FOR CITY NEWSLETTERS
WHEREAS, the City of Oak Park Heights prints a quarterly newsletter for
residents and local businesses; and,
WHEREAS, Heritage Printing has done the printing for the last five years; and,
WHEREAS, the City has been pleased with the quality of this company in
printing the City newsletter.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of
Oak Park Heights designates Heritage Printing as the official printer for City newsletters
for 2002.

WHEREAS, the City of Oak Park Heights has determined the need to designate
the Courier News as the official newspaper of the City for 2002 time sensitive
publications.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of

STILLWATER GAZETTE AS THE CITY
OF OAK PARK HEIGHTS OFFICIAL NEWSPAPER
FOR TIME SENSITIVE MATERIALS
WHEREAS, the City of Oak Park Heights has determined the need to designate
two newspapers as official newspapers for the City for 2002 due to time sensitive
publications; and
WHEREAS, for time sensitive publications, the Stillwater Gazette will be the
paper used by the City.
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of
Oak Park Heights designates the Stillwater Gazette as the official newspaper to handle
time sensitive publications for 2002.

RESOLUTION 2002 -01 -06
A RESOLUTION AMENDING CITY ORDINANCE 301,
SPECIFICALLY SECTION 301.03
AS IS RELATES TO PERMITS. INSPECTIONS AND FEES
WHERAS, Minnesota State legislation has effectuated in fee requirements to the
Minnesota State Building Code;
WHEREAS, effective January 1, 2001, legislative mandate requires a permit fee
limitation for minor residential improvements;
WHERAS, fee criteria for minor residential improvements limits permit fees to
$15 or 5 percent, whichever is greater, for improvement, installation or replacement of a
residential fixture or appliance that does not modify electric or gas service, has a labor
cost of $500 or less, and is done by the homeowner or a licensed contractor;
WHERAS, a fee schedule, attached hereto as exhibit A, has been determined for
building, mechanical, plumbing, grading, demolition, water and sewer services for the
City of Oak Park Heights and that said schedule has been prepared in compliance with
the applicable chapters of the Uniform Building Code and the Minnesota State Building
Code and mandated changes, effective January 1, 2002.
THEREFORE, BE IT RESOLVED that the City Council for the City of Oak Park
Heights hereby amend City Ordinance 301, section 301.03 to read as follows:
301.03 Permits. Inspections and Fees.
Permits shall be issued, inspections conducted and fees collected
as provided in Minnesota Statutes 16B.62, Chapter 1 of the Uniform
Building Code and Minnesota Rules 1305.0106 and 1305.017.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY GOLDRIDGE GROUP, REPRESENTING
STILLWATER FORD LINCOLN MERCURY FOR PROPERTY
LOCATED AT 12969 NORTH 60 STREET FOR AN
AMENDED CONDITIONAL USE PERMIT AND VARIANCES TO
ADDRESS LIGHTING CONFORMITY SHOULD BE APPROVED
WHEREAS, the City of Oak Park Heights has received a request for an
amended conditional use permit and variance to address lighting conformance issues at the
Stillwater Ford dealership located at 12969 North 60 Street, and after having conducted a public
hearing relative thereto the Planning Commission of Oak Park Heights recommended that the
application be partially approved and partially denied subject to conditions. The City Council of
the City of Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation
to the Community Development Department consisting of the following items:

and
3. The subject site is subject to a conditional use permit and site plan
approval of October 26, 1999 and a conditional use permit allowing the expansion of the major
auto repair use approved on November 23, 1999; and
4. The request is to allow for the existing light fixtures adjacent to Neal
Avenue remain as installed through the issuance of an amended conditional use permit and
variance. The light fixtures were not installed with a required ten foot setback. The applicant
also requests an allowance to allow five flood lights for architectural building lighting and to
exceed the allowable light levels of Section 401.15.13.7 of the Zoning Ordinance on the south
property line of the subject property; and
•
5. The City staff prepared a memorandum dated October 2, 2001 and
December 6, 2001 reviewing the request; and
6. The December 6, 2001 memorandum recommended that the application
for an amended conditional use permit and variance be approved for the lighting fixture setback,
but denial of the request to allow the five flood lights for architectural lighting and light
intensities that exceed the ordinance requirement on the south property line.
7. The Planning Commission held a public hearing at their December 13,
2001 meeting and took comments from the applicants and public, closed the public hearing, and
recommended that an amended conditional use permit and variance be approved for the lighting
fixture setback, but denial of the request to allow the five flood lights for architectural lighting
and light intensities that exceed the ordinance requirement on the south property line.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
1. The amended conditional use permit and variance submitted by Goldridge
Group for Stillwater Ford Lincoln and Mercury for lighting issues at 12969 North 60 Street and
affecting the real property as follows:

