Minneapolis, Minnesota September 1971 c PLANNER'S REPORT ON PROPOSED ANNEXATION Oak Park Heights, Minnesota Prepared by: Urban Planning & Design, Inc. • Minneapolis, Minnesota A petition requesting the Village of Oak Park Heights to annex a portion of Still- water Township is pending before the Minnesota Municipal Commission. Generally, the area included in this petition covers a rectangular parcel bounded on the south by Highway 212, on the west by Maple Street, on the north by Millard Street Extended and on the west, by County Road 66. The approximate dimensions of the area in question are 1050' by 3600'. The land itself, is for the most part, vacant, but several retail-type establish- ments are located on the easterly frontage, along Highway 212. These uses include a service station, cheese shop, restaurant and drive-in restaurant. Several resi- dential type homes are also in evidence and we understand that a small cemetery is located between Clara and Millard Streets, with Holcombe Street on the west. • • Annexation hearings are not a new phenomenon in the area, and most probably more hearings will be in order. The important point to keep in mind is that a result of the time and effort expended on the annexation proceedings should result in the establishment of sound and logical municipal lines which will serve the area in the future. The petition in question in our opinion, is but a small step in the direction of establishing the sound and logical boundaries mentioned. We do nor believe this petition goes far enough in the direction of establishing an intelligent boundary for Oak Park Heights. We would recommend to the Village and the Municipal Commi- ssion that the petition be expanded to include additional areas which could better be served by Oak Park Heights. This boundary expansion would solidify the northern boundary of a new community as suggested in the Washington County Comprehensive Plan. The suggested expanded northern boundary would commence at the intersecting points of Orleans Street at the St. Croix River, proceed westerly along Orleans to Maple Street, then southerly to Millard Street. Millard Street would be followed westerly to a point lying 500' westerly of County Road No. 66. This point would correspond with a section line. The west boundary would then follow the section line which, south of T.H. 212, would lie within the right-of-way of County Road No. 66, and eventually intersect with the existing municipal boundary. This proposed boundary expansion would not be the ultimate boundary of Oak Park Heights. However, it would in our judgment, solidify the area north of T.H. 212 into a logical expansion of Oak Park Heights. URBAN PLANNING & DESIGN, INC. • 4110 • • Our reasons for including the area north of T.H. 212 described previously, falls within the criteria established by the Metropolitan Council in its report dated June 26, 1968. It was noted in this report that the area to be annexed should be served by the community annexing it.' In this case, the area described either is being serviced by the Municipal sewer and water from Oak Park Heights,,or this area could be „ served by the utilities from the Village. The area suggested for incorporation also approximates quite closely, the watershed district lying north of T.H. 212. Although the Village of Oak Park Heights can provide the expected and needed munt- cipal services such as sewer and water, they also are able to provide improved police and fire protection. These are additional expected services, however a very important factor is the increase in planning and zoning influence which this proposed boundary change would facilitate. It has been argued previously that a logical north boundary would coincide with T.H. 212. In our opinion, this would not be in the best interests of good planning or sound zoning influence. Situations where municipalities are separated by major highways leads, sometimes, to competing posture on the part of the two separated governments. This competition generally takes the appearance of a strip of commer- cial zoning on both sides of the highway. These strips of commercial development pose more problems for the communities involved than just an abundance of commer- cially zoned property. URBAN PLANNING & DESIGN, INC. • • I 4 In our judgment, a more healthy situation exists when one municipality controls where possible, future land use planning on both sides of a major highway. Although Oak Park Heights does not now have a complete comprehensive plan under- way, they are contemplating doing this in the near future. The proposed expanded boundary of Oak Park Heights, if approved, would also fill in the voids in this particular area. Today, the, boundary line leaves much to be desired, with several isolated islands, affecting both Stillwater and Oak Park Heights' community continuity. The suggested boundary would straighten, to some extent, a gerrymandering boundary. From a purely financial viewpoint, the following figures indicate that Oak Park Heights offers an extremely better mill-rate when compared to the communities in the surrounding area. 1971 RESIDENTIAL MILL RATES (Supplied by Washington Co. We would recommend that it be expanded to include additional areas which would have a net effect of adding to the continuity of the north municipal line of the Village of Oak Park Heights. However, more importantly than straightening municipal boun- dary lines, would be the fact that Oak Park Heights would be exerting its zoning ' and planning influence on both sides of T.H. 212 which, in our opinion, leads to a more intelligently planned area within a given community. The proposed annexa- tion and the proposed expanded annexation, would also approximate quite closely the watershed districts found on the north side of T.H. 212. In this same light, Oak Park Heightstoday is serving, with their municipal utilities, much of this area proposed for annexation. County Office Building located at Stillwater, Minnesota, on August 11, 1971. The hearing