, tory hereinafter described, hereby petition your honorable body to
have all of the same included within and be annexed to the Village
of Oak Perk Heights* Minnesota, in accordance with Minnesota
Statutes Annotated, Section 414.03, and for that purpose respect-

1. That more than twenty percent of the freeholders
residing in the area hereinafter described have affixed their
signatures hereto as required by law.
2. That all of your petitioners are qualified free-
holders and residents within said area.
3. That none of said territory is now a part of any

reference is a map setting forth the boundaries of the foregoing
lands.
7. That the quantity of land embraced within the

8. That the foregoing Lands,embraced within the fore-
going description and bounded as shun on the attached map, con-
tain a resident population of 275 peers s, as ascertained by a
census to which this petition is attached.

61 resident dwellings, 19 farmsteads, 1 grain elevator, and one

the entire Village and certain outlying areas and is designed
so that it can be readily expanded to sewer additional areas.
That the Village of Oak Park Heights is also in the process of
constructing a sanitary sewer system that will, serve approximately
the same area that will be served by the water system and is
designed so that it ban be readily expanded to serve additional
areas.
13. That police protection consists of two (2)
constables, who operate on a part-time basis, and the Sheriff's
office of Washington County, Minnesota, also polices the area
and furnishes police protection whenever it is required.
13. That the Village of Oak Park Heights obtains its
fire protection from the Village of Bayport, Minnesota, which
serves the entire Village.

R E S O L U T I O N
WHEREAS, a Petition has been filed with the Council of the Village
of Oak Park Heights seeking the annexation of a portion of the Town of Bay-
town to said Village; and
WHEREAS, the Village Council of said Village has, by resolution,
approved such Petition; and
WHEREAS, the Town Board of the Town of Baytown has objected to
said Petition and requested that a hearing be held by the Minnesota Municipal
Commis s ion;
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners
of Washington County, Minnesota, concurs in the request that a hearing be
held by the Minnesota Municipal Commission to study all factors involved in
said proposed annexation.

NOTICE IS HEREBY GIVEN that a public nearing l be held
in the Greenbrier Office Building on Highway 212 and South 4th
Street in Oak Park Heights, on the 8th day of Marcht 1968, at 10:00 A.M.
before the Minnesota Municipal Commission in the matter of the proposed
annexation of certain land to the Village of Oak Perk Heights.
The property is described as follows:

Gentlemen:
We are the attorneys for the Village of Bayport, who have directed
us to oppose the Petition for Annexation currently pending and which
U includes part of Baytown Township.
The Village fully feels that proliferation at small governmental unite
is against the public interest, and further the Village Council feels that
all the services necessary now and in the future by the Township of
Baytown can be obtained with the Village of Bayport.
DThe Village Council also indicated a willingness to talk with any other
governmental municipality for the purpose of consolidation or annexation
to assure the orderly growth in this area.

The Minnesota Municipal Commission on January 29, l968
received a petition for the annexation of certain land to the
Village of Oak Park Heights, Minnesota.
Pursuant to due notice the matter came on for hearing
before the Minnesota Municipal Commission on the 8th day of
March, 1968, and on the 26th day of June, 1968.
There was a quorum of the Municipal Commission present
at both sessions of said hearing.
The Commission having duly considered the testimony of the
witnesses, the exhibits received in evidence and all other
evidence, upon all the files and records, being fully advised
in the premises, makes and enters the following:
FINDINGS OF FACT
The record shows:
1. The population of the Village of Oak Park Heights is 1400
and the population of the area to be annexed is 275.
2. The area of Oak Park Heights is 1,000 acres and the area
of the proposed area to be annexed is 3,264 acres.
3. The assessed valuation of Oak Park Heights is $2,592,133.00
and the assessed valuation of the area to be annexed is -
$182,334.00.
4. That the probable expansion of the annexing area with
respect to population and construction, indicates that the
annexing area has no present problem and that no problem
shall exist for a period of years.
5. Taxes can be reasonably expected to increase in the annexed
territory and said increase would be proportional to the

expected benefit.
6. Except for a very small portion thereof, the annexed
territory has no present need for governmental services
not now available.
7. The annexing territory does not now have facilities to
substantially improve the governmental services presently
needed by the area to be annexed.
$. If the proposed annexation were permitted the remaining
portion of Baytown Township could not feasibly or
practicably exist as an independent unit of government.
9. Baytown Township is presently able to cope with the present
problems of growth within the township area.
CONCLUSIONS OF LAW
The record is insufficient to support Findings required by
Minnesota Statutes 414.03 permitting the annexation proposed.