Be and the same is hereby approved by the City Council of the City of Oak Park Heights for
partial approval and denial subject to the following conditions:
1. All freestanding light fixtures shall be replaced with fixtures and light sources that do not
exceed a total height of 25 feet.
2. The five flood lights shall be removed. No additional flood lighting of the building
facades or sales lot shall be allowed.
3. The lighting plan shall be revised to reflect a light intensity in compliance with the
Zoning Ordinance requirements. All fixtures shall be installed such that the light
intensity is compliant with the Zoning Ordinance requirements. The applicant shall
provide proof of compliance once all of the lighting fixtures are installed on site.
4. The Planning Commission recommend and the City Council approve a variance and
amended CUP to allow the eight freestanding fixtures to remain at less than the 10 foot
setback requirement.

REQUEST BY KTJ LIMITED PARTNERSHIP ELEVEN
FOR ADDITIONAL SIGNAGE AT THE OAK PARK PONDS
DEVELOPMENT, 5801 NEAL AVENUE NORTH FOR AN
AMENDED PLANNED UNIT DEVELOPMENT AND VARIANCE
SHOULD BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from KTJ
Limited Partnership Eleven for an amended planned unit development and variance to allow for
an increase in height and sign area for the existing pylon sign, placement of illuminated tenant
signage on the south and west facades of the retail building that backs up to 58 Street and
placement of an illuminated 150 square foot Rainbow Foods sign on the northeast corner of the
• building at 5801 Neal Avenue; and after having conducted a public hearing relative thereto, the
Planning Commission of Oak Park Heights recommended that the application be partially
approved and partially denied subject to conditions. The City Council of the City of Oak Park
Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting

3. The property is subject to specific general plan of development approvals
for the Oak Park Ponds development approved in 1997; and
4. The applicants have proposed a 310 square foot pylon sign that would be
45 feet in height, a 150 square foot sign on the northeast corner of the Rainbow Foods store and
additional individual tenant signs on the west and south facades of the building that backs up to
58 Street; and
5. All of the proposed signage exceeds the signage allowances specified
under Section 401.15.G of the Oak Park Heights Zoning Ordinance and what was approved for
signage under the general plan of development approved for the subject site in 1997; and
6. City staff prepared a memorandum dated December 6, 2001 reviewing the
request; and
7. The December 6, 2001 memorandum recommended that the application
for an amended planned unit development and variance be approved for the pylon sign area, the
150 square foot Rainbow sign, and one additional wall sign for each tenant space on the building

FOLLOWING:
A. The amended planned unit development and variance submitted by KTJ Limited
Partnership Eleven for additional signage at the Oak Park Ponds development at 5801
Neal Avenue North and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights for
partial approval and partial denial subject to the following conditions:
1. The pylon sign shall be allowed to be increased in size to a maximum of 310 square feet
and contain individual tenant identification.
2. The pylon sign must remain a maximum of 30 feet in height.
3. A 150 square foot Rainbow sign be allowed on the northeast corner of the Rainbow
Foods building.
4. The wall light fixtures on the north side of the Rainbow Foods building shall be
retrofitted to be compliant with Zoning Ordinance lighting requirements.
5. All other conditions of the Planning Commission, City Council and City staff.

