Some of the City fax machines are out of operation and in need of repair or replacement.
These machines were purchased a number of years ago for Councilmembers to be used for
receiving/sending information from/to staff, consultants, or other City information.
Attached is a memo from Ms. Johnson, a quote on the cost of a new fax, and the Equipment
Policy and Use Agreement.
• The funds for the faxes would be from General Fund-Mayor and Council-Other Materials and
Supplies. The budget for this line item is $1,500 for the year. $298.33 has been spent
through 5-8-01. There is a balance of$1,201.67.

Re: City Council Fax Machines
In 1996 the City purchased Hewlett Packard fax machines for use by the City Council
Members at their homes. Of those five fax machines, four are in the possession of
Councilmembers and one is in storage at City Hall. At the present time, at least three of those
five fax machines no longer operate properly.
Due to the age of the fax machines, it would be much more cost effective to replace them than
to attempt to repair them. I have attached a copy of a page from the Viking Office Products
catalog that shows the Brother 770 plain paper fax machine for $99.98 after rebate. This
machine will also make copies and does not require a dedicated telephone line. Although this
type of fax machine is not intended for heavy use, it will handle fairly lengthy incoming faxes
and is smaller than the machines currently in use by Councilmembers. Councilmembers could
always come to City Hall with a bigger fax project or have larger faxes sent to City Hall without
incurring the cost of purchasing larger machines.

EQUIPMENT POLICY AND USE AGREEMENT

City of Oak Park Heights
I, the undersigned Oak Park Heights City Council member agree to abide by the
following rules and policies with respect to all equipment provided for in-home use by
the City of Oak Park Heights:
Section One- Ownership of Equipment
Title to all facsimile equipment, including all software and attachments,provided
under this agreement is, and will at all times remain, in the City of Oak Park Heights, and
individual council members shall have only the right to retain the possession of such
equipment pursuant to the conditions of this agreement.
Section Two-Identification of Equipment
If at any time the City of Oak Park Heights supplies individual council members
with labels,plates, or other markings stating that the equipment is owned by the City of
Oak Park Heights, the individual council members shall affix and keep such labels,
plates, or other markings in a prominent place on the equipment. Such marks of
identification displayed on the equipment shall not be altered, disfigured, or covered up.
Section Three - Care of Equipment
Individual council members shall use all provided equipment in a careful and
proper manner and shall comply with all laws, ordinances, and regulations relating to the
possession, use, or maintenance of all facsimile equipment provided.

Section Four-Use of Equipment
• Any use of the provided facsimile equipment is strictly limited to the individual
council member. Individual council members shall not make available the use of the
provided facsimile equipment to any other persons.
Section Five-Alterations and Attachments to Equipment
Individual council members agree that they will make no alterations in or to the
facsimile equipment provided, and will not add attachments to the computer equipment
provided without obtaining prior permission from the City of Oak Park Heights. The
City of Oak Park Heights reserves the right to require the removal of any such addition or
alteration and to require that the equipment be restored to its original condition.
Section Six-Return of Equipment
Upon expiration of a council member's term in office, or upon demand for return
• of equipment for any reason by the City of Oak Park Heights,the council member shall
return all provided facsimile equipment in good condition, ordinary wear and tear
resulting from proper use alone excepted, promptly to the City of Oak Park Heights.
Section Seven -Access to Equipment
The City of Oak Park Heights shall have the right to access, on reasonable prior
notice to the individual council member to install, inspect, remove and repair the
equipment as needed.

Section Eight-Risk of Loss or Damage,Indemnity for Loss or Damages, and

Liability and Indemnity for Personal Injuries
Individual council members assume all risk of loss and/or damage to the
equipment from any cause. In the event of loss of or damage to the equipment,the
individual council member, at the option of the City of Oak Park Heights shall:
1. Place the equipment in good repair;
2. Replace the equipment with like equipment in good repair,which
equipment shall become the property of the City of Oak Park Heights; or
3. Pay the City of Oak Park Heights the value of lost or damaged equipment
as determined by the City of Oak Park Heights.
Liability for injury to third parties caused by operating or handling of the provided
equipment during the period of possession by the individual council member shall be
assumed by the council member and the council member shall indemnify and hold the •
City of Oak Park Heights harmless against all such liability.
Section Nine- Software
Any software listed on any equipment schedule or incorporated as a component of
any equipment is furnished by the City of Oak Park Heights to the individual council
member is solely for the individual council member's use, and solely on the provided
facsimile equipment on which the software is first installed. Individual council members
shall not make software available in any form to any one else.
The City of Oak Park Heights licenses the use of its facsimile software from
outside companies. The City of Oak Park Heights and anyone who uses the facsimile
software must abide by the license agreements that govern the use of each software
application. •

