The purpose of this ordinance is to define and regulate Home Occupations so that such occupations are not likely to cause nuisance or hazard to the neighborhood. This ordinance is not intended to limit or discourage Home Occupations except as they are likely to infringe upon the rights of others. 401A.02 Allowed Uses. All types of Home Occupations are allowed except those restricted to commercial or business zoning districts within the City as provided in Section 401.09, 401. 10, 401 .11 and 401 . 12 of the Zoning Ordinance of the City of Oak Park Heights. Examples of occupation to be allowed as Home Occupations within the City of Oak Park Heights are those of art studio, dressmaking, special offices of clergymen , architect offices , engineer offices , - accountant offices, attorney offices, real estate agent appraiser offices , day care or group foster home or other similar uses which have no storage or merchandise, are service orientated, have no retail sales of goods on the premises, and do not generate vehicular traffic in excess of an amount normally experienced in residential districts. 401A.03 Prohibited Activities. The following restrictions shall apply to all Home Occupations within the City of Oak Park Heights. a. Home Occupation shall be carried on only by the members of the family residing within the dwelling unit. b. There shall be no exterior storage of equipment or materials used in the Home Occupation. c. There shall be no visual evidence of the Home Occupation outside of the principal or accessory structure in which it is located. d. Objectionable noise , vibration, smoke, dust, electrical disturbances, heat, glare or hazardous or toxic material shall not be produced, stored or kept upon the premises. Any waste disposed of in the sewer system shall not create or cause a greater volume than that which is normally generated by a single-family residential dwelling. '`4 160 410 . . ______ • w . e. The fee owner of a . residential ntial dwell ' ing in which a Home Occupation is proposed to be conducted shall be required to obtain a • Conditional Use Permit from the City of Oak Park Heights before engaging in any such occupation or before allowing such occupation to take place upon the premises. Conditional Use Permit shall be applied for in the manner set forth within Section 401 . 16 of the Zoning Ordinance of the City of Oak Park Heights. Conditional Use Permits for Home Occupations granted by the City of Oak Park Heights shall be reviewed annually by the City Council, at which time the applicant's compliance shall be reviewed and modifications of any condition set forth within the Conditional Use Permit may be made by the City Council. 161 s ` y ' t s • • 401A. 06 Enforcement, Suspension/Revocation, Abandonment and/or Discontinuation of Home Occupation. The Zoning Administrator and/or the City Council of the City of Oak Park Heights may from time to time request of any applicant and/or any person conducting a Home Occupation, verification that the Home Occupation is being conducted in a manner consistent with this Ordinance. The City Council may suspend or revoke any Conditional Use Permit or Certificate of Compliance for violation of any provision or condition of this Ordinance. Suspension and/or revocation of the Certificate of Compliance or Conditional Use Permit for Home Occupation shall be preceded by written notice to the applicant/fee owner providing an opportunity to be heard before the City Council at a special or regular meeting thereof. Notice shall be given at least eight 18) days in advance of the time and the place of hearing which shall also be specified therein and shall also state the nature of the violation (s) alleged. The City Council may without any advance notice , temporarily suspend any Conditional Use Permit pending the hearing on revocation or suspension for a period not to exceed thirty (30) days. • 401A.07 Effective Date. This Ordinance shall take effect and be in full force from and after its passage and publication according to law. Health Club: A facility which provides athletic activities such as tennis, handball, racquetball, track, basketball, exercise devices, etc. and such incidental services as whirlpool, sauna or massage s-. ' - - ••- -- --: - - - Home Occupation: Any occupation or profession engaged in by the occupant of a residential dwelling unit, which is clearly incidental and secondary to the residential use of the premises and does not change the character of said premises. Hotel: Any building or portion thereof occupied as the more or less temporary abiding place of individuals and containing six (6) or more guest rooms, used, designated, or intended to be used, let or hired out to be occupied, or which are i occupied by six (6) or more individuals for compensation, whether the compensation be paid directly or indirectly. Housing Shelter-Temporary Housing: A facility operated by the public or a non- profit charitable group or institution which provides one or more transient/homeless persons with lodging and meals for short periods of time in a place other than a persons own home. ■ Interim Use: A temporary use of property until a particular date, until the ' I; occurrence of a particular event, or until zoning regulations no longer allow it. t! Junk Yard: An open area where waste, used, or second hand materials are bought, sold, exchanged, stored, baled, packed, disassembled or handled; r including but not limited to, scrap iron and other materials, paper rags, rubber, tires, I. lumber, and bottles. Sexually oriented use-accessory activities shall be prohibited at any public show, movie, caravan, circus, carnival, theatrical or other performance or exhibition presented to the general public where minors are admitted. 