DEVELOPMENT, 5801 NEAL AVENUE NORTH FOR AN
AMENDED PLANNED UNIT DEVELOPMENT AND VARIANCE
SHOULD BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from KTJ
Limited Partnership Eleven for an amended planned unit development and variance to allow for
an increase in height and sign area for the existing pylon sign, placement of illuminated tenant
signage on the south and west facades of the retail building that backs up to 58 Street and
placement of an illuminated 150 square foot Rainbow Foods sign on the northeast corner of the
building at 5801 Neal Avenue; and after having conducted a public hearing relative thereto, the
Planning Commission of Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

3. The property is subject to specific general plan of development approvals
for the Oak Park Ponds development approved in 1997; and
4. The applicants have proposed a 310 square foot pylon sign that would be
45 feet in height, a 150 square foot sign on the northeast corner of the Rainbow Foods store and
additional individual tenant signs on the west and south facades of the building that backs up to
58 Street; and
5. All of the proposed signage exceeds the signage allowances specified
under Section 401.15.G of the Oak Park Heights Zoning Ordinance and what was approved for
signage under the general plan of development approved for the subject site in 1997; and
6. City staff prepared a memorandum dated December 6, 2001 reviewing the
request; and
7. The December 6, 2001 memorandum recommended that the application
for an amended planned unit development and variance be approved for the pylon sign area, the
150 square foot Rainbow sign, and one additional wall sign for each tenant space on the building
which backs up to 58 Street. The request for an increase in height of the pylon sign to 45 feet
was recommended for denial.
8. The Planning Commission held a public hearing at their December 13,
2001 meeting, took comments from the applicants and public, closed the public hearing, and
made the following recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The amended planned unit development and variance submitted by KTJ Limited
Partnership Eleven for additional signage at the Oak Park Ponds development at 5801
Neal Avenue North and affecting the real property as follows:

Be and the same as hereby recommended to the City Council of the City of Oak Park Heights for
partial approval and partial denial subject to the following conditions:
1. The pylon sign shall be allowed to be increased in size to a maximum of 310 square feet
and contain individual tenant identification.
2. The pylon sign must remain a maximum of 30 feet in height.
3. A 150 square foot Rainbow sign be allowed on the northeast corner of the Rainbow
Foods building.
4. One added wall sign on the south facade only, not to exceed 65 square feet, shall be
allowed for each tenant space in the building which backs up to 58 Street.
5. The wall light fixtures on the north side of the Rainbow Foods building shall be
retrofitted to be compliant with Zoning Ordinance lighting requirements.
6. All other conditions of the Planning Commission, City Council and City staff.

BACKGROUND
i Keith Ulstad, representing KTJ Limited Partnership Eleven, has made application for an
amended planned unit development (PUD) and variance to allow for an increase in
signage for the Oak Park Ponds development. The request includes an increase in
height and sign area for the existing pylon sign, placement of illuminated tenant signage
on the south and west facades of the retail building that backs up to 58 Street and
placement of an illuminated 150 square foot Rainbow Foods sign on the northeast
corner of the building. The general plan approvals of the PUD granted specific
allowances for signage at the Oak Park Ponds development. The amendment to the
PUD and variance is required to increase or significantly change the allowable signage
on site.
Approvals for the Rainbow Foods and connected retail area as well as the retail center
that backs up to 58 Street were granted in 1997. At that time, the City granted a
variance to allow for a 454 square foot Rainbow wall sign, two 60 square foot wall signs
on the Rainbow facade and allowances for three, eight foot high monument signs. All of
the other signs, including the pylon sign, were allowable under the sign requirements of
the Zoning Ordinance.