The petition for annexation of certain land located in the
Town of Baytown, County of Washington, State of Minnesota to
the Village of Oak Park Heights and described as:

MEMORANDUM
The instant proceeding is for the annexation of
part of Baytown Township into the Village of Oak Park
Heights. If the annexation were approved, the remainder
of Baytown Township would remain as unincorporated land.
Minnesota Statute 414.03 , Subdiv. 2, sets forth
factors which are to guide the commission in making its
determination. Among those factors are: "the existence
of all or a part of an organized township within the area
to be annexed and its ability and necessity of continuing
after the annexation".
The commission believes that part of Baytown Township
excluded from the proposed annexation would not be a viable
unit of government. Possible future combinations of this
excluded area with West Lakeland Township or with the
Village of Bayport are shown by the record to be impractical.
The excluded area would be difficult to serve from the
Village of Bayport because of awkward boundaries and
relatively difficult access. West Lakeland Township, on the
other hand, is basically rural in character and would not
be able to provide the necessary services as the excluded
area becomes more urbanized.
The commission takes this opportunity to commend for
consideration of the local residents and governments the
single community concept introduced by the Staff of the
Metropolitan Council. This plan contemplates a new
municipality r
composed of the Village of Oak Park Heights,

the Village of Bayport, and all of B ay to wn Township. The
advantages of such a municipality are cogently set forth in
Metropolitan Council Exhibit 6, "Recommendation on the

The staff recommends that one community be formed
through the consolidation of the present Oak Park
Heights, Bayport and Baytown. This community would
be approximately thirteen square miles with a
population of 5,295 and a 19$5 projected population
of $,377. This community would have a present and
potential diversified land-use mix to help finance
its needed services with industrial and some
commercial development in the eastern part, commercial
development in the north along T.H. 36 and T.H. 212,
and residential development in the remainder of
present Baytown Township.
Unified planning and needed urban services to the
whole area could be provided if these communities
consolidated. With a present population of over
5,000, the proposed community would be eligible
for several kinds of state assistance. It is
recommended that if this consolidation takes place
that urban and rural service taxing districts be
established so that those areas which are not yet
receiving municipal services would have a lower
municipal tax rate.
It is clear that the legislature did not intend to
allow annexation which would create the very type of pro-
blem area that the law was intended to correct. For this
overriding reason, the annexation is denied.

Certain freeholders in the Town of Baytown, petitioners
in the above entitled matter hereby appeal from the Order of the
Municipal Commission of the State of Minnesota in the above
captioned matter dated the 12th day of December, 1968, and
respectfully make applicatioa to the District Court of Washington
County, Minnesota, being the Court of the County wherein all of
the area involved in said proceeding is located, have a review
of said Order of the Municipal Commission of the State of Minnesota
and vacation of such Order upon the following grounds:
That the Order of the commission is arbitrary and
capricious in the following respects:
A) That Finding of Ft 4 of the Commission Order
finding that the probable expansion of the village of Oak Park
Heights with respect to popultor and construction indicates
that said Village has no present problem and that no problem
shall exist for several year ,a inconsistent with the facts
produced ac eaid hearing anC, 'Yht it was shown that the Vellage
of Oak Park Heights has ,uypali-e to its corporate limits anf,
the acqiisition of additeeea ian ' soace ie imperative.
That Fi , of the Coumession Order
that the annexed terxito:_ ;:vresent need for governmental

it is inconsistent with the evidence produced at the hearing.
C) That Finding of Fact 7 of the Commission Order

