Telephone: 952.595.9838 Facsimile: 952.595.9837 planners @nacplanning.com MEMORANDUM TO: Kimberly Kamper FROM: Scott Richards DATE: March 19, 2002 RE: Oak Park Heights — High School Stadium FILE NO: 798.02 — 02.01 As a follow up to our staff meeting on March 13, 2002, please find a list of issues that were raised by the Mayor regarding approval of a stadium at the Stillwater Area High School. The Mayor has brought forward these issues for consideration prior to the stadium review by the City Council at their March 26, 2002 meeting. Parking A. The Mayor has questioned whether the City should require additional parking stalls to be constructed at the High School in conjunction with construction of a stadium. The School District (District) has indicated that with the existing and proposed stalls on site and implementation of a Parking and Traffic Management Plan, the issues of high school and stadium parking for highly attended events will be solved. With some minor modifications proposed to the existing bus corral parking area, the District will have a total of 992 parking spaces on campus. With a December 2002 projected enrollment of 2,275 students, the parking requirement for the High School, under the December 1991 conditional use permit approval, would be 910 parking stalls. Also, based upon Zoning Ordinance requirements, the requirement for a stadium would be 488 parking stalls. The District's solution to this issue is to schedule events such that there is limited overlap in utilization of parking stalls between the activities of the school and stadium events. The District further recognizes that for a highly attended stadium event of 4,500 persons, a parking demand from 1,280 vehicles to 1,500 vehicles, depending upon vehicle occupancy, would be created. As a result, off -site parking, implemented through the Parking and Traffic Plan, would need to be utilized. The Mayor suggests that the District add stalls so that there is between 1,200 to 1,500 parking spaces on site. While the 1991 conditional use permit approval sets a ratio of • one stall per 2.5 students, it also suggests that the City can consider the transportation and parking needs of the facility based upon usage. The language of that approval condition is as follows: "H. Parking. Parking shall be initially constructed to that which is shown on Area Site Plans dated September 3, 1991. The City may require the Applicant to upgrade or add additional parking spaces so as to provide for additional growth or use of the facility to be constructed by the applicant as student populations increase. The ratio to be used to require additional spaces shall be one parking stall per 2.5 students. Actual usage of the school parking facilities and plans by Independent School District No. 834 to effect a limitation on car transportation /parking needs of the facility shall be considered by the City of Oak Park Heights with regard to future review of parking facilities." Based upon current utilization of parking for day -to -day activities of the school, and the possible addition of the stadium, the City Council should consider whether approvals of a stadium should be conditioned on adding additional stalls on site. B. The Mayor also questions whether the utilization of off -site parking lots requires conditional use permit approval and conformance with the conditions in Section 401.151.11 of the Zoning Ordinance. That section allows for off -site, off - street parking to be utilized to meet the requirements of the Zoning Ordinance through approval of a conditional use permit. Staff had determined that the High School and stadium met the parking requirements of the original conditional use permit approval, thus not requiring an additional conditional use permit. One of the conditions of allowing off -site parking is that the stalls be located within 300 feet of the main public entrance of the use being served. The City Council should determine if there is a need for an additional conditional use permit required to allow off -site parking. C. The Mayor questioned whether a shuttle bus system will work for highly attended events at the High School. He was concerned that people would not be informed of the option or that they would be unwilling to take the extra time required for transport to the stadium. Board Authorization The Mayor questioned whether the School Board had officially authori4ed staff to move forward with the application for a stadium at the High School. 2 Design Guidelines As indicated in the planning report, compliance with the Design Guidelines is not required for structures zoned O, Open Space. The Mayor questions whether the proposed design of the stadium is acceptable in that it does not match the materials of the High School building. He indicated that the Design Guidelines use the High School building as an example for architectural style, colors and materials. The bleachers and press box are metal and are proposed to be either black, red or silver. Section 401.15.1) of the Zoning Ordinance indicates that "the same or similar quality exterior materials shall be used in the accessory building and the principal building." The High School building utilizes brick, glass and standing seam metal roof panels for its exterior covering. The metal bleachers