Proposed Signage
Pylon Sign. The applicants have proposed a 310 square foot pylon sign that would
be 45 feet in height. The sign has been designed to utilize the same base as the
existing pylon sign. The appearance of the sign would be similar to the existing sign
except that four tenant signs would be placed below the Oak Park Ponds and Rainbow
signs. The increase in signage height is being requested in that recent construction in
the area has made the existing signage not visible from the Highway 5 off -ramp.
Rainbow Sign. The request includes the addition of a 150 square foot sign on the
northeast corner of the Rainbow Foods store. The sign would be placed such that cars
heading westbound on Highway 36 would see it before the Highway 5 off -ramp.
Individual Tenant Wall Signs. The applicants have requested that additional wall
signage be allowed for the building which backs up to 58 Street. Currently, each of the
tenants are allowed up to 150 square feet in the sign area above the awning on the front
of the building. This signage is not easily visible from any of the adjacent streets. The
actual area for signage above the awnings is 125 square feet per building bay. Signs
have been proposed for each of the tenants on the south facade. One additional sign
for Wells Fargo Financial is proposed on the west facade.
Variance Criteria
Section 401.15.G.11 of the Zoning Ordinance specifies criteria for the granting of sign
variances. The criteria and analysis for the Oak Park Ponds request is as follows:
1. That particular physical surroundings, shape or topographical conditions of the
specific parcel of land involved exist.
2. That the condition involved is unique to the particular parcel of land involved.
3. That the purpose of the variation is not based exclusively upon a desire to
increase the value of income potential of the business involved.

4. That the alleged difficulty or hardship is caused by this Ordinance and has not
been created by any persons presently having an interest in the parcel.
5. That the granting of the variation will not be detrimental to the public welfare or
injurious to other land or improvements in the neighborhood.
6. That the proposed variation will not impair an adequate supply of light and air to
adjacent property, or substantially increase the congestion of the public streets or
interfere with the function of the police and fire departments of the City.
The applicants have indicated that the location of the shopping center and the new
development around the site have significantly reduced the visibility of the center and
the existing signage. They claim that competition from the other shopping center north
of Highway 36, which has visibility from the major roadways surrounding it, has made
the leasable spaces in Oak Park Ponds difficult to rent and keep tenants.
Staff finds that the request for a larger (more square feet of sign area) pylon sign, the
additional Rainbow sign, and the wall signage for the building that backs up to 58
Street is justified. The request for a variance to increase the height of the sign to 45
feet may be justified in terms of visibility, but could lead to a significant number of
requests for sign height increases. The City has not allowed a deviation from the
maximum height requirement of 30 feet. To allow for this variance may open the door
for numerous other height variances along the Highway 36 corridor.
The City will begin its work on revising the sign requirements in January of 2002. At that
time, it may be suggested to increase the allowances for sign height, although staff may
recommend that the maximum height limitation be lowered in the commercial districts.
RECOMMENDATIONS AND CONCLUSIONS
City staff recommends the following related to the request for a sign variance and an
amended PUD for Oak Park Ponds. Approval of the request is also conditioned on the
following:
1. The pylon sign shall be allowed to be increased in size to a maximum of 310
square feet and contain individual tenant identification.
2. The pylon sign must remain a maximum of 30 feet in height.
3. A 150 square foot Rainbow sign be allowed on the northeast corner of the
Rainbow Foods building.
if 4. One added wall sign not to exceed 75 square feet shall be allowed for each
tenant space on the building which backs up to 58 Street.

A RESOLUTION AUTHORIZING THE SUBMITTAL OF A COMMUNITY
DEVELOPMENT-BLOCK GRANT PROGRAM APPLICATION FOR
WASHINGTON COUNTY'S 2002 FORMULA ALLOCATION
WHEREAS, the City Council for the City of Oak Park Heights has voted to receive their
Community Development Block Grant Funds through Washington County in a formula
allocation for 2002, and;
WHEREAS, the total dollar amount of these funds is $62,286.34, and;
WHEREAS, the City has identified a need to support homeowners in the City who meet
the low and moderate income benefit requirement as identified by HUD through the
establishment of a grant program for exterior improvements, and;
WHEREAS, the City has identified a need to support the activities undertaken by
Washington County's HRA to improve the low - income townhomes of the Raymie Johnson
• property by supporting the installation of playground equipment for this facility, and;
WHEREAS, the application meets the following national objective: benefit to low and
moderate income people and benefit to a limited clientele;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
1. The submittal of an application for 2002 CDBG formula allocation funds for establishing a
grant program for low and moderate income homeowners in the City of Oak Park Heights
and to assist in funding the installation of playground equipment for the Washington County
HRA -owned Raymie Johnson townhome property.
2. A total of $50,000 will be allocated to the rehabilitation grant program available to low and
moderate income homeowners. Matching grants of up to five thousand dollars ($5,000) will
be provided to qualified applicants upon completion of their project. The grants must be
matched by any funds eligible under HUD and CDBG requirements. Eligible program
activities include exterior improvements such as the repair and replacement of siding and
brick veneers, windows, roofs, soffits, fascia, sidewalks and driveways and wood or concrete
entrance steps. All projects must comply with CDBG requirements. Applicants must
demonstrate that they meet the low and moderate - income limits for CDBG Funded projects.
•
3. Not less than $12,286.34 will be allocated to the purchase and installation of playground
equipment for the Washington County HRA -owned Raymie Johnson townhome property.
4. The City of Oak Park Heights will comply with and administer this program in compliance
with HUD and CDBG requirements.