that the Village of Oak Park Heights does not now have the
facilities to substantially improve the governmental services
presently needed by the area to be annexed is not supported
by the evidence produced at said hearing.
D) That Finding of Fact 9 of the Commission Order
that Baytown Township is presently able to cope with the present
problem of growth within the township area is oppressive and
in unreasonable disregard of the best interests of the territory
affected .
WHEREFORE, petitioners pray for the Order of this
Court vacating the Order of the municipal Commission of the
State of Minnesota dated December 12, 1968, denying the annexation
of property located in. the Town of Baytown to the Village of
Oak Park Heights in remanding saie matter to the Municipal
Commission for an Order granting such annexation petition and
for such other and further r'eli.ef as to the Court seems just
and proper

Notice is hereby given that a public hearing will be held
pursuant to Minnesota Statutes 414 as amended, before the Minnesota
Municipal Commission in the above-entitled matter in the Washington
County Office BuiJ.ding, Stillwater, Minnesota, on the lath day of
March, 1970, commencing at 10:00 o' clock a.m. , and continuing until
all representatives or other interested groups of persons have had
an opportunity to be heard concerning the above--entitled annexation

RESOLUTION ESTABLISHING POSITION 1``
OF VILLAGE COUNCIL OF
VILLAGE OF OAK PARK HEIGHTS REGARDING
ANNEXATION OF VARIOUS LANDS LOCATED
IN THE TOWN OF BAYTOWN TO VILLAGE OF OAK PARK HEIGHTS
WHEREAS, the Village Council of the Village of
Oak Park Heights, Washington County, Minnesota, has heretofore
on the 10th and 20th days of November, 1969 approved petitions
to annex certain areas located in the Town of Baytown to the
Village of Oak Park Heights, and
WHEREAS, the Town Board of the Town of Baytown duly
opposed said petitions for annexation, and
WHEREAS, a consolidated hearing on said petitions
was duly held before the Municipal Commission of the State
of Minnesota on the 18th day of March, 1970, at the Washington
County Office Building, Stillwater, Minnesota, and
WHEREAS, subsequent to the commencement of said
hearing, the Town of Baytown through its duly appointed attorney,
Jack Wallace, agreed to withdraw its objection to said petitions
for annexation, thereby enabling said Municipal Commission to
issue its order for annexation proypiasd, however, that the
Village of Oak Park Heights adopt a resolution disapproving
of any further petitions for the annexation of any lands in the
Town of Baytown to the Village of Oak Park Heights, pending
discussions to take place between the Village Council of the
Village of Oak Park Heights and the Town Board of the Town
of Baytown, regarding a permanent solution to the problem of
piecemeal annexations9 said Village, and
WHEREAS, the Honorable Raymond Johnson, Mayor of
Oak Park Heights, at said hearing agreed to encourage the

adoption of said •resolution by the Village Council of the
Village of Oak Park Heights provided, however, that said
Village consult the town of Baytown upon receiving of petitions
for annexation, and would approve all annexation petitions
not opposed by the Town of Baytown, and provided further that
discussions would commence immediately between the said Village
and Town regarding a permanent solution to the problem of

WHEREAS, it it is incumbent upon the village of
Oak Park Heights, the Town 'of Baytown and the Village of.

✓ solution regarding the future develop ment of said municipalities.
NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA,
as follows:
1. That the Village Council of the Village of •
Oak Park Heights hereby disapproves of any further
petitions for the annexation of any lands in the � � ��
Town of Baytown to the Village of Oak Park Heights;
provided, however, that in the event any such further
annexation petitions are received by said Village,
and upon receipt of written notice from the Town of
Baytown not opposing such annexation, such petition
shall be approved.
2 , That the Village Clerk may be and hereby is
authorized to write to the Town •of Baytown requesting
a meeting at the earliest possible time between said
Town and Village for the purpose of discussing perm-
anent solutions to the problem of annexation; that
such discussions shall include and not be limited to
the advantages and disadvantages of merging the Vii-
lage of Oak Park Heights and the Town of Baytown .
3 . That said Village Clerk is further instructed
to contact the Village of Bayport and request the
attendance of said Village at the above described
• meeting.
4. That in the event the above municipalities are
unable to resolve the question of the best solution

