On December 3, 1993 the Minnesota Municipal Board received a
resolution from the Cities of Oak Park Heights and Bayport, requesting the
detachment of certain property, and annexation of the same territory
pursuant to Minnesota Statutes 414.061.
After review of the resolution, the Minnesota Municipal Board hereby
makes and files the following Findings of Fact, Conclusions of Law, and
Order.
FINDINGS OF FACT
1. That a resolution requesting concurrent detachment and
annexation of certain property was received from the Cities of Oak Park
Heights and Bayport.
2. The resolution contained all the information required by
statute including a description of the territory proposed for detachment
and annexation, which is as follows:
That part of the SE 1/4 of the SW 1/4 of Section 3, Township 29N,
R2OW: commencing at a point where the west right-of-way line of
Stagecoach Trail No. intersects the south line of the corporate
limits of Oak Park Heights, thence NE'ly along the west right-of-way
line of said Stagecoach Trail No. to its intersection with the west
line of the corporate limits of Bayport, thence south along said west
line of corporate limits to the south line of the corporate limits
of Oak Park Heights, thence west on the south line of said corporate
limits of Oak Park Heights to the point of beginning; AND
That part of the SW 1/4 of NE 1/4 of Section 3, Township 29, R2OW:

commencing at a point where the west right-of-way line of Stagecoach
Trail No. intersects the north line of the corporate boundary of the
City of Bayport, thence NW'ly along the west right-of-way line of
Stagecoach Trail No. to its intersection with the centerline of 56th
Street No. , .thence east along the centerline of 56th Street North and
from the curve to the right of said centerline in a straight line
parallel to the north corporate boundary line of Bayport to the east
right-of-way line of Minnesota Highway 95, thence south along the
east right-of-way line of said Highway 95 to its intersection with
the north line of the corporate limits of Bayport, thence west along
the north line of the corporate limits of Bayport to the point of
beginning.
3. The area proposed for detachment and annexation is situated
within the City of Oak Park Heights and abuts the municipal boundary of the
City of Bayport.
CONCLUSIONS OF LAW
1. The Minnesota Municipal Board duly acquired and now has
jurisdiction of the within proceeding.
2. An order should be issued by the Minnesota Municipal Board
concurrently detaching and annexing the area described herein.
O R D E R
1. IT IS HEREBY ORDERED: That the property described in Findings
of Fact 2 be, and the same hereby is, detached from the City of Oak Park
Heights and annexed to the City of Bayport, the same as if it had
originally been made a part thereof.
2. IT IS FURTHER ORDERED: That the effective date of this order
is January 6, 1994.

Resolution between the City of Oak Park Heights and the City of
Bayport for the concurrent detachment and annexation of the
corporate land pursuant to Minnesota Statute 414.061. The three
copies have been fully executed by the City of Bayport.
Earlier this month, we received one fully executed copy of
the Joint Resolution from the City of Oak Park Heights.
Unfortunately, the Municipal Board requires an original copy
along with an original copy for the City of Bayport and its City
Attorney. Consequently, I am asking you and your Mayor to sign
three more copies of the Joint Resolution. Please retain one
original for your files and forward the two remaining signed

A JOINT RESOLUTION BETWEEN THE CITY OF OAK PARK HEIGHTS AND THE
CITY OF BAYPORT FOR THE CONCURRENT DETACHMENT AND ANNEXATION OF
INCORPORATED LAND PURSUANT TO MINNESOTA STATUTE 414.061.
WHEREAS: The City of Oak Park Heights desires to detach the
following tracts of land within the corporate limits of
the City of Oak Park Heights legally described as
follows:
1. That part of the SE 1/4 of the SW 1/4 of Section
3, Township 29N, R2OW: commencing at a point where
the west right-of-way line of Stagecoach Trail No.
intersects the south line of the corporate limits
of Oak Park Heights, thence NE'ly along the west
right-of-way line of said Stagecoach Trail No. to
its intersection with the west line of the

said west line of corporate limits to the south

SUBJECT: Detachment and annexation of prison land. '3\'\]'�
In the 1987, the cities of Bayport and Oak Park Heights o,�y
concurrently resolved to detach from Oak Park Heights and annex
to Bayport that part of the prison property lying within Oak Park
Heights. Both cities have record of this action currently on
file. For some undetermined reason, however, the Municipal
Board, which must approve such transactions, does not have any
record of this joint resolution. Therefore, the detachment and
annexation has never been processed by the Board.
I have been in contact with the Municipal Board staff during
the last week concerning this issue. Pat Lundy, who is the
Assistant Director, informed me that if both cities wish to
continue forward with this process, it will be necessary for both
City Councils to pass a new joint resolution, with a legal
description and map of the area included for the Municipal
Board's review.
Using samples provided by the Municipal Board, I have
prepared a resolution, legal description of the land and a map
which are attached for your review and comments. Annexation of
this land would put the prison, in its entirety, within the city
limits of Bayport.
The resolution is scheduled for discussion by the City
Council at the November 1, 1993 Council meeting. Please contact
either myself or Ken Hartung if you have any comments or
questions.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING ANNEXATION AND DETACHMENT
OF CERTAIN LANDS LYING WITHIN THE CITY OF OAK PARK HEIGHTS
AND THE CITY OF BAYPORT
WHEREAS, the City Council of the City of Oak Park
Heights has been contacted by the City of Bayport with regard to
the cooperative request to detach and annex certain lands within
the Cities of Bayport and Oak Park Heights; and,
WHEREAS, the same affects the property owned by the
Minnesota Correctional Facility at Bayport; and,
WHEREAS, such detachment and annexation is consented to
by the Department of "Administration and the Department of
Administration and the Department of Corrections for the State of
Minnesota, the fee owner of the property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights in conjunction with the City Council
of the City of Bayport as follows:
1 . That the petition for detachment and annexation of
certain lands from the City of Bayport to the City of Oak Park
Heights be and the same is hereby approved, and the City Attorney
is authorized to proceed in conformance therewith to provide the
necessary documents and filings with the Minnesota Municipal
Board in such case made and provided.