WHEREAS, the City mileage reimbursement policy was $.0.34.5 per mile in
2001; and,
WHEREAS, Treasury regulations require that mileage reimbursement over
$0.36.5 per mile to be treated as taxable wages.

thus, no prior, special or general statue shall be construed to authorize or prevent the
disposal of public records at a time or in a manner different than prescribed by such
chapter of bylaws 1971, Chapter 529 and no general or special statute enacted
subsequent to Laws 1971, Chapter 529 shall be construed to authorize or prevent the
disposal of public records at a time or in a manner different than prescribed in this
chapter of in Laws 1971, Chapter 529 unless it expressly exempts such records from

STATUTE 13.03 RELATING TO THE RETRIEVAL, REPRODUCTION,
COPYING, RESEARCHING AND RELATED CHARGES AUTHORIZED BY
STATUTE UNDER THE GOVERNMENT DATA PRACTICES ACT
WHEREAS, the City of Oak Park Heights has previously established a charge
for the researching, retrieval and photocopying of documents; and
WHEREAS, the City of Oak Park Heights attempted to have a uniform charge
for all of its citizens and all persons requiring research, retrieval and reproduction of
records, and to represent the costs of reproduction of the records and the cost of
researching as requested by individuals; and
WHEREAS, the City of Oak Park Heights has reviewed its charges for certain
types of documents and has determined that, with regard to their reproduction the cost is
sufficient to cover the time of City employees, photocopying expenses and the use of
other facilities of the City of Oak Park Heights but, with regard to larger projects, may
• not be accurate as to the actual costs of reproduction and provision of those services; and
WHEREAS, the City Treasurer has determined that the cost of the City copier is
at the rate of 3 cents per copy; based upon the following data:

FOR THE CITY OF OAK PAK HEIGHTS PURSUANT TO
MINNESOTA STATUTE 204B.01 ET SEQ
WHEREAS, Minnesota Statute 204B.14 directs that each city shall constitute at
least one election precinct; and
WHEREAS, Minnesota Statute 204B.16 allows the establishment of one polling
place for each election precinct; and,
WHEREAS, Minnesota Statute 204B.16 allows the City to designate by
resolution additional polling places to serve each election precinct; and,
WHEREAS, it is the intent of the City of Oak Park Heights to maintain an at
large electoral method and yet allow its residents the opportunity to vote at an election
precinct without unnecessary delay and congestion; and,
WHEREAS, the City Council for the City of Oak Park Heights believes it to be
• in the best interests of the City and its residents to establish two election precincts within
the City of Oak Park Heights and have a separate polling place for each election district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR

CITY OF OAK PARK HEIGHTS

A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION BY THE CITY COUNCIL THAT THE
REQUEST BY INDEPENDENT SCHOOL DISTRICT 834
FOR CONDITIONAL USE PERMITS AND A VARIANCE TO
ALLOW CONSTRUCTION OF A STADIUM AT THE HIGH SCHOOL
LOCATED AT 58 STREET NORTH AND STATE HIGHWAY 5
BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from
Independent School District 834 (District) for an amended conditional use permit CUP to allow
for a change to the original CUP approval, a CUP to allow for 90 foot light poles and fixtures at
other than a 90 degree cutoff, and a variance to allow the two bleacher structures to exceed the
building height standards for accessory buildings; and after having conducted a public hearing
relative thereto, the Planning Commission of Oak Park Heights recommended that the
application be approved with conditions. The City Council of the City of Oak Park Heights
• makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