1 401.15.M. Home Occupations. 1. Purpose. The purpose of this Section is to maintain the character and integrity of residential areas and to provide a means through the establishment of specific standards and procedures by which home occupations can be conducted in residential neighborhoods without jeopardizing the health, safety and general welfare.-of the surrounding neighborhood. In addition, this Section is intended to provide a mechanism enabling the distinction between permitted home occupations and special or customarily "more sensitive" home occupations, so that permitted home occupations may be allowed through an administrative process rather than a legislative hearing process. 2. Procedures and Permits. a. Permitted Home Occupation. Any permitted home occupation as defined in this Ordinance, and subject to the performance standards of this Section, may be conducted solely within a single family detached dwelling (excluding attached garage space and/or any accessory structures). The permitted home occupation 1 shall require a "permitted home occupation permit". Such permits shall be issued l subject to the conditions of this Section, other applicable City Ordinances and State law. This permit may be issued by the Zoning Administrator based upon proof of compliance with the provisions of this Section. Application for the "permitted home occupation permit" shall be accompanied by a fee as adopted by the City Council. If the Zoning Administrator denies a permitted home occupation permit to an 1 applicant, the applicant may appeal the decision to the City Council. The permit shall remain in force and effect until such time as there has been a change in 1, conditions or until such time as the provisions of this Section have been breached. An annual fee, as set by the City Council, will be charged to the applicant. At such time as the City has reason to believe that either event has taken place, a public 1 hearing shall be held, and the City Council shall make a final decision on whether or not the permit holder is entitled to the permit. b. Special Home Occupation. Any home occupation which does not meet the specific requirements for a permitted home occupation as defined in this Section shall require a "special home occupation permit" which shall be applied for j reviewed and disposed on in accordance with the procedural provisions of a conditional use permit found in Section 401.03 of this Ordinance. 15-65 I • • I • c. Declaration of Conditions. The City Council may impose such conditions on the granting of a special home occupation permit as may be necessary to carry out the purpose and provisions of this Section. d. Transferability.. Permits shall not run with the land and shall not be transferable. r e. Lapse of Special Home Occupation Permit by Non-Use. Whenever within one (1) year after granting a permit the use as permitted by the permit shall not have been initiated, then such permit shall become null and void unless a petition for extension of time in which to complete the work has been granted by the City Council. Such extension shall be requested in writing and filed with the Zoning Administrator at least thirty (30) days before the expiration of the original permit. There shall be no charge for the filing of such petition. The request for extension shall state facts showing a good faith attempt to initiate the use. Such petition shall ii be presented to the City Council for a decision. f. Reconsideration. Whenever an application for a permit has been considered and l denied by the City Council, a similar application for a permit affecting substantially the same property shall not be considered again by the City Council for at least six (6) months from the date of its denial unless a decision to reconsider such matters is made by not less than four-fifths (4/5) vote of the City Council. 3. Requirement-General Provisions. All home occupations shall comply with the following general provisions and according to definition, the applicable requirement provisions. a. General Provisions. 1) No home occupation shall produce light, glare, noise, odor, vibration, smoke, dust, heat, or hazardous or toxic material shall not be produced, stored, or kept on the premises that will in any way have an objectionable effect upon adjacent or nearby property. 2) No equipment shall be used in the home occupation which will create electrical interference to surrounding properties. 3) Any home occupation shall be clearly incidental and secondary to the residential use of the premises, should not change the residential character thereof, and shall result in no incompatibility or disturbance to the surrounding residential uses. 15-66 I • • 4) No home occupation shall require internal or external alterations or involve construction features not customarily found in dwellings except where required to comply with local and state fire and police recommendations. 