The Conditional Use Permit was approved by the City Council on May 27, 2008, with the following conditions, with my notes as to known status as of this date in italics. 1. The number of buses allowed on site at any one time shall not exceed 100. Per Tom Oswald of Mn Central School Bus - no more than 76 busses are likely to ever be on site at a given time. Torn Oswald, 651 -430 -3311 2. Any plans for a covered shelter to the rear of 5302 Stagecoach Trail North shall be approved by City staff. None in place and no proposal or permit for one received as of 10 -9 -08 3. All employees dispensing fuel shall receive training for proper fueling techniques including emergency spill response procedures. As of 10 -9 -081 am unaware of any such verification of training having been received by the City. 4. The applicant shall submit a notification for above ground storage tanks to the IVIPCA once the tank has been installed. As of 10 -9 -09 the tank has not yet been installed. 5. The applicant shall submit a spill prevention and control counter - measure plan to the EPA and to the City. As of 10 -9 -09 I am unaware of any such plan having been received by the City. 6. The applicant shall receive and retain a hazardous waste generators license from Washington County for the landscape business and bus operation. As of 10 -9 -091 have not seen a copy of this license for the development file and have no knowledge of it having been obtained. 7. The fuel tank shall be screened with a fence on the west, north and south sides with a ten (10) foot cedar fence, as approved by the City. As of 10 -9 -09 tank not yet installed nor screening fence. Fire code requires fence composition other than that as approved. 8. The tree removal and replacement plan was favorable to the Planning Commission and was subject to the approvals of the City Arborist and City Council. As of 10 -06 -9 Arborist Widin reported her inspection of the landscaping and opined that she found the landscaping requirement for the project to be fulfilled. 9. All signage and lighting existing and proposed for the site shall be compliant with the Zoning Ordinance. 9 -03 -08 site visit revealed signage installed without permits to both businesses at site. Since then Horticultural Services has removed their sign and MN Central School Bus has applied for their sign permit (paymentfor some has been submitted to their c corporate office as of 10 -1 -08 and has not yet been received). Some lighting (full cut off) issues exist and are being handled by Building Official Butler. 10. Any changes to the grading and drainage patterns of the site shall be subject to the review and approval of the City Engineer. I've received no information that there has been any change to the grading or drainage patterns at the site as of 10 -9 -08 11. Block heaters and heater plugs shall be installed and utilized on all buses operated out of the facility at 5280 and 5288 Stagecoach Trail, and an electrical outlet shall be provided for each bus before commencement of operations. There shall be no excessive idling of buses on the site as determined by the City. Tom Oswald has indicated that block heater requirement has been fulfilled. As of 9 -03 -08 Mr. Oswald stated that engineer was working on outlet situation and that they expected the lot to be striped and outlets installed prior to the end of the month. To my knowledge this is not yet done. A revised striping plan was received 10 -6 -08. 12. An operations plan shall be developed and enforced, subject to the review and approval of City staff, requiring that all buses be backed into their respective parking spaces at the end of the day's operation. As of 10 -9 -08 I've not received an operations plan for the file and as of today's site visit busses backed in prior to noon. 13. The plan for hours of operation as developed by the applicant, in correspondence dated April 25, 2008, was favorable to the Planning Commission and City Council and is subject to approval of City staff. Nothing is expected - correspondence as noted in condition was part of application submittal and planning and council packet materials at time of review, recommendations and approval. 14. Annual review is hereby imposed as a condition of this permit. This permit shall be reviewed on or about June 1 of each year and may be amended or altered at the discretion of the City Council. NA 2