to the problem of piecemeal annexation or orderly
annexation, BE IT FURTHER RESOLVED that the Village
of Oak Park Heights requests the assistance and
guidance of the Municipal Commission in this matter.
5 . BE IT FURTHER RESOLVED that in the event no
permanent solution , as above described, is arrived
at between the Village of Oak Park Heights and the
Town of Baytown after all reasonable efforts have been
made, that said Village of .Oak Park Heights shall
take such other necessary steps to accomplish such
permanent solution and shall further agree to receive
annexation petitions from free holders residing
in the Town of Baytm4n .
6 . BE IT FURTHER RESOLVED that the Village Clerk
be and hereby is authorized to forward a copy of
the foregoing resolution to the Town of Baytown,
the Village of Bayport and the municipal Commission .
of the State of Minnesota .

Gentlemen:
Our initial discussions of possible future merger of our
communities was confined to general view points.
At this time I feel that we must move from generalities to
specific consideration of the factor of finances and taxation
as this will be a most important consideration in any decision
we make, and will be a vital consideration for the citizens
of our respective communities. Answers to questions on taxa-
tion must be thoroughly documented for our further discussion
and for use in informing our communities if and when the
governmental bodies can agree on any change in political
boundaries.
The first step in this process is to list the receipts and
expenditures of the separate communities. I have included
two forms which I would like your treasurer to complete and
return to me. so that I can assemble a comparison sheet for
our next meeting. Thi will permit us to discuss the adjust-
ment in each communitis taxes which would result from
compilation of this data, and also to discuss the m a simple
immediate savings which might be possible

Baytown Township was requested to moment on the proposed annexations
before your Commission, involving Baytown Township and Oak Park Heights.
The Town Board of Baytown Township unanimously agrees that they would
like to have the proposed annexations denied, based on the followings
1. Baytown Township is now able to furnish sewer services, now
regulated under the Metropolitan Sewn ward.
2. The Comprehensive Study made by the Metropolitan Council staff,
as directed by the Minnesota Municipal Commission, dated June 16,
196, staters
"The staff recommends that ono oomaunity be formed through the eon-
solidation of the present Oak Pork Heights, Bayport end Baytown."
The proposed annexation or possible expansion thereof could be
detrimental to the overall development of the entire area.
#. The Washington County Comprehensive Plan at the present time
assures the professionally coordinated planning and asning of all
unincorporated land, including Baytown %unship.
The members of the Town hoard have discussed at length the various
possibilities of adopting a plan of annexation through ordinance or
agreement, The Board feels that no such plan is feasible and me no
hope in agreeing to any such plan. It is still the feeling of the Board
that the only proper solution is a consolidation of Oak Park Heights,
Bayport end Baytown.

consolidated with Minnesota Municipal Commission No. A-2196 (Lake Elmo)
and Minnesota Municipal Commission No. A-2197 (Bayport) , and that
the files involving the Oak Park Heights proceeding were Minnesota
Municipal Commission Nos. A-1725 and A-1734; that there was a
considerable number of hearings on said respective commission files
and that subsequent to their consolidation, the last hearing was held
on the 13th day of July, 1972, at the Washington County Office Building
in the City of Stillwater.
That on said last hearing date Commissioner Robert W. Johnson
presided at said meeting and Commissioners Robert J. Ford and
Harold J. Dahl were present together with Ex-Officio Members
A. B. Schaefer and Idor Pederson, both Washington County Commissioners.
Appearing for the Village of Oak Park Heights was attorney
Lyle J. Eckberg; for the Village of Bayport was attorney John H.
Rheinberger; for the Village of Lake Elmo was attorney Donald T. Raleigh;
and for the Town of Baytown was attorney Esther M. Tomljanovich.
,Upon the evidence adduced at the h.aaring, upon the briefs of
counsel and upon all files and records :herein, the Commission makes
the following:
FINDINGS OF :='ACT
I . That the notices of hearing in the said above proceedings
were all given pursuant to law.
2 . That the approximate number of residents residing in the
area proposed to be annexed to the Village of Oak Park Heights in
the expanded petition is 300 persons.
3 . That the area proposed for annexation contains 3 , 000 acres
more or less .
4 . That said area is now or about to become 'urban or suburban
in character.
5. That said area is without governmental services except for
fire protection furnished by Bayport and police protection furnished
by the Sheriff' s Department of Washington County.
6 . That said area is within the present limits of the same
school district as the Village of Oak Park Heights .
7 . That the needed governmental services for said area except
as herein stated can best be provided by the Village of Oak Park
Heights .
8 . That the proposed annexation will have no adverse effect
upon any community adjacent to the area sought to be annexed .