5) There shall be no exterior storage of equipment or materials used in the home occupation, except personal automobiles used in the home occupation may be parked on the site. 6) The home occupation shall meet all applicable fire and building codes. 7) There shall be no exterior display or exterior signs or interior display or interior signs which are visible from outside the dwelling. 8) All home occupations shall comply with the provisions of the City Code. 9) No home occupation shall be conducted between the hours of 10:00 pm. and 7:00 am. unless said occupation is contained entirely within the principal building, excluding attached garage space, and will not require any on-street parking facilities. 10) No commodity shall be sold on the premises. 11) Not over twenty-five (25) percent of any one story can be used for a home ly occupation. b. Requirements-Permitted Home Occupations. 1) No person other than those who customarily reside on the premises shall be employed. 2) The general public shall not come to the premises in question for purposes pertaining to the conduct of the home occupation. 3) All permitted home occupations shall be conducted entirely within the principal dwelling, excluding attached garage space, and may not be conducted in an accessory building. Home Occupation. c. Requirements-Special ation.P " 1) No person other than a resident shall conduct the home occupation. 15-67 I 2) Special home occupations shall be limited to only those activities of a non- residential nature which are specified as allowed by state statute or regulation such as day care group nursery or which comply with Sections a and b above, but are conducted entirely within the principal building or attached garage space. 3) Special home occupations may be allowed to accommodate their parking demand through utilization of on-street parking. In such cases where on- street parking facilities are necessary, however, the City Council shall maintain the right to establish the maximum number when and where changing conditions require additional review. - • 4. Non-Conforming Use. Existing home occupations lawfully existing on the date of this Ordinance may continue as non-conforming uses. They shall, however, be required to obtain permits for their continued operation. Any existing home occupation that is discontinued for a period of more than thirty (30) days, or is in violation of the Ordinance provisions under which it was initially established, shall be brought into conformity with the provisions of this Section. 5. Inspection. The City of Oak Park Heights hereby reserves the right upon issuing any home occupation permit to inspect the premises in which the occupation is being conducted to insure compliance with the provisions of this Section or any conditions additionally imposed. 401.15.N. Day Care Nursery Facilities. t 1. Purpose. The regulation of day care nursery facilities in these zoning regulations is to establish standards and procedures by which day care facilities can be conducted within the City without jeopardizing the health, safety and general welfare of the day care participants and/or the surrounding neighborhood. This Section establishes the City's minimum requirements for the establishment of a day care facility which are not defined as permitted uses by State Statute or which are operated in uses other than single family homes. Day care facilities other than those defined permitted uses by State Statutes which operate in a single family dwelling as an accessory use shall be subject to Section 1014 of this Ordinance and processed as a home occupation. 2. Application. Day care nursery facilities which are not already permitted uses in the zoning district shall be considered conditional uses within all the zoning districts and shall be subject to the regulations and requirements of Section 401.03 of this Ordinance. In addition to the City regulation, all day care facility operations shall comply with the minimum requirements of the Minnesota Department of Welfare regulations, as may be amended. f- I 15-68 I r Page 2 - City Co it Minutes 10/14/97 Councilmember Robert then asked Kaiser why the City has received only one bid for the five-year tree-pruning plan. Kaiser said that other companies have told him they cannot compete with St . Croix Tree ' s prices . Councilmember Robert requested that this issue be tabled until the October 28 meeting so that Administrator Robertson could solicit other quotes . The Police Department was also directed to make a note of the trees around the community that are in need of pruning and report back to the Council at the next meeting. Cindy Weckworth. Senior Environmental Health Specialist . Washington County - Overview of Groundwater - Councilmember Beaudet said that Ms . Weckworth was not able to be present today, but that she would return to present her report at the next Council meeting on October 28 . Petition from Valley View Garden Homes Association - Doug Bergmann, 14913 57th Street North and president of the association, was present to bring some issues before the Council . The first three issues involved water drainage problems . Bergmann outlined the concerns of the association: raising up some storm sewers and putting grates on them, the maintenance of a rock bed in an overflow