and press box are of a similar quality exterior material to the roof panels of the High School building. The City Council should indicate whether the stadium is compatible or of a similar quality exterior material as the High School structure. Stadium Lighting The Mayor had questioned whether the four stadium light poles would require light beacons. Information was provided by Jay Pomeroy of Anderson - Johnson Associates Inc. that the poles are less than 200 feet in height and are of an adequate distance from the Lake Elmo Airport that no beacon lighting is required. The Mayor had also questioned what color had been proposed for the poles. Mr. Pomeroy indicated that the poles would be painted silver. The City does not have an ordinance requirement for color of light poles, but we routinely specify a bronze color for light fixtures and poles in development projects. Additionally, we require antenna and tower structures under 200 feet to be painted silver. In order for the poles to blend better with the sky as a background, the silver color would be preferred. Food Concessions The Mayor questioned if the District would provide any type of portable concession stands for stadium events. His concern was if Washington County health standards would be complied with. Mike Brabender, representing the District, has indicated that the concession stands would be operated by a booster club and would comply with all health standards. Rest Room Facilities The Mayor felt that rest room facilities should be required for the stadium at time of construction as part of the amended conditional use permit approvals. On the subject of the restroom issue which has been raised by Jim Butler, we have contacted the Minnesota Building Codes and Standards Division (the 'Division "), and it is our understanding that permanent restroom facilities are not required for the outdoor stadium project. hi fact, the Division has interpreted the applicable sections of Mimiesota's adoption of the 1997 Lhiform Building Code with respect to bleacher seating. The Division has issued Policy PR -04 (0 which states that the Division will recognize the use of 11 portable temporary fixtures that will be available on site during times when the bleacher seating is in use." Under Minn. Stat. 1.68- 59 -61, the Minnesota State Building Code governs the construction of bleachers. For your reference, we have also enclosed a copy of Policy PR -04 (3/00). Additionally, enclosed with this correspondence is a copy of a letter previously addressed to Kris Danielson which was intended in part to discuss recent issues raised by Police Chief Lindy Swanson, relating to the Emergency Evacuation and Parking and 1'raffie Management Pl;tns, At Kris suggestion, we have spoken with Mr. Swanson directly to discuss our comments with him, Based upon our discussions with Mr. Swanson, it is our understanding that he is now comfortable with both Plans with the exception that he believes that it is important to have four oft -duty police officers in the Stadium during football games. In short, there appears to be a conflict within the City as to where the off - duty police officers are to be located. The City planning staff and Planning Commission seem to have been supporting a "requirement" that four officers be required t pe rfo rm t" tat fur ofcers required d to the Stadium. Mr. Swanson appears to support a requ perform crowd control duties inside the Stadium. The District would prefer some flexibility in managing this resource effectively, however. In addition to the above, this is simply to update/respond to selected outstanding matters relating to the District's application: I. As to plans for spectator lighting, landscaping and securing of satellite toilets, certain of those plans have now been delivered to you. We hope to have plans for securing of satellite toilets furnished to you prior to the end of this week for review by City staff and inclusion in Council Member packets for the March 26 meeting. Should we encounter any delays in this regard, I will update you accordingly. 2. As to the comments recently provided to the Parking and Traffic Management Plan and Emergency Evacuation Plan by the City's police chief, Mr. Lindy Swanson, we generally concur with his comments. However, for the reasons discussed below, we believe further modification to the Plans should be unnecessary. Both the Parking and Traffic Management Plan and Emergency Evacuation Plan are intended only to establish the District's min ° um duties in the areas of parking and traffic management and emergency evacuation for the various Stadiuru events. Neither plan was intended to address issues outside that scope, nor has the District previously been requested to expand the scope of either plan. b, The requirement for four security officers, which originally appeared as Condition No. 18 to the February 14, 2002 Planning Report, implemented comments by the Planning Staff, as discussed under the "Traffic" heading on page 8 of that report. There, the report recommends the use of four off - duty police officers for traffic purposes. In implementation of the requirements of this report, Section 3 of the Parking and 'traffic Management Plan incorporates the report's recommendation for four security personnel. The