was continued to September 21, 1971. After receiving the testimony of numerous witnesses, the hearing was continued until November 10 and 11, 1971, and thereafter continued from November 10 and 11, 1971 to December 2 and 3, 1971, at which time additional and further testimony was taken. The hearing was scheduled for February 24, 1972 and then continued until February 29, 1972, at which time further additional testimony was taken. Robert W. Johnson, Chairman of the Minnesota Municipal Commission, presided at the hearing. Also in attendance and sitting were Commis- sioners Harold J. Dahl, Robert J. Ford, and Ex-Officio Members Idor A. Pederson and Don L. Cafferty. The Township of Stillwater, Washington County, Minnesota, duly filed an objection to said annexation. The City of Stillwater, Washington County, Minnesota, duly filed an objection to said annexation. • • The petitioner was represented by Vacil Kalinoff, Attorney at Law, Stillwater, Minnesota; the Village of Oak Park Heights was represented by Albert F. Ranum, Village Attorney for the Village of Oak Park Heights, Stillwater, Minnesota; the City of Stillwater was represented by Harold D. Kimmel, City Attorney for the City of Stillwater, Minnesota; the Town of Stillwater was represented by James D. Gibbs, of Fridley, Minnesota, Township Attorney for the Town of Stillwater. The members presided at the hearing, viewed the premises, received numerous exhibits, received a stipulation agreed to by all parties that the area in the Town of Stillwater and sought to be annexed to the Village of Oak Park Heights, is now or is about to become urban or suburban in character and that the public health, safety and welfare of said area sought to be annexed can best be served by municipal government. After the hearings were concluded all parties were directed to present a final and written argument to the Minnesota Municipal Commission. The Commission, having considered the testimony of the witnesses, the exhibits received in evidence, the stipulation, and all other evidence and the files and records herein the arguments of council, and being fully advised in the premises, makes the following Findings of Fact, Conclusions of Law and Order. FINDINGS OF FACT 1. Due, timely and adequate legal notice of the hearing ordered by the Minnesota Municipal Commission was published, served and filed. 2. Due, timely and adequate objection to the proposed annexation of the property herein described was filed by the Township of Stillwater and the City of Stillwater. 3. The area proposed for annexation is described in the petition I • • as: SUMMIT PARK as surveyed and platted and now on file and of record in the Office of the Register of Deeds. in and for Washington County, Minnesota, which is located adjacent to and abuts the corporate limits of the Village of Oak Park Heights, Washington County, Minnesota, and All that part of the South Half of the Southwest Quarter (Sz of SW4) of Section Thirty-three (33), Township Thirty (30) North, Range Twenty (20) West, which lies East of Oasis Avenue North, also known as Washington County Highway 66; which is located adjacent to and abuts an extensive residential section of the corporate limits of the City of Stillwater, Washington County, Minnesota. 4. That the area proposed for annexation consists of approxi- mately 85 acres and the original petition for annexation of said 85 acres to the Village of Oak Park Heights was signed by a majority of the 'property owners in the area sought to be annexed. 5. That the area proposed for annexation is now or is about to become urban or suburban in nature and that the Village of Oak Park Heights and the City of Stillwater are capable of providing the services required by the area within a reasonable time. 6. That municipal government of the property proposed for . annexation is required to protect the public health, safety and welfare in reference to plat control, or land development and construction which may be reasonably expected to occur within a reasonable time hereafter. 7. That the annexation of the Summit Park area hereinbefore described, to the Village of Oak Park Heights is in the best interests of the annexing municipality and of the property proposed for annexation. -3- • 8. That the area proposed for annexation should be reduced by excluding the remaining area west of Summit Park, which area would be better served by the City of Stillwater. 9. That the estimated increase in the population of Oak Park Heights caused by the annexation of the Summit Park Area would be 18 persons. 10. That the remainder of Stillwater Township can continue to carry on the functions of government without undue hardship. CONCLUSIONS OF LAW 1. The Minnesota Municipal Commission duly acquired and now has jurisdiction on this annexation proceeding. 2. The Summit Park section of the area proposed for annexation is so conditioned and so located as to be properly subject to the municipal government of the Village of Oak Park Heights, Washington County, Minnesota. 3. That there is no need for the continuance of any township government within the area proposed for annexation. 4. That the area proposed for annexation is now or is about to become urban or suburban in nature. That the Village of Oak Park Heights, Washington County, Minnesota, is capable and is best situated to provide the governmental services presently needed and those services which will become necessary in the future in the Summit Park section of the area proposed for annexation. 5. The annexation of the Summit Park area to the Village of Oak Park Heights, Washington County, Minnesota, will not severely affect the capability of the Township of Stillwater to continue its normal operation. 5-A. The remaining area proposed for annexation west of Summit Park would better be served by annexation to the City of Stillwater. -4- • • 6. The annexation of the Summit Park area to the Village of Oak Park Heights, Washington County, Minnesota, would be in the best interest of the area affected. 7.