parking lot, and the sod problems after a heavy rain. Bergmann also requested that a vacant lot be mowed and that rubble be removed from another empty lot . City Engineer Anderlik said that he would need to go out to the site before he would be able to make any recommendations . Council directed Anderlik to have a report ready at the next Council meeting. Council then asked Jack Krongard, the developer, for his input on the issues. Krongard noted that there have been some problems in the past but that he has spent some of his own money to fix problems that he did not cause. Krongard said that he is willing to install new storm sewer grates free of charge if that would solve the drainage problem. Krongard then said that he would mow the vacant lot . He also said that the rubble would be removed because he would be using it in the construction of a berm, which he expected to start work on within the week. There were some other residents of the association that shared concerns with the Council . Clyde Theets, 14935 57th Street North, said that he would like a street sign to designate his road between 57th and 58th Streets . Council directed staff to order a half-and-half sign for the street indicating which direction is 57th Street and which direction is 58th Street . William 'Caine . Objection to the Granting of Mary Stenfors ' Special Home Occupation License - Kaine appeared before the Council with a petition from some of the neighbors adjacent to Mary Stenfors, objecting to the Home Occupation Permit that was granted to Stenfors. He said he felt that the Council acted covertly when they reconsidered the permit application without another public notice to the neighbors . Page 3 - City C it Minutes 10/14/97 City Attorney Vierling told Kaine that the procedural action that the Council took is perfectly legal and appropriate. Kaine then indicated his displeasure with the Council because he had been present at the initial public hearing to oppose the permit, yet the Council ultimately granted Stenfors the permit . There was some discussion about the conditions P laced on the permit and the fact that the Council reserves the right to revoke the permit at any time should there be violations of the conditions . Vierling noted that the permit is subject to annual review. Councilmember Robert asked Vierling if people could make anonymous complaints. Vierling noted that any complaint could only remain anonymous until a decision was made whether or not to charge someone . Once that decision was made, either to charge, or, to not charge someone with a crime, then the complainant ' s name would become public. Department Reports: Police - Chief Swanson acknowledged the receipt of a $50 . 00 donation from Wal-Mart . He said the Police Department worked with Wal-Mart in a child fingerprinting project and that the $50 . 00 was to be used for future materials . Swanson then requested Council authorization to proceed with drafting an updated dog ordinance to address problems with potentially dangerous dogs . Councilmember Robert, seconded by Swenson, moved to set a public hearing for Tuesday, October 28 at 7 :30 p.m. to discuss a new dog ordinance . Carried 5-0 . Chief Swanson requested that the City consider establishing a on- street parking ban in the winter months to help with the street plowing. Councilmember Turnquist, seconded by Schaaf, moved to set a public hearing for Tuesday, October 28 at 7 :30 p.m. to discuss an ordinance establishing possible seasonal parking restrictions. Carried 5-0 . Parks -Councilmember Robert asked if the street lights at the MN/DOT bridge area will remain lighted, because several of them are burned out . Administrator Robertson said that the area should remain lighted in order to deter vandalism, but they do want to block off some of the streets that are not needed for access . Police Chief Swanson said that if the City wants Valley View Park to be plowed this winter, they will have to remove the posts which lock the gates . In that case, the park will have open access throughout the winter. Councilmember Robert said that issue would be ut on the Parks Commission agenda for the meeting P g on October 21 . There were several changes : (1) Extension of the development review period from 60 to 120 days. Council agreed with this change . (2) The addition of lighting requirements to the ordinance. (3) Requirement for driveways to be made of bituminous material . (4) Boat and Recreational Vehicle setback requirements . There was discussion about the lighting requirements . City Attorney Vierling said that any plan approved before this point will be grandfathered into the new ordinance. Council looked over the study done regarding lighting violations and directed staff to prepare findings to be distributed to City businesses on how they could come into compliance with the City lighting ordinance in an inexpensive manner. There was considerable discussion about the requirement to pave driveways and parking pads. Staff indicated that this was suggested for aesthetic and practical reasons . Hotel: Any building or portion thereof occupied as the more or less temporary abiding place of individuals and containing six (6) or more guest rooms, used, designated, or intended to be used, let or hired out to be occupied, or which are occupied by six (6) or