District has accepted this recommendation without controversy, and endorses the need for use of such security personnel to handle traffic management. Whether all four will ultimately be required for such purposes will depend on actual experience in implementing the Plan. Should a lesser number prove to be required, then the District would discuss this with the City in the context of a possible later amendment to the Plan in accordance with its terms. Such would, of course, require approval by the City Administrator, after consultation with Mr. Swanson. C. Mr. Swanson indicates that application of the security personnel to the handling of traffic management would not be possible as such security personnel would be occupied with crowd control instead. Again, the purpose of the Parking and Traffic Management Plan was in part to allocate responsibilities of security personnel for traffic management purposes —not security purposes. Ile District has a long history of handling stadium security at Miller Stadium. No prior concerns have been expressed as to the District's ability to perform this task, nor have security issues been raised in any of the Planning Reports prepared by the Planning staff, or otherwise expressed during any of the prior Planning Commission Meetings. d- It is possible that some traffic management and stadium security responsibilities Wright be performed by the same Security Personnel. Similarly, outside this "window ", there may well be some need for additional interim crowd control measures. In this regard, the District will probably need 'to hire additional Security Personnel to perform that function. It makes sense, however to allow the District the flexibility to manage its traffic control and crowd control resources effectively. Realistically, the establishment of inflexible rules in this area will make it difficult for the District to respond to actual conditions during a Stadium event. Little benefit is afforded the City, the District, the community, or the tax payers to require the District to have excess Security Personnel on hand, or to overly limit or control the District's utilization of such resources during an actual event. e. Mr. Swanson is convect in noting that both the Parking and Traffic Management Plan and Emergency Evacuation Plan refer in selected instances to "Security Personnel, if any". The purpose behind these references is not to undercut the mandatory obligation set forth in Section 3 of the Parking and Traffic Management Plan. Rather, it is simply a recognition of the fact that both plans are intended to also govern situations (i) where Security Personnel are not re uired by the City for traffic management purposes (i.e., non - highly attended events), and (ii) where Security Personnel may similarly not be required by the District for either traffic management or security purposes. Given the variety of events that will be held in the Stadium (both known and unknown at this time) it is reasonable to expect that certain events will require little or no traffic management or security coverage. The difficulty is in prescribing those circumstances in advance in such a manner as can be usefully implemented in the future. At some point, discretion needs to be left to the District to make plans in accordance with the needs generated for each particular event.. The Parking and Traffic Management Plan and Emergency Evacuation Plan are intended to apply to all Stadium Events and therefore are drafted with that flexibility in mind. The revised detail is what we are proposing to provide. We have had discussions with Paul Hoppe, the owner of the local satellite toilet company, to determine the most appropriate way of securing the units to minimize vandalism (tipping, moving, etc.). He stated that toilet units are typically secured to chain link fencing with cable and locks. Generally, a maximum of two units are cabled together to eliminate excessive slack in the cable. The cable is strung through the wood skids at the base of the toilet unit and through the fence. Keys are then held by school maintenance staff and the satellite toilet company. A clear and more comprehensive approach was lost due to extensive changes made to the means of egress provisions contained in chapter 10 of the 1994 UBC. These means of egress provisions were totally re"-itten for the 1997 edition because of pressure to conform to the format of the other national model building codes. Removed in the process were practical requirements relating to when aisles are required, aisle width, distance to aisles and the delineation of provisions between indoor and outdoor seating, to name a few. Two relevant factors: . First, many bleachers and grandstands are being replaced to comply with Minnesota's Bleacher Safety Act. As a result, everyone involved in bleacher sales, design, manufacture, construction and inspection is inquiring of the Division about the interpretation of bleacher codes. However, Division staff is unable to adequately answer many of these questions because certain of the applicable UBC provisions are either overly restrictive, contradictory, not understandable or no longer exist. The result is inconsistent design and compliance with the state building code. . Second, the reality is that building permits