WHEREAS the following described tracts of land situated in the
County of Washington, State of Minnesota, to wit:
1 . That part of the SE2 of the SW4 of Section 3,
Township 29N, R20W: commencing at a point where
the West right of way line of Stagecoach Trail No.
intersects the South line of the corporate limits
of Oak Park Heights, thence NE'ly along the West
right of way line of said Stagecoach Trail No. to
its intersection with the West line of the corporate
limits of Bayport, thence South along said West
line of the corporate limits to the South line of
the corporate limits of Oak Park Heights, thence
West on the South line of said corporate limits of
Oak Park Heights to the point of beginning.
2. That part of the SW4 of the NE4 of Section 3,
Township 29N, R20W: commencing at a poi nt where
the West right of way line of Stagecoach Trail No.
intersects the North line of the corporate boundary
of the City of Bayport, thence NE'ly along the West
right of way line of Stagecoach Trail No. to its
intersection with the center line of 56th St. No. ,
thence East along the center line of 56th St. No.
and from the curve to the right of said center line
in a straight line parallel to the North corporate
boundary line of Bayport to the East right of way
line of Minnesota Highway #95, thence South along
the East right of way line of said Highway #95 to
its intersection with the North line of the corporate
limits of Bayport, thence West along the North line
. of the corporate limits of Bayport to the point of
beginning.
are within the corporate limits of the City of Oak Park Heights, abut the
corporate limits of the City of Bayport, and is property subject to concurrent
detachment and annexation by resolution of the Councils of both Bayport and
Oak Park Heights; and
WHEREAS the foregoing described tracts of land are the only part of
the Minnesota Correctional Facility east of Stagecoach Trail and south of
• 56th Street North outside the present city limits of Bayport; and

WHEREAS due to duplication of jurisdiction of the police departments
of both Bayport and Oak Park Heights in patrolling and policing these areas
it would be in the best interests of Bayport that said areas be under the
jurisdiction of Bayport; and
WHEREAS the City of Oak Park Heights is adopting a resolution concurrent
with this resolution approving the detachment of said tracts of land from the
City of Oak Park Heights and their annexation to the City of Bayport.
NOW, THEREFORE, be it
RESOLVED by the City of Bayport that the detachment of said lands
from the City of Oak Park Heights and annexation thereof by the City of
Bayport be and hereby is approved in all respects.
BE IT FURTHER RESOLVED that a certified copy of this resolution be
filed with the Executive Director of the Minnesota Municipal Board pursuant
to Minn. Stat. 414.061 , Subd. 1 , together with a copy of the corporate boundary
map of the City of Bayport deliniating the proposed changed of boundary.
BE IT FURTHER RESOLVED that said concurrent detachment and annexation
shall become effective by the Minnesota Municipal Board's order or at such
later date as provided by the Board in its order.

MINUTES OF MEETING HELD MONDAY, NOVEMBER 9, 1987
Call to order by Mayor Sommerfeldt at 7 :00 P.M. Present:
O'Neal, Seggelke, Torgerson, Vierling and Wilson. Absent:
Doerr.
Clerk read public hearing notice, presented affidavit of
publication and mailing list on request for 10 ft. side yard
setback to existing garage from David Foley. Mayor called for
comments. O'Neal, seconded by Seggelke, moved to close hearing.
4 aye votes. Hearing closed.
Seggelke, seconded by Torgerson, moved to grant the above
request. Roll call vote taken with 4 aye votes cast. Request
granted.
Public hearing was continued on request from Ming Chu (Stone Lake
Restaurant) for On Sale and Sunday Liquor Licenses. Mayor called
for comments and discussion ensued. Seggelke, seconded by
O'Neal, moved to close bearing. 4 aye votes. Hearing closed.
Torgerson, seconded by O'Neal, moved to grant the above license.
Roll call vote taken with 4 aye votes cast. Request granted.
O'Neal, seconded by Torgerson, moved to adopt Resolution 187-11-
48 approving Ordinances #87-1003-05 and #87-1004-06 granting
Northern States Power Franchises for gas and electric. Roll call
vote taken with Sommerfeldt, Torgerson and O'Neal voting aye and
Seggelke abstaining. Resolution adopted.
O'Neal, seconded by Seggelke, moved to adopt Resolution #87-11-49
accepting the annexation petition in Baytown Township and
authorizing City Attorney to file with the Municipal Board. Roll
call vote taken with 4 aye votes cast. Resolution adopted.
Seggelke, seconded by Torgerson, moved to adopt Resolution #87-
11-50 approving the annexation and detachment of certain lands
lying within the City of Oak Park Heights and the City of Bayport
and authorizing City Attorney to proceed. Details available at
Clerk's office. Roll call vote taken with 4 aye votes cast.
Resolution adopted.
Seggelke, seconded by Torgerson, moved to approve minutes of
October 13th and 26th as presented. 4 aye votes. Carried.
Torgerson, seconded by Seggelke, moved to authorize City Engineer
to prepare information for meeting November 23rd regarding an
additional water tower. Information to contain possible location
and costs. 4 aye votes. Carried.
