
should be paid by the benefitted property owners.

The second request is for the extension of municipal
services as set forth in the Petition for Public Improvement.
As most of you know, the primary reason for seeking annexa-
tion to Oak Park Heights was because of the urgent need for
municipal services, particularly sanitary sewer and storm
water control which the Town of Baytown was unable to furnish.
As indicated in the Findings of Fact of the Municipal Board,
there has been failure of an on-site septic system within
the area and further development requires the installation
of municipal utilities because of the areas soils. Accordingly,
it is respectfully requested that the City Council undertake
the steps necessary to initiate these projects so they could
be constructed, if possible, during the 1982 calendar year.

the Anderson/Linquist annexation issue. As part of our analysis, we have
identified work which was conducted on sewer discharge calculations which
could be viewed as having City-wide significance and related to general
comprehensive planning. The findings of this work will for example, be of
benefit in any future annexation matters and will be important as the
Metropolitan Council reviews its own plans and submits them to the City
for comment.
I have attached copies of our statements on the Anderson/Linquist request
and starred those items which relate to the sewer discharge question. These

MINUTES OF MEETING HELD TUESDAY, OCTOBER 12, 1982

Call to order by Mayor Sommerfeldt at 7 :00 P.M. Present: O' Neal,
Lang, Westphal, Seggelke, Bonestroo, Ryan, Vierling & Wilson.
Absent : None.
Clerk read public hearing notice, presented affidavit of publication
and mailing list for public hearing for Schwantes , Inc. request for
rezoning, subdivision & PUD. Discussion ensued. Mayor called for
comments from residents present. O ' Neal moved to close the hearing with
Seggelke seconding. 5 aye votes . Hearing closed.
Lang moved to deny the rezoning request from Schwantes, Inc. Seconded
by O'Neal. Roll call vote taken with O'Neal , Lang and Seggelke voting
.ye and Westphal and Sommerfeldt voting nay. Rezoning denied with
parcel remaining a B-2 District. Mr. Red Swager moved to withdraw
request for PUD & subdivision at this time.
Clerk read public hearing notice and presented affidavit of publication
for the establishment of Storm Sewer Improvement District No. 1.
Mayor Sommerfeldt opened hearing, calling for comments from residents.
Seggelke moved to close hearing, with O ' Neal seconding. 5 aye votes.
Hearing closed.
Seggelke moved to adopt Ordinance No. 41600 establishing a storm sewer
improvement tax district within which the Council may acquire,
construct, reconstruct, extend, maintain, and otherwise improve
storm -sewer systems and related facilities and within which the Council
kr may levy a tax on all taxable property therein to finance the cost
of such improvements, including maintenance and the payment of
principal and interest on obligations issued inmaking such improve-
ments . Seconded by Lang. Roll call vote taken with 5 aye votes.

Seggelke moved to direct City Attorney to contact R. Lafayette to
update appraisal dated. October` 1, 1979 of City owned property. Seconded
by Westphal. 5 aye votes. Carried.
Westphal moved to direct City Engineer to add an a}anndum to the
Anderson/Linguist -- NSP project to include sewer and water extensions
to the Junker property. Seconded by Lang. 5 aye votes. Carried.

Lang moved to table Junk'er' s' request for increase in residential
garbage service until the, November 8th . meeting. Seconded by O ' Neal .
5 aye votes. Carried.

O' Neal moved to approve plans And specs for the Anderson/Linguist -
NSP project. Seconded by_ `Westphal-. 5 aye votes . Approved.
