Several parties have raised some concerns regarding Condition No. 15 of the CUP
and drainage easement conditions from Valley Branch Watershed District related to
the stadium improvements at the Stillwater High School. Please review the attached

Community Development Director Danielson explained that the Planning
Commission has recommended that this application move forward to the City
Council after receipt of two more items. Danielson noted that the applicant has
requested consideration at an April Council meeting and has waived the statutory
120 day review period.
Mayor Beaudet, seconded by Councilmember McComber, moved to have the
Acting City Administrator send a letter to Mr. Montanari stating that the
application will be on the April 23, 2002 City Council Agenda and if he wishes to
have the Council review any additional information it must be received by April
17, 2002.
Councilmember Doerr, seconded by Byrne, moved to amend the motion to
change April 17 to April 12. Carried 5 ----- 0.
Vote was taken on the primary motion as amended. Motion carried 5 ---W 0.
B. Stillwater Area Hi ' h School — Stadium Inn•rovements
Planner Richards reviewed his March 21, 2002 memo outlining Planning
Commission Recommendations. Richards also reviewed the draft Resolution and
suggested changing the language in the title and body of the Resolution to reflect
that the Planning Commission failed to approve the application.
Richards reported that the proposed restroom facilities were discussed at length
during the previous week and provided clarification of comments made in his
March 19, 2002 memo on this issue. Richards noted that permanent restrooms
would not be required by the state on the stadium grounds if the restrooms in the
high school building were made available for use.
School district attorney Jeff Carpenter reviewed a drawing of the site plan
showing placement of bleachers, lights, speakers, press box and outlined the
anticipated construction schedule. Carpenter also addressed issues outlined in the
most recent planning report.
Discussion was held regarding the proposed shuttle bus system from Lily Lake
Elementary and Stillwater Junior High. Mr. Carpenter stated that the school

district feels the shuttle bus system will address parking issues and they are very
concerned about the possibility of the City requiring installation of additional
blacktop to serve just a few events each year. Mayor Beaudet emphasized the
shortcoming in the parking available for homecoming and playoff football games.
Beaudet stated that his concern is that attendance at those games would be 7,500
to 8,000 and the addition of more parking is a reasonable request. Beaudet also
expressed concern about stadium patrons parking at the shopping center across
the street and the City's possible recourse against the high school to compel
installation of additional parking.
Mr. Carpenter reiterated figures and projections received from the school
district's parking consultant and suggested leaving a one year review in place to
readdress parking issues after the stadium is in use and needs can be assessed.
Mayor Beaudet, seconded by Councilmember McComber, moved to have the City
Attorney draft language permitting future Council review of the stadium parking
issues. Carried 5 — 0.
Discussion was held concerning design guidelines, bleacher colors and materials.
Planner Richards noted that design guidelines technically do not apply to the high
school as it is zoned Open Space.
Jay Pomeroy of Anderson - Johnson Associates reported that the bleachers are
planned to be red, black or silver and will be constructed of a material that will
not fade or rust. Mr. Pomeroy also reviewed light and light pole design. Mayor
Beaudet expressed concern that the surfaces of the light fixtures be non - reflective.
Councilmember McComber, seconded by Mayor Beaudet, moved to add a
condition stating that should the school district decide not to construct permanent
bathroom facilities, the high school building will be open for the use of the
bathroom facilities. Carried 5 --- 0.
Councilmember Swenson, seconded by Byrne, moved to substitute the motion on
the restrooms with a motion to require compliance with state statutes regarding
restroom facilities subject to annual city council review.
Councilmember Doerr, seconded by Byrne, moved to call the question on the
primary motion. Carried 5 -- 0.
Roll call vote taken on primary motion. Carried 4 — 1, Beaudet opposed.
Police Chief Swanson stated that he is concerned that the parking lot is monitored
during events to prevent illegal parking and maintain access for emergency
vehicles. Mr. Carpenter and Principal Koski reviewed the emergency plan and
security plan.

