Call to Order: Chair Eder called the meeting to order at 7:00 p.m. Present: Vice Chair Bye, Commissioners Johnson and Weyer, City Administrator Johnson, Public Works Director Kegley, Arborist Widin, Arborist-in-Training Lisa Danielson, and Commission Liaison McComber. Absent: None. II. Approval of Agenda: Chair Eder corrected the date at the top of the Agenda. Commissioner Weyer, seconded by Commissioner Bye, moved to approve the Agenda. Carried 4-0. III. Approve Parks Commission Minutes—Febru ry 23, 2015: Commissioner Weyer, seconded by Commissioner Johnson, moved to approve the Minutes. Carried 4-0. IV. Department/Commission Liaison Reports: A. Arborist: Arborist Widin reported that there were a few outstanding items from the winter boulevard tree pruning that were being dealt with. She stated she was working with Lisa Danielson on training, and Lisa would be doing a presentation on the Linear Park tree planting plan. She reminded residents that they should be careful with pruning Oak trees, stating they should not prune those trees between April 1 and October 1. B. Public Works Director: Public Works Director Kegley reported that the City was accepting applications for the park attendant position, and he wanted those positions filled by the end of April for work starting mid-May. He also reported that the 2015 park and trail map was being finalized. He reported that the Public Works staff was working on building trail map kiosks. C. Other/Commission Liaison Reports: Commission Liaison McComber reported that Spring Clean-up day was set for Saturday, May 2 at the Andersen Corporation parking lot. Vice Chair Bye, seconded by Commissioner Weyer, moved to accept the Department/ Commission Liaison Reports. Carried 4-0. V. Visitors/Public Comment: None VT. Public Hearings: None VII. New Business: A. Linear Park Planting Plan—2015: Arborist-in-Training Danielson presented a PowerPoint presentation on the plan. Chair Eder, seconded by Vice Chair Bye, moved to approve the recommendation to grant Instant Green Tree Planting the bid for the Linear Park planting in 2015. Carried 4-0. Chair Eder stated that the walkthrough usually takes about one a half to two hours beginning at Cover Park and moving through to end at Autumn Hills Park. Chair Eder, seconded by Commissioner Johnson, moved to set Saturday, April 11, 2015 at 2:00 p.m. as initial parks walkthrough with a backup date of Saturday, April 18 if necessary due to inclement weather or other scheduling conflicts. Carried 4-0. VIII. Old Business: A. Oak Park Crossing Park Plan: Chair Eder reported that the Parks Commission held two open houses and great feedback was received and they would be reading through feedback cards. He suggested residents who were not able to attend the open houses stop by City Hall to view boards and provide feedback. IX: Informational: A. Does the Park commission wish to consider charging non-residents a fee to reserve park shelters? 2. Does the Park commission wish to recommend a policy or rule for "No Smoking" under park shelters? COVER PARK • General maintenance items: • Ground wire hanging from hockey rink light pole/service • Tree branches on south side of building touching electrical service line. • 2014 street reconstruction work disrupted a portion of the rock wall lining the Cover Park garden. Resident Pam Patrick requested that P.W. staff rebuild the wall back to the condition before construction. o Pam gave the commission a brief history of Cover garden - flowers in the garden were transplanted in 1996 from homes taken by MNDOT for the bridge project. At the time, the Council funded $15,000 for the garden project. Over nine years the garden committee re- paid $11,000 by sale of plants. Page 11 of 48 • Potentially extend the existing parking lot on the south side of the Cover Park shelter. Extending the lot could create parking spaces. • Remove the Xcel fence (or a portion of it) on the north side of Cover Park so patrons can pass between Cover Park and Oak Park Crossing Park. OAK PARK CROSSING • Commission discussed Oak Park Crossing sign placement locations—ideal location is just east of the lot entrance. • Add swings to playground area • Trail maintenance—consider crack sealing portions of the trail within Oak Park Crossing Park. • Install permanent signage Re: dog waste(currently signs are on temporary/movable post). VALLEY VIEW • Extend the concrete @ the shelter to the north. Extending the roof overhead is not necessary. • The Commission discussed the south parking lot—If the shelter is expanded, the lot will be necessary as parking along the "entrance road"may block emergency vehicle access. o If lot is not replaced—Commission recommends the drive lanes be widened to make room for parking. • Maintenance items: • Leaning grill • Attend to plantings near shelter(in rock garden) • Replace the Wood fence - o Consider replacing only sections adjacent to parking lot. It may not be necessary to replace the portions of fence that are deep within wooded areas, as these residents have the woods as a buffer from the park. BREKKE • Add a grill to open shelter area • Heavily used double grill at the main park pavilion has a hole rusted through—P.W. to repair. • Install hard surface(asphalt) trail to connect ball fields and upper playground equipment. 