have often not been obtained for these types of structures. There are two reasons for this. One is that bleacher seating usually gets installed after buildings are already constructed and building permits closed out. Another is that because they are install ed after buildings are complete, they are often viewed by both inspector and installer as equipment not requiring permits. Although these are generalizations, the fact is that most code officials are not used to working with the bleacher seating provisions of the Uniform Building Code. It is because of this that up -to -date comprehensive code requirements relating to bleacher seating have not been established in the Uniform Building Code. Prior to that edition, the code permitted the number of seats without backrests between any seat and an aisle to be not greater than 20, for a total of 42 seats in a row with aisles at each end. In general, this is what the bleacher seating industry has used as a standard for the manufacture of their' product for years. Now both the 1997 UBC and 2000 IBC only permit a maxi mum of 14 seats per row with the typical 12 -inch wide aisle accessway. In conta ast, for indoor bleachers the 1997 UBC permits 9 seats between any seat and an aisle, for a total of 20 scats in a row. This is less restrictive than that permitted outdoors. Therefore, as established in NFPA 101, the following is an acceptable equivalent alternative to the number of seats to an aisle provision contained in U13C Secton 1004.3.2.3.2. As a result, the required aisle width more than doubled in most cases when compared to the 1988 UBC. ICBO issued an option soon thereafter that stated the intent of the change was not to tie aisle width in bleacher type seating to the requirements for auditorium type seating. Their recommendation was to use the 1988 UBC to determine aisle width. The 1988 UBC requires 36 inches for aisles serving seating on one side and 42 inches for aisles serving seating on both sides, regardless of occupant load. Despite the ICBO opi lion, no code change resulted in either the 1994 & 1997 UBC to correct the langmage with the original intent. This has created a hardship for bleacher malufactmers and has lead to inconsistent application of the code. Postal Servico. 503595.1 PARKING AND TRAFFIC MANAGEMENT PLAN Stillwater High School Stadium March 2002 The following is the parking and traffic management plan for implementation at all events held at the Stillwater High School Stadium, located at 5701 Stillwater Boulevard North, Oak Park Heights, Minnesota. Section 1.Defined Terms. means the City of Oak Park Heights, Minnesota. " District " means Independent School District No. 834. "Highly Attended Event" means, in the case of a Stadium Event, any event with attendance of over 3,000 persons. The District shall project which Stadium Events will be classified as Highly Attended Events by using the historical data of attendance at such events. Historically, based upon the attendance, the homecoming football game would be considered a Highly Attended Event. The District shall evaluate the • attendance at other events to ascertain if any such other events will be considered Highly Attended Events. " High School Pro e ' means Stillwater High School property, located at 5701 Stillwater Boulevard North, Oak Park Heights,. Minnesota. "No n_HiaMY Attended Event means, in the case of a Stadium Event, any event other than a Highly Attended Event. " Off -site P arkin g Lo t" means any parking lot not located on the High School Property, as designated by the District from time to time, and approved by then acting police chief for the City, as an Off -site Parking Lot for the purpose of Stadium event parking. Unless another designation of a Shuttle Route is made in accordance with this Parking and Traffic Management Plan, the Off -site Parking Lots shall be as shown on the attached Ex hibit A. "Shuttle Route" means, the route shuttle buses will take to drop -off and pick -up Stadium Event attendees, as designated by the District from time to time, and approved by then acting city administrator for the City, after consultation with the City's then acting police chief and city engineer. Unless another designation of a Shuttle Route is made in accordance with this Parking and Traffic Management Plan, the Shuttle Routes shall be as shown on the attached Exhibi A. With respect to Highly Attended Events, the District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall implement such marketing and parking informational strategies as the District or such Stadium Event organizers or sponsors deem reasonably prudent and effective to inform Stadium Event attendees of applicable event parking arrangements, including without limitation the following: (i) The prohibition against curbside or other parking in other than On -site and Off -site Parking Lots, together with such other parking restrictions related thereto as may be communicated by the City to the District from time to time; and 81 0299 -3 2 e P N E� v u e i (ii) The location of Off -site Parking Lots, the location of drop -off and pick -up sites, and the availability of shuttle bus transportation services to and from the Stadium, and to encourage car pooling, and the use of such Off -site Parking Lots and shuttle