more individuals for compensation, whether the compensation be paid directly or indirectly. Housing Shelter-Temporary Housing: A facility operated by the public or a non- profit charitable group or institution which provides one or more transient/homeless ' persons with lodging and meals for short periods of time in a place other than a persons own home. I Interim Use: A temporary use of property until a particular date, until the occurrence of a particular event, or until zoning regulations no longer allow it. u Junk Yard: An open area where waste, used, or second hand materials are bought, sold, exchanged, stored, baled, packed, disassembled or handled; including but not limited to, scrap iron and other materials, paper rags, rubber, tires, lumber, and bottles. A junk yard includes an auto wrecking yard, but does not include uses established entirely within closed buildings nor sanitary land fills. i Kennel:Any lot, premises, dwelling or dwelling unit in which three (3) or more dogs over the age of six months are kept, harbored, owned or otherwise possessed, either on a commercial basis or scale for boarding or breeding, or on a private basis for personal use, enjoyment or profit. Land Reclamation: The process of the re-establishment of acceptable topography (i.e. slopes), vegetative cover, soil stability and the establishment of safe conditions appropriate to the subsequent use of the land. 02-14 • S r• c. Sexually oriented use-accessory activities shall be prohibited at any public show, movie, caravan, circus, carnival, theatrical or other performance or exhibition presented to the general public where minors are admitted. 1 401.15.M. Home Occupations. 1. Purpose. The purpose of this Section is to maintain the character and integrity of residential areas and to provide a means through the establishment of specific standards and procedures by which home occupations can be conducted in residential neighborhoods without jeopardizing the health, safety and general welfare,::-of the surrounding neighborhood. In addition, this Section is intended to provide a mechanism enabling the distinction between permitted home occupations and special or customarily "more sensitive" home occupations, so that permitted home occupations may be allowed 1 through an administrative process rather than a legislative hearing process. 2. Any permitted home occupation as defined in this j Ordinance, and subject to the performance standards of this Section, may be f conducted solely within a single family detached dwelling (excluding attached garage space and/or any accessory structures). Such permits shall be issued I subject to the conditions of this Section, other applicable City Ordinances and State law. General Provisions. 1) No 0 h me occupation shall produce light, glare, noise, odor, vibration, smoke, dust, heat, or hazardous or toxic material shall not be produced, stored, or kept on the premises that will in any way have an objectionable effect upon adjacent or nearby property. 2) No equipment shall be used in the home occupation which will create electrical interference to surrounding properties. • [ 3) Any home occupation shall be clearly incidental and secondary to the residential use of the premises, should not change the residential character thereof, and shall result in no incompatibility or disturbance to the surrounding residential uses. F- L 15-66 I • • p 4) No home occupation shall require internal or external alterations or involve construction features not customarily found in dwellings except where required to comply with local and state fire and police recommendations. 5) There shall be no exterior storage of equipment or materials used in the home occupation, except personal automobiles used in the home occupation may be parked on the site. 6) The home occupation shall meet all applicable fire and building codes. 7) There shall be no exterior display or exterior signs or interior display or interior signs which are visible from outside the dwelling. 8) All home occupations shall comply with the provisions of the City Code. 9) No home occupation shall be conducted between the hours of 10:00 pm. and 7:00 am. unless said occupation is contained entirely within the principal building, excluding attached garage space, and will not require any on-street parking facilities. 10) No commodity shall be sold on the premises. 11) Not over twenty-five (25) percent of any one story can be used for a home 1 occupation. b. Requirements-Permitted Home Occupations. 1) No person other than those who customarily reside on the premises shall be employed. 2) The general public shall not come to the premises in question for purposes pertaining to the conduct of the home occupation. 3) All permitted home occupations shall be conducted entirely within the principal dwelling, excluding attached garage space, and may not be conducted in an accessory building. c. Requirements-Special Home Occupation. " 1) No person other than a resident shall conduct the home occupation. 15-67 S • 2) Special home occupations shall be limited to only those activities of a non- residential nature which are specified as allowed by state statute or regulation such as day care group nursery or which comply with Sections a and b above, but are conducted entirely within the principal building or attached garage space. 