Section Ten -Facsimile Use Policies
• All facsimile documents are considered public unless otherwise defined by the
Data Practices Act. In addition
all data and information stored on facsimile storage
media owned by the City is considered public unless otherwise defined by the Data
Practices Act.
1. Access and Disclosure
The City of Oak Park Heights reserves the right to access, for any PmP ose, all
messages sent over its facsimile machines. The City reserves the right to
access,
for any purpose, all data stored on facsimile media owned by the City. Any
person using the City facsimile resources to store or send data and messages for
any purpose has no expectation of or claim to privacy of that data except as
provided by the data practices act.
The City reserves the right to disclose any facsimile to law enforcement officials.
2. Unacceptable uses of facsimile system
• No council member shall be allowed to use the facsimile system to obtain access
to the files or communications of others without advance authorization. No
council member shall use the facsimile system to harass others,or use the
facsimile system to send ra,messages, graphics or documents which would constitute

harassment or a violation of the Civil Rights of any individual.
I accept and agree to the city's policy on use of its equipment in my place of residence
and will abide by the terms thereof.

I have in my possession a fax machine that was purchased by the city for council member use approx. 7 years ago. This
machine has broken beyond repair and is not useable anymore. Due to this break down I am going to dispose of this
machine at a proper disposal site. There is no asset tag on it so I will just discard it.

I, the undersigned Oak Park Heights City Council member agree
to abide by the following rules and policies with respect to all
equipment provided for in-home use by the City of Oak Park Heights :

times remain, in the City of Oak Park Heights, and individual
council members shall have only the right to retain the possession
of such equipment pursuant to the conditions of this agreement .
Section Two - Identification of Equipment
If at any time the City of Oak Park Heights supplies
individual council members with labels, plates, or other markings
stating that the equipment is owned by the City of Oak Park
Heights, the individual council members shall affix and keep such
labels, plates, or other markings in a prominent place on the
equipment. Such marks of identification displayed on the equipment
shall not be altered, disfigured, or covered up.
Section Three - Care of Equipment
Individual council members shall use all provided equipment in
a careful and proper manner and shall comply with all laws,
ordinances, and regulations relating to the possession, use, or
maintenance of all facsimile equipment provided.

limited to the individual council member. Individual council
members shall not make available the use of the provided facsimile

Section Five - Alterations and Attachments to Equipment
Individual council members agree that they will make no
alterations in or to the facsimile equipment provided, and will not
add attachments to the computer equipment provided without
obtaining prior permission from the City of Oak Park Heights . The
City of Oak Park Heights reserves the right to require the removal
of any such addition or alteration and to require that the
equipment be restored to its original condition.
Section Six - Return of Equipment
Upon expiration of a council member' s term in office, or upon
demand for return of equipment for any reason by the City of Oak
Park Heights, the council member shall return all provided
facsimile equipment in good condition, ordinary wear and tear
resulting form proper use alone excepted, promptly to the City of
Oak Park Heights.
Section Seven - Access to Equipment
The City of Oak Park Heights shall have the right of access,
on reasonable prior notice to the individual council member to
install, inspect, remove and repair the equipment as needed.
Section Eight - Risk of Loss or Damage, Indemnity for Loss or
Damages, and Liability and Indemnity for Personal Inju ries.

Individual council members assume all risk of loss or and
damage to the equipment from any cause . In the event of loss of or
damage to the equipment, the individual council member, at the
option of the City of Oak Park Heights shall :

2 . Replace the equipment with like equipment in good repair,
which equipment shall become the property of the City of Oak
Park Heights;or
3 . Pay the City of Oak Park Heights the value of lost or
damaged equipment as determined by the City of Oak Park

Liability for injury to third parties caused by operating or
handling of the provided equipment during the period of possession
by the individual council member shall be assumed by the council
member and the council member shall indemnify and hold the City of
Oak Park Heights harmless against all such liability.

Any software listed on any equipment schedule or incorporated
as a component of any equipment is furnished by the City of Oak
Park Heights to the individual council member is solely for the
individual council member' s use, and solely on the provided
facsimile equipment on which the software is first installed.
Individual council members shall not make software available in any

All electronic mail documents are considered public unless
otherwise defined by the Data Practices Act. In addition, all data
and information stored on computer storage media owned by the City
is considered public unless otherwise defined by the Data Practices
Act .