services. (b) Non - Highly Attend Events. With respect to Non - Highly Attended Events, the District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall implement such marketing and parking informational strategies as the District or such Stadium Event organizers or sponsors deem reasonably prudent and effective to inform Stadium Event attendees of applicable event parking arrangements, including without limitation the following: (i) The prohibition against curbside or other parking in other than On -site and Off -site Parking Lots, together with such other parking restrictions related thereto as may be communicated by the City to the District from time to time. (ii) Such other marketing and /or parking informational strategies as the District deems appropriate under the circumstances. (c) Ill Marketing And Parking informational Str Such marketing and parking informational strategies may include any of such efforts as (i) newspaper and /or radio advertising, (ii) postings at District school, or such other organizer or sponsor, facilities, (iii) District, or such other organizer or sponsor, website postings, (iv) informational flyers to District students and/or other prospective attendees, (v) notifications to season ticket holders, (vi) informational notifications to school districts for visiting teams (in the case of game events) or otherwise to groups or entities sponsoring or representing, potential attendee groups (in the case of non -game events), or (vii) such other or additional strategies as the District, or such other organizer or sponsor, determines, from time to time, to be useful and effective. Section 3. Intersection Traffic Management The District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall provide a minimum of four (4) Security Personnel for all home football games and all Highly Attended Events to perform the following duties with respect to traffic management: (a) Security Personnel shall direct traffic at the following intersections and parking lot entrances (or as needed at other locations): ID F. (b) Except to the extent such duties are allocated to flag persons performing parking lot management duties pursuant to Section 4 below, Security Personnel shall monitor the availability of parking. spaces within the On -site Parking Lots and, as necessary, shall close such On -site Parking Lots and post appropriate temporary signage'at all On -site Parking Lots entrances and /or those intersections identified in (a) above, advising potential event attendees when the On -site Parking Lots are full, and directing such. potential attendees to any alternative Off -site Parking Lots. (c) Security Personnel shall communicate with each other to direct traffic as necessitated by variable traffic flow. Section 4. On -site Parking Lot Management The District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall utilize flag persons for all Highly Attended Events to perform the following duties with respect to On -site Parking Lot management; (a) Such flag persons shall work in coordination with Security Personnel performing traffic management duties in accordance with Section 3 above, to direct traffic flow within the On -site Parking Lots for all Highly Attended Events. (b) Such flag persons shall monitor the availability of parking spaces within the On -site Parking Lots and, as necessary, shall close such On -site Parking Lots and post appropriate temporary signage at all On -site Parking Lots entrances and /or those intersections identified in Section 3(a) above, advising potential event, attendees when the On -site Parking Lots are full, and directing such potential attendees to any alternative Off -site Parking Lots. Section 5. Off -site Parking and S huttle Bus Services: The District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall provide off -site parking and shuttle bus services for all Highly Attended Events as follows: (a) The District, or such organizers or sponsors, shall make available to Stadium event attendees off -site parking in one or more of the RB L} ICAN&ARUNDEL 810299 -3 Off -site Parking Lots, and shall provide appropriate shuttle bus services between such Off -site Parking Lots and the High School Property, in connection with each Highly Attended Event. Except to the extent Shuttle Routes may not be accessible or otherwise useable (e.g., road construction detours, obstructions due to accidents or other emergencies, etc.), Shuttle buses shall adhere to the Shuttle Routes. In each case, the number of required Off -site Parking Lots and shuttle buses shall be determined by the District, or such organizers or sponsors, in accordance with the District's, or such organizers' or sponsors', projections for Stadium event attendance and for Off -site Parking Lot usage. (b) The District, or such organizers or sponsors, shall furnish one or more shuttle attendants at the High School Property shuttle drop off location(s), as shown on the attached Exhibit A , and /or at each . Off -site Parking Lot used by the District, or by such organizers or sponsors, to direct the loading and unloading of shuttle buses. (c) The District, or such organizers or sponsors, shall furnish one or more flag persons at each Off -site Parking Lot used by the District, or by such organizers or