3) Special home occupations may be allowed to accommodate their parking demand through utilization of on-street parking. In such cases where on- street parking facilities are necessary, however, the City Council shall maintain the right to establish the maximum number when and where changing conditions require additional review. 4. Non-Conforming Use. Existing home occupations lawfully existing on the date of this Ordinance may continue as non-conforming uses. They shall, however, be required to obtain permits for their continued operation. Any existing home occupation that is discontinued for a period of more than thirty (30) days, or is in violation of the Ordinance provisions under which it was initially established, shall be brought into conformity with the provisions of this Section. 5. Inspection. The City of Oak Park Heights hereby reserves the right upon issuing any • home occupation permit to inspect the premises in which the occupation is being conducted to insure compliance with the provisions of this Section or any conditions additionally imposed. 401.15.N. Day Care Nursery Facilities. 1. Purpose. The regulation of day care nursery facilities in these zoning regulations is to establish standards and procedures by which day care facilities can be conducted within the City without jeopardizing the health, safety and general welfare of the day care participants and/or the surrounding neighborhood. This Section establishes the City's minimum requirements for the establishment of a day care facility which are not defined as permitted uses by State Statute or which are operated in uses other than single family homes. Day care facilities other than those defined permitted uses by State Statutes which operate in a single family dwelling as an accessory use shall be subject to Section 1014 of this Ordinance and processed as a home occupation. 2. Application. Day care nursery facilities which are not already permitted uses in the {tk zoning district shall be considered conditional uses within all the zoning districts and shall be subject to the regulations and requirements of Section 401.03 of this Ordinance. In addition to the City regulation, all day care facility operations shall comply with the minimum requirements of the Minnesota Department of Welfare regulations, as may be amended. I have enclosed (Enclosure 12B) the definition and language governing home occupation which is found in our Zoning Ordinance . Council had reviewed this language in 1996 when it was in the process of updating the City' s Zoning Ordinance . I have also enclosed (Enclosure 12C) a list of those residents who received a letter from the Building Inspector asking them to come into compliance with the Home Occupation requirements . I have underlined the names of those people who have subsequently filed an application for a Home Occupation license. The next step for those who have not applied would be to follow the same procedure as we do for any nuisance violation. We would have a police officer visit those properties which are not in compliance . The officer would let them know if they were not in compliance by a certain date they would receive a ticket . Home Occupation Letters - Councilmember Swenson noted he had received a complaint about the City requiring a home occupation permit for home businesses . Administrator Robertson said that Council was concerned that the City was not enforcing the ordinance that requires businesses operating out of the home apply for a Home Occupation Permit . Therefore, the City sent letters to individuals identified as having a home occupation business . Robertson noted that the current fee for a Minor Home Occupation Permit is $25 . 00 and the current fee for a Major Home Occupation Permit is $100 . 00 . Robertson said that the current definition of a Major Home Occupation business is that it has retail traffic and/or outdoor storage. He indicated that both Minor and Major Home Occupation Permits can be renewed for $10 . 00 per year. After much discussion about possibly changing the definition and/or fees for home occupations, Council tabled any action. Cable - Councilmember Turnquist reported on the recent Cable Commission meeting. Middle St . Croix Water Management Organization - Administrator Robertson stated that he attended the recent MSCWMO meeting because citizen representative Barbara O'Neal was unable to attend. Robertson reported that the organization discussed a preliminary report prepared by SEH for a northern outlet for Perro Pond. The report estimates the total cost for the northern outlet to be between $800, 000 to $1, 000, 000 . The City' s portion of the cost would be $400, 000 to $500, 000 . Robertson indicated that Barb O'Neal has resigned from the MSCWMO. O 'Neal recommended that because of the potential cost to the City of the Northern Outlet improvement that the City Council should appoint an elected official to the MSCWMO. The purpose of this ordinance is to define and regulate Home Occupations so that such occupations are not likely to cause nuisance or hazard to the neighborhood. This ordinance is not intended to limit or discourage Home Occupations except as they are likely to infringe upon the rights of others . 