Mayor Beaudet, seconded by Councilmember McComber, moved to add to
condition 2 that the light fixtures will be subject to city staff review and approval
prior to installation. Carried 5 — 0.
Mayor Beaudet, seconded by Councilmember McComber, moved to add to
condition 5 that all lighting fixtures at the stadium entrance gate and bleachers
will comply with city standards. Carried 5 — 0.
Mayor Beaudet, seconded by Councilmember McComber, moved to delete
condition 16. Carried 5 -- 0.
Councilmember Byrne, seconded by Swenson, moved to amend the title and
language in the Resolution to reflect that the Planning Commission did not
recommend approval. Carried 5 ---- 0.
Councilmember Swenson, seconded by McComber, moved to adopt the
Resolution Establishing Findings of Fact and Resolution by the City Council that
the request by ISD 834 for a CUP and Variance to allow construction of a stadium
at the high school as amended and with the addition of language to be drafted by
the City Attorney concerning parking issues. Roll call vote taken. Carried 5 — 0.
Mayor Beaudet moved that the applicant be required to pay for any street sign
change necessary as a result of the CUP up to $1,500. Motion died for lack of a
second.
Councilmember Swenson, seconded by Byrne, moved to authorize the Mayor to
sign the Resolution. Carried 5 — 0.
C. Schedule Joint Worksession Between City Council, Planning Commission
and Parks Commission to Discuss Oakgreen Village and McKean Square
Applications
Mayor Beaudet, seconded by Councilmember McComber, moved to set a joint
worksession for April 1, 2002, 6:30 p.m. Carried 5 — 0.
D. Brown's Creek
Tim Freeman introduced himself as the new Brown's Creek Watershed District
liaison to the City of Oak Park Heights. Mr. Freeman also presented a copy of the
Second Generation Watershed Management Plan.

Second Generation Management Plan. Carried 5 .0.

Dear Mayor, Council, and City Administrator:
I am in receipt of correspondence from the attorneys for Independent School District
No. 834 relative to the issuance of the Conditional Use Perrnit and Variance Permit on the stadium
project. I have also had conversation with Mayor Beaudet who has expressed concerns relative to
the permit, as well. With regard to same, I attach a copy of the correspondence from the ISD 834
counsel and advise the Council that the Mayor's concern also deals (in part) with the same issue as
it affects Condition No. 15 of the permit. The correspondence from the School District counsel is,
of course, self-explanatory. The Mayor's concern was in the aspect of making sure that the permit
condition would require the construction of permanent restroorn facilities on the site.
Inasmuch as the issue is in conflict between the School District and Mayor
Beaudet's viewpoint as to what the Council voted on, I am returning this issue to the Council at this
time. I have reviewed the minutes of my partner, who was at the Council meeting when the matter
was passed, the minutes and comments of the City Planner and City Administrator, and will have
reviewed the tape before Tuesday night's meeting to assure myself that the provisions of Condition
No. 15 as we have drafted them are accurate. If I feel that they are inaccurate, I will certainly advise

All uses shall be subject to the following conditions and/or restrictions imposed by the City Council of the
City of Oak Park Heights.
1. This Third Amendment is granted to the Conditional use Permit as issued to allow the construction of a
High School Stadium including 90 foot high light poles with fixtures at other than a 90 degree cutoff, and a
variance to allow the two bleacher structures to exceed the building height standards for accessory buildings
Bleacher Height shall be 24 feet 8.5 inches on the East side and 43 feet 8 inches on the West side (not including