sponsors, to direct traffic flow within such On -site Parking Lot. (d) The District, or such organizers or sponsors, shall post appropriate temporary signage at each Off -site Parking Lot and shuttle drop off • location used by the District, or by such organizers or sponsors, providing appropriate directional and /or other information for potential event attendees with respect to the availability and implementation of off -site Stadium Event parking and shuttle bus services. Section 6. Parking and Traffic Management Instruction/Training. (a) The District shall provide instruction or training of Security Personnel and parking lot flag persons. (b) In the case of Stadium Events other than District sponsored Stadium Events, the District shall furnish a copy of the Parking and Traffic Management Plan to the Responsible Officials designated by the sponsoring entity. (c) A copy of the Parking and Traffic Management Plan will be furnished to all Security Personnel. Section 7, Day Fo Games a nd H g Even Until such time as the District constructs Stadium lighting to enable it to hold lighted evening events at 10 5 R10ERDCNNETT EGAN4ARUNDCL 810299.3 the Stadium, all football games and Highly Attended Events to be scheduled during daylight hours shall be scheduled not earlier than one (1) hour following the time by which the District projects that the On -site Parking Lots shall be reasonably cleared, subject to holdover parking by students, teachers and /or other District employees who may be intending to remain on the High School Property for purposes of attending such game or other event. Section 8. Parking Fees The District does not presently anticipate charging fees, or permitting the charging of fees by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), for parking in connection with any Stadium events. If the District desires to charge fees, or permit the charging of fees by such organizers or sponsors, for Stadium event parking in the future, the District will amend this Parking and Traffic Management Plan in accordance with Section 10 below. Section 9. Non - District Sponsored Events With respect to Stadium events organized or sponsored by other than the District, the District shall coordinate with the applicable Responsible Officials to encourage and supervise implementation of the obligations and responsibilities allocated to such organizers or sponsors under this Plan, as applicable. Section 10, 6mendments to Parking and Traffic Management Plan: The Parking and Traffic Management Plan may be modified from time to time upon the approval, or at the request, of the then acting city administrator for the City, after consultation with the City's then acting police chief and city engineer. Section 9. Defined Terms. "�qLty" means the City of Oak Park Heights, Minnesota. " District " means Independent School District No. 834. " Emergency " means, in the case of a Stadium Event, any event or occurrence which presents in the reasonable judgment of the then acting Responsible officials an emergency situation creating a substantial risk of endangerment of the life, safety or security of attendees at such Stadium Event, including both players and spectators, such that Emergency Evacuation is deemed in the reasonable judgment of . such Responsible Officials to be necessary or prudent for the protection of such attendees. An illustrative list of such emergency situations includes, fire, violent weather (including thunderstorms, dangerously high winds or tornado activity), bomb scares, terrorist activity, flash floods and other similar occurrences. " Emergency Evacuation means any evacuation of the Stadium in connection with any Emergency, as a result of, or pursuant to, the decision of the then acting Responsible Officials. " Emergency Evacuation Plan means this emergency evacuation plan, or such amended emergency evacuation plan as may be adopted from time to time hereafter, whether as a supplement to, or in replacement of this emergency evacuation plan. " Emergency Exits means the following entrance /exit gates located at the Stadium (all as depicted on Exhibit A attached to this Plan): (a) the main entrance /exit gate located at the northerly end of the Stadium; and (b) the emergency access gate, located at the northwesterly end of the Stadium and proximate to the visitors' bleachers. "Evacuation S_ taging Areas means those open areas located within the Stadium and immediately to the north and south of each of the home and visitors' bleachers (all as depicted on Exhibit A attached to this Plan). 