9 . That the Town of Baytown' s form of government is
inadequate to provide the governmental Services now necessary
or which will be necessary in the near :`'uture .
10 . That Section Seven (7 ) of the area proposed to be
annexed is located North of the Lake Elmo Airport and lies adjacent
to the Village of Lake Elmo and can be pest provided with needed
governmental services by the Village of Lake Elmo .
11. That the following described abutting area is now or
is about to become urban or suburban in character and would be
better served by the Village of Oak Park Heights :
12 . The Northeast Quarter (NE ) of the Northeast
Quarter (NE1) of Section Nine (9) , Township
Twenty-Nine ( 29) North, Range Twenty (20) West .
13 . That the population of the area herein ordered annexed
to the Village of Oak Park Heights is approximately 300 .
l4 . That McDonalds Lake which is divided by the annexation
herein ordered, is a non-meandered lake with a very limited
watershed and will not be adversely affected by inclusion within
more than one municipality. Counsel for the Village of Lake Elmo
and the Village of Oak Park Heights stipulated that the boundary
herein ordered dividing the lake was the most acceptable alternative .
Expert opinion of the Washington County Planner was that such a
division would not cause drainage or other problems of lake and
land use. No party or person testified in opposition to the
division as herein ordered.

CONCLUSIONS OF LAW
1 . The Minnesota. Municipal Commission has duly acquired
and now has jurisdiction of the within proceedings .
2 . Municipal government of the area herein annexed is
required to protect the public health, safety, and welfare.
3. The area herein annexed is so conditioned and so located
as to be properly the subject of municipal government by the
Village of Oak Park Heights .
4 . The interests of the Village of Oak Park Heights and
of the area herein annexed would be best served by annexation
of said area to the Village.
5. The area herein annexed is or is about to become urban
or suburban in character.
6 . The township form of government is not adequate to meet

the problems found to exist in the area herein annexed.
7 . The annexation will not materially affect the ability
of the Township of Baytown to provide governmental services for
the balance of said township.
8 . That the following described area would be better served
by the Village of Lake Elmo:

9 . That the area proposed for annexation should be increased

purposes until the next state or federal census .
IT IS FURTHER ORDERED: That all manies in the general fund
and other assets of the township shall be divided on the basis of
the ratio of the assessed valuation of the area annexed to the
assessed valuation of the property remaining in the township .
This accounting shall take place within thirty ( 30) days of
certification of the results of the above ordered election.
IT IS FURTHER ORDERED: That any 1973 state or federal aids
or rebates received by the township after the date of this Order
shall be divided on the basis of the ratio of the population
annexed to the population remaining in the township. This
accounting shall take place within thirty ( 30) days of receipt
of such aids .

shall be May 29 , 1973 .

MEMORANDUM
The purpose of the legislature in establishing the Minnesota
Municipal Commission is outlined in the opening Section of Chapter
414:
"The legislature finds that: (1) sound urban development-
is essential to the continued economic growth of this
state; (2) municipal government is necessary to provide
the governmental services essential to sound urban develop-
' ment ard for the protection of health, safety, and welfare
in areas being used intensively= for residential , commercial,
industrial, institutional and governmental purposes or in
areas undergoing such development; (3) the public interest
requires that municipalities be formed when there exists
or will likely exist the necessary resources to provide
for their economical and efficient operation; (4) annexation
to or consolidation with existing municipalities or
unincorporated areas unable to supply municipal services
should be facilitated; and, (5) the consolidation of
municipalities should be encouraged. It is the purpose
of this chapter to empower the Minnesota Municipal Commission
as . o
to ron.ote and regulate development of municipalities s