ADDITIONAL RESTRICTIONS AND PROVISIONS.
The provisions following additional restrictions and rovisions being part of the Third Amendment to Conditional Use
Permit and Variance to be issued herein shall be:.
1. No activity at the stadium shall be illuminated with the outdoor lighting system after 11:00 PM or at any
time on Sundays.
2. When constructed, the outdoor lighting system shall be tested to assure compliance with the lighting
requirements founds in Section 401.15.B.7(d) and (e) of the Zoning Ordinance. Meter readings shall be
provided to the City in compliance with methods of measuring light intensity as found in the Zoning Ordinance. The light fixtures shall be subject to City staff review and approval prior t o and after
installation to assure compliance with the Zoning Ordinance and the conditional use permit.
3. Th e CUP will be granted to allow the stadium lighting to be constructed and operating within two years
of the time of initial completion of the stadium complex. If the lighting is not erected within this period,
its subsequent construction will require application for necessary permits and approval of the City
Council.
4. All events held at the stadium shall comply. with State MPCA standards applicable to sound. The City
shall require limitations on use of loud speakers if noise levels are found to exceed State MPCA
standards,. Upon installation of' the sound system, meter- readings shall be submitted to the City
demonstrating compliance with MPCA standards, subject to City staff review and approval.
5. A lighting plan shall be provided by the District indicating provisions for lighting the area between the
parking lots to the entrance gates and bleachers. The plan shall be subject to review and approval of the
City Council, City Engineer, and staff. All light fixtures for the stadium entrance gate and bleachers
shall be subject to City staff review and approval prior to and after installation to assure compliance with
the Zoning Ordinance and the conditional use permit.

7. The District has established an Emergency Evacuation Plan for the stadium, subject to review and
approval of the City Administrator with consultation of the Police Chief and City Engineer. A copy of

the p lan shall be placed on file with the Police Department of the City of Oak Park Heights.
8. The District shall provide plans for securing satellite toilet facilities to the ground, subject to review and
approval of the Building Official.
9. Any plans for signage shall comply with Section 401.15.G of . the Zoning Ordinance and be subject to
City review and approval.
10. Any plans to replace the existing score board shall be submitted to the City for review and approval.
Any plans to erect a new score board shall require a new application.
11. All landscape and transplanting plans shall be subject to review and approval of the City Arborist..
12. Drainage calculations for the proposed changes to the site shall be submitted to the City Engineer. All
grading and drainage plans shall be. subject to the review and approval of the City Engineer and the
Valley Branch Watershed District.
13. The District has provided material and color samples of the bleachers and press box. The Planning
Commission has recommended bleacher colors in red, black, or silver with complementary colors for the .
press box as presented by the District.
14. The District has provided a Parking and Traffic Management Plan for event parking, detailing when it
will be put into effect, and how it will be implemented, subject to . review and approval of the City
Administrator, with consultation, of the Police Chief and City Engineer. Parking facilities providing for
1200 to 1500 parking spaces will be provided for, especially as needed for highly attended stadium
events. The City reserves the right to readdress the parking and traffic management plan andlor the on
and off -site parking requirements in such a manner that will promote the public health, safety and
welfare of the community. In its review, the City may require the District to add additional on -site
parking to accommodate highly attended events.
15. This approval does not include the future concession/ticket and rest room facility. Detailed plans would
need to 'be submitted for amended conditional use permit approval at the time of proposed construction.
The District shall abide by State laws in providing necessary rest room facilities, subject to future review
by the City Council.

This letter is simply to express a concern with respect to the text of ?aragraph 15 of the
Third Amendment to Conditional Use Po:Emit and Variance (the "CLTP") in connection with the
above mattez. As you are probably aware, we received a draft of the CM) either late yesterday or
this morning. Unfortunately, T have not been available until late today to review this matter,
The last sentence in Paragraph 15 was added to address issues with respect to the debate
over the possible requirement that the District either furnish permanetit rest room facilities, or
make zest roams in all or a portion of the existing school building available for fan use during
various stadium events. My notes and =collection indicate that City staff had understood that the
District was obligated by the State building code to mike the school building available for such
use in the event permanent stadium rest roams were not to be constructed. Our office shared a
contrary interpretation of the State building cede on. this issue. Tn an effort to avoid any further
delays, including the possible need for a subsequent City Council hearing, the proposal was
made to simply require the District to comply with the State buiid±ng code. As indicated during
the Council meeting, it would certainly be the intent of the District to comply with the code--
whatever these requirements might be. It is my understanding that the Council vote on and
approved, this compromise solurion.
The current CUP language reads as follows: "Thy District shall abide by State laws in
providing necessary rest room facilities, subject to future review by the City Council." While 1'
assume that the intent of the proposed langtage is to conform to the City Council vote on this
issue, ! am concerned that it is susceptible to the following contrary interpretations:
1. By providing that the District shall abide by State laws "in providing necessary