1 10Ert 0 f.NNV1 CAN &AAUNDt t. " Responsible Officials means in each case (a) those officials employed by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), who are designated by the District, or such Stadium Event organizers or sponsors, as being responsible for supervising a Stadium Event; and (b) such law enforcement personnel as may be employed by the City and have authority under applicable law to exercise emergency powers to preserve or protect the safety, security and /or welfare of Stadium attendees. " Security Personnel means those security personnel, if any, employed by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), then located at the Stadium during a Stadium Event. " Stadium " means the Stillwater High School Stadium, located at 5701 Stillwater Boulevard North, Oak Park Heights, Minnesota. " Stadium Eve nt" means any formal event held within the Stadium, whether District sponsored or otherwise formally sanctioned or permitted by the District. Section 2. Evacuation Protocol Upon the occurrence of any Emergency resulting in the decision by the Responsible Officials to declare an Emergency Evacuation, the following rules shall apply: (a) All attendees. shall be promptly instructed to immediately depart the • bleachers and other Stadium areas in an orderly manner, and shall be provided such other directions as may be appropriate under the circumstances. In the event the Stadium public address system is in use for the applicable Stadium Event, the public address system announcer shall provide such instructions. If the public address system is not in use, or if for any reason such system is not then operational, the Responsible Officials, with the assistance of any Security Personnel, shall provide such instructions. (b) All Security Personnel, if any, or such Responsible Officials, in the absence of any Security Personnel, shall immediately assist in directing spectators out of the bleachers and into the closest available Evacuation Staging Areas, and shall otherwise assist in facilitating a prompt and orderly evacuation of the Stadium by way of the Emergency Exits. (c) If, in the opinion of the Responsible Officials, the applicable emergency conditions warrant providing emergency shelter to the attendees, such attendees shall be directed to the school building entrance serving the gymnasium areas, and such attendees shall be encouraged to seek shelter within the gymnasium areas for their safety and security. • RIDER HFNN6T 8100184 2 EBANLARUNDEI. Emergency Exits /Evacuation Staging Areas At all times during any Stadium Event the Emergency Exits and Evacuation Staging Areas shall remain free of any temporary or .permanent, physical obstructions so as to facilitate unhindered egress from the Stadium in the event of any Emergency Evacuation; provided, however, location of one or more trash receptacles within an Evacuation Staging Area shall not be deemed a temporary or permanent physical obstruction for purposes of this Section. Section 4. Em ergency Instruction/Training The District shall undertake the following instructional /training steps in connection with the implementation of this Emergency Evacuation Plan: (a) The District shall incorporate this Emergency Evacuation Plan in all appropriate emergency instruction and training programs which may be conducted by the District for District personnel from time to time. (b) In the case of Stadium Events other than District sponsored - Stadium Events, the District shall furnish a copy of the Emergency Evacuation Plan to the Responsible Officials designated by the sponsoring entity. The City Council of the City of Oak Park Heights makes the following findings of fact: • 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The subject site is zoned CBD, Central Business District in which office buildings are a listed permitted use; and 4. The PUD /CUP and preliminary /final plat is required to subdivide the property for office condominiums; and 5. A conditional use permit is required to allow a reduction from the off - street parking supply requirements and to allow a joint parking proposal with an adjoining property; and N 6. The City staff prepared a memorandum dated December 6, 2001 which recommended the applicant address issues related to the site and to provide additional information; and 7. In February 2002, the applicant provided additional information and a Declaration of Cross Easements with the adjoining property owner; and 8. The City staff prepared a memorandum dated March 7, 2002 recommending the Planning Commission approve the request subject to submittal of additional information and satisfaction of conditions; and 9. The March 7, 2002 memo addressed the issue of the termination clause of the Declaration of Cross Easements and the need for City Attorney approval of the document. 10. The City Attorney drafted a memo on March 14, 2002 indicating that the Declaration of Cross Easements document could not be approved with the 60 day termination clause and without document amendment or modification approval by the City of Oak Park Heights. 11. At the March 14, 2002 Planning Commission meeting, City staff recommended that the application not move forward until a preliminary /final plat was submitted and a Declaration of Cross Easements, which is satisfactory to the City Attorney, was submitted for approval; and • 12. The Planning Commission held a public hearing at their March 14, 2002 meeting, took comments from the applicants and public, closed the public hearing, and recommended approval of the application; and 13. On April 12, 2002, the City of Oak Park Heights received a letter from Montanari Homes addressing the market for the office building, a utility plan, and a signed Declaration of Cross Easements; and 14. The signed Declaration of Cross Easements did not include language acceptable to the City Attorney regarding termination and City of Oak Park Heights approval for amendment or modifications. 