Notice is hereby given that a public hearing will be held pursuant
to Minnesota Statutes 414 , as amended , before the Minnesota Municipal
Board in the above-entitled matter .
The hearing will be held on the 19th day of April , 1978, in the
Board Room , Washington County Courthouse , Stillwater , Minnesota , com-
mencing at 9 : 00 a .m. All persons shall be given an opportunity to be
heard orally and to submit written data , statements or arguments concern-
ing the above-entitled matter . The right to testify and the admission
of testimony and other evidence shall be governed by the Rules of the
Minnesota Municipal Board . (The rules of the Minnesota Municipal Board
may be purchased from the Documents Section , 140 Centennial Building ,
St. Paul , Minnesota . )

As you are aware, the Municipal Board has granted preliminary approval
to the entire area proposed for annexation. In order to expedite the final
'processing of this decision, I would request that your office complete the
• enclosed sample form under the findings of fact section. As soon as I
receive this, I will review and revise the draft order and forward it to
the board for their final decision.

Re: Annexation of Certain Lands in Baytown Township
Dear Mr. Heuer:
We have been notified by the Municipal Board that a
continued hearing in the above matter will be held on August 30,
1978 at 9:00 a.m. in the Board Room of the Washington County
Court House, Stillwater, Minnesota.
The purpose of the hearing is two-fold. First, to
obtain a map of the Oak Park Heights/Baytown Township area indicating
the proposed annexation area as it exists in relationship to Baytown
and Oak Park Heights, Secondly, to receive testimony from the DNR
and other interested individuals regarding the affect of any proposed
annexation on the designated wildlife area which exists immediately
east of the proposed annexation area.

A few weeks ago I gave a signed petition to the Oak Park Heights ,'
clerk requestingl'he annexation of that part of Registered Land
survey number seventy that presently is in
Baytown Township plus

the land of the school board and Mr. Ludowese.
It is indicated there are 57 acres in the area of which 53 acres
belong to the signers of the petition.
The LeRoy Andersons who own 2-1/2 acres would sign only if they
were given street improvements free and without assessments
charged to their property. k
g p operty. They also stated they did not want •
a ublic street in
P front of their house because they did not
want the traffic driving by their place. When the purchase a- fV1
greement, signed by Anderson, was made it included the statement 'ri
that the front 30 feet would be for a public road. ,--$
Earl Ludowese has one acre. He was hesitant about signing the .'
petition but expressed a real need for sewer.

The present extrance to the Andresons ' and Samples ' homes looks
like a street but it is an easement which allows entrance to their
homes over my land. The easement does give the right to build, .
repair and to maintain the drive at their expense. The sharing
of this expense has caused very bad feelings between the Andersons t7N
and the Samples. ,

I am sure a contact with Baytown Townboard about this petition }
will bring a negative answer. My feeling is that a hearing before ?,'7
the Municipal Commission will bring a positive answer.'
