Kobs Commissioner IN THE MATTER OF THE DETACHMENT ) OF CERTAIN LAND FROM THE CITY OF ) FINDINGS OF FACT OAK PARK HEIGHTS AND ANNEXATION ) CONCLUSIONS OF LAW TO THE CITY OF BAYPORT PURSUANT ) AND ORDER TO MINNESOTA STATUTES 414 ) On December 3, 1993 the Minnesota Municipal Board received a resolution from the Cities of Oak Park Heights and Bayport, requesting the detachment of certain property, and annexation of the same territory pursuant to Minnesota Statutes 414.061. After review of the resolution, the Minnesota Municipal Board hereby makes and files the following Findings of Fact, Conclusions of Law, and Order. FINDINGS OF FACT 1. That a resolution requesting concurrent detachment and annexation of certain property was received from the Cities of Oak Park Heights and Bayport. 2. The resolution contained all the information required by statute including a description of the territory proposed for detachment and annexation, which is as follows: That part of the SE 1/4 of the SW 1/4 of Section 3, Township 29N, R2OW: commencing at a point where the west right-of-way line of Stagecoach Trail No. intersects the south line of the corporate limits of Oak Park Heights, thence NE'ly along the west right-of-way line of said Stagecoach Trail No. to its intersection with the west line of the corporate limits of Bayport, thence south along said west line of corporate limits to the south line of the corporate limits of Oak Park Heights, thence west on the south line of said corporate limits of Oak Park Heights to the point of beginning; AND That part of the SW 1/4 of NE 1/4 of Section 3, Township 29, R2OW: -2 commencing at a point where the west right-of-way line of Stagecoach Trail No. intersects the north line of the corporate boundary of the City of Bayport, thence NW'ly along the west right-of-way line of Stagecoach Trail No. to its intersection with the centerline of 56th Street No. , .thence east along the centerline of 56th Street North and from the curve to the right of said centerline in a straight line parallel to the north corporate boundary line of Bayport to the east right-of-way line of Minnesota Highway 95, thence south along the east right-of-way line of said Highway 95 to its intersection with the north line of the corporate limits of Bayport, thence west along the north line of the corporate limits of Bayport to the point of beginning. 3. The area proposed for detachment and annexation is situated within the City of Oak Park Heights and abuts the municipal boundary of the City of Bayport. CONCLUSIONS OF LAW 1. The Minnesota Municipal Board duly acquired and now has jurisdiction of the within proceeding. 2. An order should be issued by the Minnesota Municipal Board concurrently detaching and annexing the area described herein. O R D E R 1. IT IS HEREBY ORDERED: That the property described in Findings of Fact 2 be, and the same hereby is, detached from the City of Oak Park Heights and annexed to the City of Bayport, the same as if it had originally been made a part thereof. 2. WHEREAS: The City of Oak Park Heights desires to detach the following tracts of land within the corporate limits of the City of Oak Park Heights legally described as follows: 1. '3\'\]'� In the 1987, the cities of Bayport and Oak Park Heights o,�y concurrently resolved to detach from Oak Park Heights and annex to Bayport that part of the prison property lying within Oak Park Heights. Both cities have record of this action currently on file. For some undetermined reason, however, the Municipal Board, which must approve such transactions, does not have any record of this joint resolution. Therefore, the detachment and annexation has never been processed by the Board. I have been in contact with the Municipal Board staff during the last week concerning this issue. Pat Lundy, who is the Assistant Director, informed me that if both cities wish to continue forward with this process, it will be necessary for both City Councils to pass a new joint resolution, with a legal description and map of the area included for the Municipal Board's review. Using samples provided by the Municipal Board, I have prepared a resolution, legal description of the land and a map which are attached for your review and comments. Annexation of this land would put the prison, in its entirety, within the city limits of Bayport. The resolution is scheduled for discussion by the City Council at the November 1, 1993 Council meeting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights in conjunction with the City Council of the City of Bayport as follows: 1 . That the petition for detachment and annexation of certain lands from the City of Bayport to the City of Oak Park Heights be and the same is hereby approved, and the City Attorney is authorized to proceed in conformance therewith to provide the necessary documents and filings with the Minnesota Municipal Board in such case made and provided. NOW, THEREFORE, be it RESOLVED by the City of Bayport that the detachment of said lands from the City of Oak Park Heights and annexation thereof by the City of Bayport be and hereby is approved in all respects. BE IT FURTHER RESOLVED that a certified copy of this resolution be filed with the Executive Director of the Minnesota Municipal Board pursuant to Minn. Stat. 414.061 , Subd. 1 , together with a copy of the corporate boundary map of the City of Bayport deliniating the proposed changed of boundary.