15. The Declaration of Cross Easements submitted by the applicant to the City of Oak Park Heights is not acceptable to the City Attorney in regards to the termination clause and City of Oak Park Heights approval for amendments or modifications to the document. 16. The project as proposed requires 90 off - street spaces in accordance with Section 401.15.F. the Zoning Ordinance. With proof of parking, the applicant is proposing 53 off - street parking stalls. Without a Declaration of Cross Easements that is acceptable to the City Attorney to allow utilization of the Eagles parking lot or the provision of on- street parking on 60 Street North, the subject site will be 37 off - street parking stalls short of the Zoning Ordinance requirements. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL DENIES THE FOLLOWING: A. The application submitted by Montanari Homes for a planned unit development/ conditional use permit, a conditional use permit for a reduction in parking and to allow a joint parking allowance, preliminary /final plat and site plan/Design Guideline review for an office building at 13481 North 60 Street and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby denied by the City Council of the City of Oak Park Heights based upon the following findings: 1. The Planning Commission should provide direction regarding the acceptability of the proposed parking stall dimensions. 11. The Planning Commission recommends an 18 foot parking stall length with a two foot overhang for the parking areas on site. 12. No snow storage shall be allowed on site. Grading and drainage issues are subject to review and approval of the City Engineer and review of the applicable watershed authority. 14. Grant of Easement The Eagles hereby grant and convey to Montanan a temporary easement for parking purposes only over the bituminous surface area of the Eagles Property now used as a parking lot. 2. Grant of Easement Montanan hereby grants and conveys to the Eagles a temporary easement for parking purposes over the bituminous surface area of the Montanan Property now used as a parking lot. 3. Limitation of Easement The easements granted herein shall be limited as follows: The Eagles shall have the right to use the Montanari parking lot easement described above during the hours of 5:30 p.m. until 7:00 a.m cf each day. Montanari shall be allowed to use the parking easement on the Eagles property during the hours of 7:00 a.m. until 5:30 p.m. of each day. No semi - trucks, trailers of any kind, bobcats, backhoes, trucks in excess of 1 ton or similar vehicles or equipment shall be allowed to park on the easement premises without the consent of the fee owner. 4. Repair and Maintenance The owners of their respective properties shall have the sole obligation and responsibility for the repair and maintenance of the parking surfaces on their property. Such repair and maintenance shall include the resurfacing of the parking area, the plowing of snow and the application of salt and/or sand as needed. Each party represents and agrees that it will maintain their respective parking surface in good condition of repair. • 5. Easement not to be obstructed It is expressly understood and agreed that the easements herein created are for the sole purpose of parking. The owners of the parcels shall use the rights granted by this instrument with due regard to the rights of others and their use of such easement shall be such that it will not obstruct passage or drainage thereon. 6. Easement Term This easement shall be for an indefinite term but may be terminated by either party by written notice to the other 60 days in advance of termination. Such notice shall be delivered personally or by certified mail to the addresses in paragraphs 2 and 3 of the Recitals set forth above. A copy of the Notice of Termination and Affidavit of Service shall be recorded in the office of the Washington County Recorder if this easement document has been recorded. • 7. Issues of concern for residents of Oakgreen Avenue and for residents of Pond View Condominiums included: • The current condition of Oakgreen Avenue and traffic congestion at the intersection of Hwy 36 and Oakgreen Avenues. • The proximity of affordable rental housing to their properties. • Tot lots and playgrounds should be located away from roadways, families with children will need a place for their children to play. • The uncertainty of how future development will impact their properties. • The desire for a privacy fence and screening to be incorporated into the Villas plans. In addition the Commission discussed: t How the applicants arrived at a decision to place this development in its proposed location. • The need for compliance with any requirements Xcel Energy may have relative to its easement and the proximity of development. The applicant shall dedicate an easement for 59 Street and all required drainage and utility easements as required by the City in the final plat and development contract. 5. The Park Commission should comment on the trail requirements for this area and recommend the desired trail/sidewalk locations for incorporation into the general plan of development. 6. The current setbacks for the Villas project as proposed are acceptable. 7. The applicant shall provide drainage calculations for the proposed site as part of the general plan application.