that the public interest in efficient local government will
he properly recognized and served . "
In attempting to fulfill this mandate in this area in Washington
County, the Minnesota Municipal Commission has considered and deliberated
at great length for several years . The three orders issued today
represent our best judgment as to how the public interest in efficient
local government will be properly recognized and served" . The
resident voters in the township will now have an opportunity to vote
on these determinations.
The Township attorney and officials have argued strongly that
ultimate solution in this area should be one g government rather than
two or three. They have indicated that they would have no objections
to merger if Bayport and Oak Park Heights would also agree to
consolidate. This was also the conclusion of planning experts from
the Metropolitan Council in a study done at the request of the
commission as early as 1968. While we do not wish to pre-judge

our conclusion if such a proceeding were initiated, we strongly
urge the municipal councils and the resident voters of these two
municipalities to file petitions giving the Commission the jurisdiction
to consider such a consolidation. The commission is not empowered
to act on its own initiative.
Today' s decision is a major step in the direction sought by
township officials. It reduces the number of governments involved
from three to two. It is a comprehensive boundary solution eliminating
the need for expensive unending battles over "piecemeal" annexations.
The 1968 Metropolitan Council study approved a similar division as
an "interim solution" . If approved, the former township residents
will be able to petition the commission for consolidation of the two
remaining villages.
We urge the Villages involved to e:;tablish a rural-urban service
district under Minnesota Statutes, Section 272 . 67, to assure the
most equitable tax benefit ratio to all of their citizens. We also
urge them to consider contracting with the capable and efficient
offices of the Washington County Planning Commission for advice and
assistance in establishing a comprehensive unified approach to
community planning and development.

Treasurer for the City of Oak Park Heights, X will continue to perform
a varying degree of these repponsibilities until December 31st.
In view of this and the probable delay in the approval of the annexation
of your property to the City, I have enclosed the following;
1. Your check No. 1178 in the amount of $270.00 for rezoning
fee and deposit.
2. Application for rezoning.
3. Copy of survey.
Until the annexation is completed and new administrative appointment is
made, it appears that it may beat for you to resubmit when the above has
been resolved. As previously advised, we cannot process your rezoning
until the annexation is completed.

Re Annexation of certain lands to the City
of Oak Park Heights
. Dear Mr. Bjornson:
With regard to the. check which you deposited with
Ken Heuer, Clerk for the City of Oak Park Heights on October
16, 1978, I have noted that Mr. Heuer returned your check to
you in view of the fact that he is acting Clerk of the City of
Oak Park Heights at this time and felt that the matter should
-=� best be taken up by the Clerk after the first of the year. I
believe that Mr. Heuer' s purpose in doing so was to defer con-
sideration of your application for zoning to the new Clerk and
new Council rather than to set it before the present council
which may change due to the new elections which are pending.
The trturn of your check in this matter does not appear to me
to vary or change your Petition for Annexation to the City of
Oak Park Heights and in my opinion, it will continue to be
effective as of Octoter 16, 1978. However I shall keep your
check in the amount of $270. 00 in my file to be re-delivered
to the new City Clerk for the City of Oak Park Heights.
I will also keep tab of the expenses which are incurred
through the annexation process in securing annexation of your
lands to the City. Insofar as these expenses are incurred I.
understand that they will be deducted from the $270. 00 whici you
have tendered. In regard to other fees to be incurred for
applications for rezoning, etc. those will have to be dealt with
with the new City Clerk upon his appointment and I do not hold
your check for any such purpose insofar as rezoning is concerned.

Pursuant to statute, the ordinance which annexed
the Bjornson property to the City of Oak Park Heights has
been published once in the official newspaper for the City,
and the Affidavit of Publication is enclosed herewith.
The statute requires that proof of the publication
V/must be attached and filed with the ordinance, and that the
ordinance must be recorded in the ordinance book within
twenty...IMF days after its publication.
Should you have any questions regarding the ordinance
or its enactment, or procedures subsequent thereto, please do
