Re: Stillwater Area High School
Violation of Conditional Use Permit
1 have been directed by the Oak Park Heights City Council
to provide you formal written notice that Independent School
District #834 is in violation of the Conditional Use Permit as
originally issued December 10, 1999 and as recently modified by the
Oak Park Heights City Council on April 28, 1999 as it affects
parking lot configuration and compliance issues with the Stillwater
Area High School.
1 trust that you are aware that the Oak Park Heights
Chief of Police has been diligently working with your former
principal as well as ocher staff at the high school to bring that
facility back in compliance with the original Conditional Use
Permit. To date, he has not been successful in doing so and the
City Council does not intend to allow the parking noncompliance
circumstance to continue into this fall's school term. For your
reference, 1 am attaching a copy of a memo I ' received from Chief
Swanson as prepared by his officer, Joe Croft, detailing the
outstanding parking noncompliance issues as it affects the original
Conditional Use Permit.
The City of Oak Park Heights would have preferred to have
compliance with its Conditional Use Permit by Independent School
District #834 as it affects this facility; unfortunately, to date
no action has been taken to assure that compliance.

Therefore, 1 am herewith notifying you that prior to
sanctions being imposed by the City Council with regard to the
violation of the Conditional Use Permit and its tears you will be
given an opportunity to be heard before the City Council of the
City of Oak Park Heights at its regularly convened meeting on
Tuesday, August 10, 1399 to show cause, if any you have, why the
Conditional Use Permit previously issued to Independent School
District #834 in this matter should not be revoked, modified or
otherwise sanctions imposed for noncompliance. Please be advised
that the City Council reserves the right to impose civil sanctions
under Section 20B.040 of its City Ordinances providing that in the
event the Council determines that a violation of the ordinance has
occurred, the City Council may revoke the license or permit or
suspend the license for a period of up to 60 days and /or impose a
civil penalty and fine up to $2,000.00 for such violation or any
combination of the two.
You may feel free to direct issues with regard to
bringing the property into compliance directly to Chief Lindy
Swanson of the Oak Park Heights Police Department and further
direct any questions you have with regard to your appearance at the
August 10, 1999 hearing before the oak Park Heights City Council to
City Administrator Thomas Melena.
