Keidsen, Secretary. The petitioning property owners were represented by ''inston E. Sandeen, Esq. The Board of Trustees of Oak Park Township were represented by Richard Hiniker; Esq. The Commission, having duly considered the testimony of the witnesses, the exhibits received in evidence and all other evidence, upon all the files and records, being fully advised in the premises, makes and enter the following: FINDINGS OF FACT I. Due, timely and adequate legal notice of the petition and the hearing herein, including adjourned sessions thereof, 411 411 was posted, published, served and filed. II. Fairview Cemetery Association is the owner in fee and James L. Simpson and Robert Norgren, doing business as J. & B. Realti Co. , are earnest honey contract purchasers of the property proposed for annexation consisting of approximately eight acres. III, The City of Stillwater approves the annexation and supports the proposed commercial use of the area to be annexed. IV. The population of the area to be annexed is none as compared to approximately 8,310 population for the City of Stillwater. V. The area to be annexed is approximately eight acres as compared to approximately 2,323 acres in the City of Stillwater. VI. The assessed valuation of the area to be annexed is $974.00 as compared to the assessed valuation of the City of Stillwater of 0,8044562.00. VII. The City of Stillwater has been a growing community, increasing from $,310 population in 1960 to approximately $,560 population in 1965 and increasing in area since 1960 by approximately 100 acres. The expansion of the City of Stillwater has been to the south,. into Oak Park Township and south and west into the formerly agricultural area of Still- water Township. The east boundary of the City of Stillwater is the St. Croix River and the State of lisconsin, which stops expansion to the east. -2- 110 The improvement of I-Highway �r at 212 from a two-lane highway into a divided four-lane highway with frontage roads bordering part of and traversing through Oak Park Township indicates the expansion of the City of Stillwater into this suburban and formerly agricultural area. Commercial developments appear to have grown up along Highway '1212 and would indicate further commercial use of the area south and west of the City of Stillwater and including Oak Park Township. P VIII. V a cant s pa ce for expa nsion of the City of Stillwater is c 1 available through annexation of vacant lands except to the east. Oak Park Township is one of the few vacant land areas abutting to the City of Stillwater on the south. Ix. One of the petitioners, J. & B. Pealti Co. , proposes to spend approximately /500,000.00 in construction of apartment buildings in the area to be annexed In all probability, taxes will increase by annexation; but should be proportional to the benefits received, includ- ing City utility services, improved police and fire protection, improved streets and street maintenance, reduction of insur- ance rates, sewer and water service, and other benefits of city service. 11 0 T he proposed commercial i s l use of the area to be annexed c a and the health and welfare of the community show a need for such governmental services as city water service, city sewage disposal system, city zoning, city street planning, city police and city fire protection. 1� XI • The City of Stillwater will have available to the area to be annexed adequate city water and adequate city sewer -3- • ! connections. The City will put in streets required with pro- portionate costs being paid by the owners of the abutting property. City planning services, police departments and fire departments will be available to serve the area. XII. There is no need for the continuance of any township government within the area to be annexed after the annexation. ..III. Oak Park Township offers no governmental service for sewage and water in the area to be annexed. The Township offered no evidence to indicate the existence of present or on range to be annexed. The Township g ange planning for the area t e anne e p relies upon the Sheriff's Department of ?Washington County, Minnesota for police protection and upon the City of Stillwater for fire protection. CONCLUSIONS OF LAW I. The Minnesota Municipal Commission duly acquired, and now has, jurisdiction of the within proceedings. II. The area of land to be annexed is so conditioned and so located as to be properly subjected to municipal government by the City of Stillwater. III. The area to be annexed by the City of Stillwater would be in the best interests of the area affected and the City. IV. Municipal Government of the area to be annexed herein is necessary and is required to protect public health, safety and welfare and to provide necessary governmental services. V. The Township form of government is not adequate to cope with the problems of the proposed commercial expansion in the area to be annexed. -4- 410 410 VI. The