401A.02 Allowed Uses. All types of Home Occupations are allowed except those restricted to commercial or business zoning districts within the City as provided in Section 401 .09 , 401 .10 , 401 . 11 and 401 . 12 of the Zoning Ordinance of the City of Oak Park Heights. Examples of occupation to be allowed as Home Occupations within the City of Oak Park Heights are those of art studio, dressmaking, special offices of clergymen , architect offices , engineer offices , accountant offices, attorney offices, real estate agent appraiser offices, day care or group foster home or other similar uses which have no storage or merchandise, are service orientated, have no retail sales of goods on the premises, and do not generate vehicular traffic in excess of an amount normally experienced in residential districts. 401A.03 Prohibited Activities. The following restrictions shall apply to all Home Occupations within the City of Oak Park Heights. a. Home Occupation shall be carried on only by the members of the family residing within the dwelling unit. b. There shall be no exterior storage of equipment or materials used in the Home Occupation. c. There shall be no visual evidence of the Home Occupation outside of the principal or accessory structure in which it is located. d. Objectionable noise , vibration, smoke, dust, electrical disturbances, heat, glare or hazardous or toxic material shall not be produced, stored or kept upon the premises. Any waste disposed of in the sewer system shall not create or cause a greater volume than that which is normally generated by a single-family residential dwelling. 164 e. There shall be no on-site advertising allowed. f. The Home Occupation shall not cause internal or external alterations of substance to the dwelling unit nor shall it involve construction features not customarily found in single-family residential dwellings. g. There shall be no retail sales allowed on the premises. 401A. 04 Parking. No Home occupation shall be permitted which generates more than two cars on-street parking. Off- street parking spaces must be in a garage, garage apron or driveway. There shall be no more than four off- street parking spaces. 401A. 05 Conditional Use Permit Required. The fee owner of a residential dwelling in which a Home Occupation is proposed to be conducted shall be required to obtain a Conditional Use Permit from the City of Oak Park Heights before engaging in any such occupation or before allowing such occupation to take place upon the premises. Conditional Use Permit shall be applied for in the manner set forth within Section 401 . 16 of the Zoning Ordinance of the City of Oak Park Heights. Conditional Use Permits for Home Occupations granted by the City of Oak Park Heights shall be reviewed annually by the City Council, at which time the applicant' s compliance shall be reviewed and modifications of any condition set forth within the Conditional Use Permit may be made by the City Council. 401A. 06 Enforcement, Suspension/Revocation, Abandonment and/or Discontinuation of Home Occupation. The Zoning Administrator and/or the City Council of the City of Oak Park Heights may from time to time request of any applicant and/or any person conducting a Home Occupation, verification that the Home Occupation is being conducted in a manner consistent with this Ordinance. The City Council may suspend or revoke any Conditional Use Permit or Certificate of Compliance for violation of any provision or condition of this Ordinance. Suspension and/or revocation of the Certificate of Compliance or Conditional Use Permit for Home Occupation shall be preceded by written notice to the applicant/fee owner providing an opportunity to be heard before the City Council at a special or regular meeting thereof. Notice shall be given at least eight (8) days in advance of the time and the place of hearing which shall also be specified therein and shall also state the nature of the violation(s) alleged. The 165 • City Council may without any advance notice, temporarily suspend any Conditional Use Permit pending the hearing on revocation or suspension for a period not to exceed thirty (30) days. 7 Effective ec tive Date. St. Croix Valley Home Delivery,a sole proprietorship,has been by tbetlf Minneapolis since 1988. The city requires such a license as it considers my base of operations to be Kemps/Marigold Foods. They provide most of the office support,such as direct billing and new customer information. We are also licensed separately by the Department of Agriculture as a business,a milk truck and to accept and redeem food stamps. We are also dues-paying members of The Association of Independent Dairy Distributors. • I do not accept deliveries to our home. The product I.deriver is picked up each day at Kemp& Truck parts for repairs and normal maintenance are sent to the Kemps garage, where the work is done. • All of my sales are at the homes_of the customers we serve. The_exceptionto this is our neighbors who sometimes ask for extra milk or cheese during the week between regular stops. • All billin g and collection of debts is done at the home of our customers. • Customers do not call t ace orders-the product is already on the truck. • Large orders, such as Snyders, are placed through Kemps and added to my regular order. • I do not advertise. Kemps has a listing in the White Pages for those people interested in getting on the route.