and
3. The subject site is zoned O, Open Space Conservation District in which
high schools are a listed conditional use; and
4. The City staff prepared a memorandums dated February 14, 2002 and
February 27, 2002 reviewing the requests; and
5. The memorandums dated February 14, 2002 and February 27, 2002
recommended that the requests be approved subject to conditions; and
•
6. The Planning Commission held a public hearing at their February 21, 2002
• meeting, took comments from the applicants and public, closed the public hearing, continued the
meeting to March 4, 2002 to allow staff to review the recommended conditions and to allow the
District to provide a Parking and Traffic Management Plan and an Emergency Evacuation Plan;
and
7. At their March 4, 2002 meeting, the Planning Commission reviewed and
made revisions to the recommended CUP conditions, the Parking and Traffic Management Plan,
and the Emergency Evacuation Plan, took comments from the applicant, and recommended the
application be approved subject to conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The application submitted by the District for an amended CUP to allow for a change to
the original CUP approval, a CUP to allow for 90 foot light poles and fixtures at other
than a 90 degree cutoff, and a variance to allow the two bleacher structures to exceed the
building height standards for accessory buildings, and affecting the real property as
follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights for
approval subject to the following conditions:
1. No activity at the stadium shall be illuminated with the outdoor lighting system after
1 1:00 PM or at any time on Sundays.
2. When constructed, the outdoor lighting system shall be tested to assure compliance with
the lighting requirements founds in Section 401.15.133(d) and (e) of the Zoning
Ordinance. Meter readings shall be provided to the City in compliance with methods of
measuring light intensity as found in the Zoning Ordinance.
3. The CUP will be granted to allow the stadium lighting to be constructed and operating
within two years of the time of initial completion of the stadium complex. If the lighting
is not erected within this period, its subsequent construction will require application for
necessary permits and approval of the City Council.
4. All events held at the stadium shall comply with State MPCA standards applicable to
sound. The City shall require limitations on use of loud speakers if noise levels are found
to exceed State MPCA standards. Upon installation of the sound system, meter readings
shall be submitted to the City demonstrating compliance with MPCA standards, subject
to City staff review and approval.

5. A lighting plan shall be provided by the District indicating provisions for lighting the area
• between the parking lots to the entrance gates and bleachers. The plan shall be subject to
review and approval of the City Council, City Engineer, and staff.
6. The emergency access drive and gate shall be appropriately marked and accessible to
emergency personnel at all times subject to review and approval of the Police Chief.
7. The District has established an Emergency Evacuation Plan for the stadium, subject to
review and approval of the City Administrator with consultation of the Police Chief and
City Engineer.
8. The District shall provide plans for securing satellite toilet facilities to the ground, subject
to review and approval of the Building Official.
9. Any plans for signage shall comply with Section 401.15.G of the Zoning Ordinance and
be subject to City review and approval.
10. Any plans to replace the existing score board shall be submitted to the City for review
and approval. Any plans to erect a new score board shall require a new application.
11. All landscape and transplanting plans shall be subject to review and approval of the City
Arborist.
• 12. Drainage calculations for the proposed changes to the site shall be submitted to the City
Engineer. All grading and drainage plans shall be subject to the review and approval of
the City Engineer and applicable watershed authority.
13. The District has provided material and color samples of the bleachers and press box. The
Planning Commission has recommended bleacher colors in red, black, or silver with
complementary colors for the press box as presented by the District.
14. The District has provided a Parking and Traffic Management Plan for event parking,
detailing when it will be put into effect, and how it will be implemented, subject to
review and approval of the City Administrator, with consultation of the Police Chief and
City Engineer.
15. This approval does not include the future concession/ticket and rest room facility.
Detailed plans would need to be submitted for amended conditional use permit approval
at the time of proposed construction.
16. The amended CUP shall be subject to the review process established in the original CUP
amended to delete any mandatory yearly review of the CUP with language as
recommended by the City Attorney.