City of Stillwater can feasibly and practicably provide for and best serve the need for governmental services presently existing and as they become necessary in the future in the area to be annexed. Cafferty Ex-Officio Member IN THE MATTER OF THE PETITION TO ) FINDINGS OF FACT , ANNEX CERTAIN LAND TO THE CITY OF CONCLUSIONS OF LAW, STILLWATER, MINNESOTA AND ORDER This proceeding under Minnesota Statutes 414, as amended, for the annexation to the City of Stillwater, Minnesota of certain property located in the Township of Stillwater, Washington County, Minnesota, more particularly described herein, came on for hearing before the Minnesota Municipal Commission at the County Office Building in the City of Stillwater, Minnesota, on the 24th day of February, 1971, in the County Board Room at 10:00 A.M. Arthur R. Swan, Vice Chairman of the Minnesota Municipal Commission, presided at the hearing. Also in attendance and sitting were Ex-Officio Members I. A. Pederson and Don L. Cafferty, Washington County Commissioners. The Township of Stillwater, Washington County, Minnesota, duly filed an objection to said annexation and the Village of Oak Park Heights Washington County. Minnesota, also duly filed an objection to said annexation. The petitioner was represented by Harold D. Kimmel, City Attorney for the City of Stillwater, Washington County, Minnesota, and the Township of Stillwater, Washington County, Minnesota was represented by John R. Rheinberger, Attorney at Law, Stillwater, Minnesota. The Village of Oak Park Heights, Washington County, Minnesota, was represented by Albert E. Ranum, Attorney at Law, Stillwater, Minnesota. The members presided at the hearing, viewed the premises after completion of the hearing and after receiving certain exhibits and testimony relative to the property being annexed to the City of Stillwater. . • The Commission, based upon the evidence adduced at said hearing, the view of the premises and the arguments of counsel, and the files and records in this proceeding, and being fully advised in the premises, makes the following Findings of Fact, Conclusions of Law and Order. FINDINGS OF FACT 1. Due, timely and adequate legal notice of the hearing ordered by the Minnesota Municipal Commission was published, served and filed. 2. Due, timely and adequate objection to the proposed annexation of the property herein described was filed by the Township of Stillwater and the Village of Oak Park Heights, both of Washington County, Minnesota. 3 . The area proposed for annexation is hereinafter fully described and is located adjacent to and abuts the corporate limits of the City of Stillwater, Washington County, Minnesota. 4. That the area proposed for annexation is owned by Fairview Cemetery Association and that Fairview Cemetery Association, being the only owner of the land described, petitioned for its annexation to the City of Stillwater. 5. That the real estate in question is legally described as; The Northwest Quarter of the Southeast Quarter (NW0. of SEA.) , of Section Thirty-three (33 ) , Township Thirty (30) North, Range Twenty (20) West, except the North Twenty-two (22) feet thereof, lying and being in the County of Washington and State of Minnesota, and is approximately forty (40) acres in area. 6. That the property in question is used exclusively for cemetery purposes and there are no residents of that property and that future development of the property will continue to be for cemetery purposes and that as a result no population growth is anticipated for the area in question. 7. That the property in question is in need of Municipal police 2 • . 110 services, which services the City of Stillwater, Minnesota, is capable of and is best situated to provide to the property; that the present police services being provided by the Town of Stillwater are in themselves inadequate and have been required to be augmented by services by the Washington County Sheriff' s Office. CONCLUSIONS OF LAW 1. The Minnesota Municipal Commission duly acquired and now has jurisdiction of this annexation proceeding. 2. The area proposed for annexation is so conditioned and so located as to be properly subject to the municipal government of the City of Stillwater, Washington County, Minnesota. 3. There is no need for the continuance of any township government within the area proposed for annexation. 4. The City of Stillwater, Washington County, Minnesota is capable and is best situated to provide the governmental services. presently needed and those services which will become necessary in the future in the area proposed for annexation. 5. That the proposed annexation to the City of Stillwater, Washington County, Minnesota will not materially affect the capability of the Township of Stillwater to continue its normal operation. 6. That annexation of the area to the City of Stillwater, Washington County, Minnesota would be in the best interests of the area affected. 7.