Dear Anderson- Johnson:
Enclosed is the Valley Branch Watershed District (VBWD) permit for your project. Please note the
following conditions imposed by the Managers, which are also listed on the back of the permit.
1. Drainage easements shall be granted to the City of Oak Park Heights which cover land
adjacent to the ponding/wetland area up to its 100 -year flood elevations and which cover all
ditches and storm sewers.
2. Access easements to these drainage easements shall also be granted to Oak Park Heights.
The City of Oak Park Heights shall be responsible for all maintenance within drainage
easements. The 100 -year flood elevation for the infiltration trenches and infiltration basin
on the site are Elevation 936.0 feet and Elevation 935.3 feet, respectively.
3. The overflow elevation from the upstream infiltration trench to the downstream infiltration
trench shall be re- evaluated so that the runoff does not spill to existing "CB2" instead of
draining to the proposed infiltration basin.
4. The VBWD Engineer andlor Inspector shall be notified at least three days prior to
commencement of work.
5. Erosion controls shall be installed prior to the commencement of grading operations and be
maintained throughout the construction period until turf is established. Additional erosion
controls may be required, as directed by the District Inspector or District Engineer.
6. All disturbed areas shall be vegetated within 14 days of final grading.
7. This permit is not transferable.
8. The required drainage easements and access easements shall be recorded with the
Washington County Recorder's Office.
9. This permit is subject to obtaining all other permits required by governmental agencies
having jurisdiction (including a NPDES permit).
10. The applicant is responsible for removal of all erosion control measures including silt fence
and hay bales upon establishment of permanent vegetation at the project site as determined
by the VBWD Engineer andlor Inspector.

Permission is granted to do the work proposed in accordance with the Rules and Regulations and Water Management
Plan of the District; subject to the following provisions:
1. Drainage easements shall be granted to the City of Oak Park Heights which cover land
adjacent to the ponding/wetland area up to its loo -year flood elevations and which cover all
ditches and storm sewers.
2. Access easeme.-r,-LF, tc these drainage easements shall also be granted to Oak Park Heights.
The City of Oak Park Heights hail be responsible for all maintenance within drainage
easements. The 100-year flood elevation for the infiltration trenches and infiltration basin
on the site are Elevation 936.0 feet and Elevation 935.3 feet, respectively. . . •'•
3. The overflow elevation from the upstream infiltration trench to the downstream infiltration
trench shall be re-evaluated so that the runoff does not spill to existing "CB2" instead of
draining to the proposed infiltration basin.
4. The VBWD Engineer and/or Inspector shall be notified at least three days prior to
- commencement of work.

maintained throughout the construction period until turf is established. Additional erosion
controls may be required, as directed by the District Inspector or District Engineer.
6. All disturbed areas shall be vegetated within 14 days of final grading.
7. This permit is not transferable.
S. The required drainage easements and access easements shall be recorded with the
Washington. County Recorder's Office. •
9. This permit is subject to obtaining all other permits required by governmental agencies
having jurisdiction (including a NPDES permit).
10. The applicant is responsible for removal of all erosion control measures including silt fence
and hay bales upon establishment of permanent vegetation at the project site as deteriniued
by the VBWD Engineer and/or Inspector.
