Mihelich Vice Chair John Carey Member IN THE MATTER OF THE DETACHMENT ) OF CERTAIN LAND FROM THE CITY OF ) FINDINGS OF FACT, BAYPORT AND ANNEXATION TO THE ) CONCLUSIONS OF LAW, CITY OF OAK PARK HEIGHTS PURSUANT ) AND ORDER TO MINNESOTA STATUTES 414.061 ) On June 30, 1986, the Minnesota Municipal Board received a resolution from the°CiWcy of Bayport. On July 28, 1986, a resolution was received from the City of Oak Park Heights. Both resolutions were filed pursuant to M.S. 414.061 and requested the concurrent detachment of certain land from the City of Bayport and annexation of the same property to the City of Oak Park Heights. After review of the resolutions, the Minnesota Municipal Board hereby makes and files the following Findings of Fact, Conclusions of Law, and Order. FINDINGS OF FACT 1 . That a resolution supporting detachment of certain property was received from the City of Bayport and a resolution supporting annexation of said property was received from the City of Oak Park Heights. 2. The resolutions contained all the information required by statute including a description of the territory proposed for detachment and annexation, which is as follows: That part of the NW1/4 of the SE1/4 of Section 3, Township 29N, Range 20W, described as follows, to-wit: �� • _2_ Beginning at the NW corner of said NW1/4 of SE1/4 thence South along• the West line thereof 365 feet more or less to its intersection with the Westerly right of way of Stagecoach Trail No. (formerly Stillwater Point Douglas Road), thence Northeasterly along the westerly line of said Stagecoach Trail No. to the North line of said 1/41/4, thence West along said North line 101.08 feet more or less to the point of beginning of this description. 3. The area proposed for detachment is situated within the City of Bayport and abuts the municipal boundary of the City of Oak Park Heights. CONCLUS 19NS OF LAW 1 . The Minnesota Municipal Board duly acquired and now has Jurisdiction of the within proceeding. 2. An order should be issued by the Minnesota Municipal Board concurrently detaching and annexing the area described herein. O R D E R 1. IT IS HEREBY ORDERED: That the property described in Findings of Fact 2 be, and the same hereby is, detached from the City of Bayport and annexed to the City of Oak Park Heights, the same as if it had originally been made a part thereof. 2. IT IS FURTHER ORDERED: That the effective date of this order is August 14, 1986. Dated this 14th day of August, 1986. Lundy Assistant Director • • No. 2-86 RESOLUTION FOR DETACHMENT AND ANNEXATION The City Council of the City of Bayport RESOLVES: That the tract of land situated in the County of Washington, State of Minnesota to wit: That part of the NW4 of the SE4 of Section 3, Township 29N, Range 20W, described as follows to wit: Beginning at the NW corner of said NW4 of SE4, thence South along the West line thereof 365 feet more or less to its intersection with the Westerly right of way of Stagecoach Trail No. (formerly Stillwater Point Douglas Road), thence Northeasterly along the westerly line of said Stagecoach Trail No. to the North line of said , thence West along said North line 101.08 feet more or less to the point of beg- inning of this description is within the corporate limits of the City of Bayport, abuts the City of . Oak Park Heights and is property subject to concurrent detachment and annexation by resolutions of the councils of both cities•pursuant to Minnesota Statutes 414.061, Sub. 1. That the City of Bayport desires the above described land be detached from Bayport and be annexed to the City of Oak Park Heights. That this resolution is being adopted concurrently with a re- solution by the City Council of Oak Park Heights approving such de- tachment and annexation. Be it further RESOLVED that a certified copy of this resolution be filed with the Executive Director of the Minnesota Municipal Board pursuant to Minnesota Statutes 414.061, Sub. 1 with a copy of the corporate boundary map of the City of Bayport deliniating the proposed change of boundary. Let said concurrent detachment and annexation be effeictive upon the Minnesota Municipal Board's order or at such later date as provided rovided by the Board in its order. I� Clerk I • • RESOLUTION NO. #86-07-14 CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING OF THE CONCURRENT DETACHMENT AND ANNEXATION OF REAL PROPERTY FROM THE CITY OF BAYPORT TO THE CITY OF OAR PARR HEIGHTS. WHEREAS, there exists a certain tract of land located within the City of Bayport, County of Washington, State of Minnesota, to-wit: That part of the NW's of the SE' of Section 3, Township 29N, Range 20W, described as follows, to-wit: Beginning at the NW corner of said NWT of SEA thence South along the West line thereof 365 feet more or less to its intersection with the Westerly right of way of Stagecoach Trail No. ( formerly Stillwater Point Douglas Road) , thence Northeasterly along the westerly line of said Stagecoach Trail No. to the North line of said 44, thence West along said North line 101 . 08 feet more or less to the point of beginning of this description. the same being totally located within the corporate limits of the City of Bayport and abutting the City of Oak Park Heights, being the property subject to current detachment and annexation proceedings by way of resolutions of both City Councils of both Cities pursuant to M. S. §414 .061 , Subdivision 1; and WHEREAS, the City of Bayport desires the above-described land to be detached from the City of Bayport and annexed to the City of Oak Park Heights; and WHEREAS, the City of Oak Park Heights desires the above- described land to be detached from the City of Bayport and annexed to the City of Oak Park Heights; and 411 411 WHEREAS , one hundred percent ( 100%) of all property owners affected by such detachment and annexations concur and agree with the annexation of the property to the City of Oak Park Heights; and WHEREAS, this resolution is being adopted concurrently Oak with a resolution from the City Counci l of the City of Par k Heights approving of such detachment and annexation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights that the City Council hereby concurs with the City Council of Bayport that the above-described real property be detached from teh City of Bayport and annexed to the City of Oak Park Heights , the same to be effective upon issuance of the Board' s order or at such later date as provided by the order of the municipal board or at such later date as may be provided in the municipal board order . BE IT FURTHER RESOLVED that a certified copy of this resolution be filed with the Executive Director of the Minnesota municipal board pursuant to M. S. §414 .061, Subdivision 1, with a copy of the corporate boundary map of the Cities of Oak Park Heights and Bayport delineating the proposed change of boundary between said cities. City of Oak Park Heights 14168 N. 57th St. Oak Park Heights, MN. 55082 Dear Lavonne: I'm in the process of following up on some pending Council business, and realized that I have not yet heard anything from the City of Oak Park Heights relative to the detachment and annexation resolution that was sent out on July 10. I believe Mayor Bliss spoke to your mayor by telephone with respect to this proposal, and Steve Sullivan and I also spoke with Gene Ostendorf on the same subject. At any rate, I am enclosing another copy of the resolution which was acted upon by the Bayport City Council. If this has not yet come before the Oak Park Heights Council, please let me know what the status is at the present time. I assume the original was forwarded to your City Attorney, and perhaps he has not yet gotten back to you on it. If you're free for lunch some day soon, give me a call and we can meet in some convenient location. I would enjoy visiting with you again. You may also wish to advise the Council and the affected property owners that the Minnesota Municipal Board requires a filing fee pursuant to Rule 6000 .340 , subd. 2 of its adopted rules of $4. 00 per acre with a minimum fee of $100.00 to accompany the resolutions . It may be the opinion of the Council that such a filing fee should be paid by the affected property owners inasmuch as the City is pursuing this matter on their behalf and at their request.