2 Page 12 of 48 • Easement trail fence (connecting 55h Street to Park)—plan for replacement. Re-pitch lower ball field ground behind backstop to repair drainage issue. Some equipment such as the lower ball field backstop, benches and trash receptacles lean because of water retention. SWAGER • Maintenance Items: o Maintain tennis court surface—cracks are beginning to appear. The tennis court in 4PH is an asphalt surface with • Add a horseshoe pit • Replace wood fencing along the south boarder of the park. • Plan for wood and metal play structure replacement—leave existing in until a suitable replacement is installed. • Plan for saving set replacement. • Discussion of potential to expand park to possible land locked parcel—Upon review, the land abutting Cover to the north is not land locked and has a house situated at the north end of the parcel. AUTUMN HILLS • PIan for Playground equipment replacement • Autumn Hills a potential location for splash pad discussion. • Potential band shell addition • Maintenance Items: o Repair rain gutters. Potentially run drains underground away from building to daylight downhill from shelter. o Cigarette butts littered around shelter. The desired sign location is actually Xcel Energy owned property; therefore the City will need to request permission from Xcel to place the sign. I am requesting the Park. Cominission provide direction to staff as to the location for sign placement so a formal request to Xcel Energy can he made. To the best of my knowledge there have not been any material issues with these placements and appear well received. Generally looking for additional direction to allow the 2015 placement. NOW,.THEREFORE,for the reasons set forth above,and in consideration of the mutual promises and agreements herein set forth, VENDOR and City agree as follows: 1. VENDOR shall instatl,maintain and service all vending equipment("Machines")and is limited to a single soda- vending machine only and at designated City Locations, Brekke Park and Autumn Hills Park,(See Exhibit A).At no time shall the Machines be deemed the possession of City;they are,and will remain,under the control of VENDOR.All equipment shall be maintained in good working condition. 2. City shall have the right to approve/disapprove of the specific placement of Machines at Locations in City sole discretion. During the term of this Agreement,VENDOR shall pay City Facility Rental Income(FRI)as follows: $0.00.There shall be no minimum revenues guaranteed by the City. 3. Water shall be vending choice in all machines and shall be kept stocked with appropriate product and in a volume reasonably similar to all other offerings.At all times,the machines shall be kept clean and in good appearance without any broken facing or graffiti,free of debris,dirt,etc.The machines shall not be internally lit if they directly face a residential area. 4. The VENDOR shall place a clearly marked label or sign on all machines that provides a phone number so that machine users are able to seek any applicable refunds directly from the VENDOR.The VENDOR is directly responsible for and shall appropriately manage any refunds requested by park patrons. 5. The VENDOR during the term of this Agreement,shall not be required to pay a commission to the City which is typically equal to a percentage of all gross revenues(less applicable State imposed sales tax and deposits) collected from the sale of beverages vended from the Machines. 6. The initial term of this Agreement shall be twelve(12)months commencing as of the date written above. Thereafter;the term may be extended for an additional twelve(12)month period at the sole discretion of the City conveyed to the Vendor by written notice.Either party may terminate this Agreement without penalty providing the other party with by thirty days written notice of such discontinuation. 7. The machines are anticipated to remain at their locations through the off-seasons. The Vendor shall however be obligated to remove the machines should the City request such removal. In some circumstances,these machines may not be accessible to the general public during periods in which park shelters may be closed. 8. VENDOR will provide City with a full accounting of all revenues received from Machines at City Locations. Page 21 of 48 9. City may elect to give VENDOR detailed notice of non-performance hereunder. Upon the receipt of such written notice,VENDOR shall have at least ten(10)days to remedy or cure the facts giving rise to such alleged non- performance hereunder. if VENDOR has not affected such a remedy or cure within the prescribed time period, City may terminate this Agreement if said non-performance is material in nature.Said termination shall be effective ten(10)days after City's issuance of written termination for cause, 12. Upon any form of contract termination, the VENDOR shall,at the Vendor's sole expense,remove all equipment and/or machines from the City's premises. 13. The VENDOR may not assign their responsibilities as outlined in the Agreement to a third-party without the City's written permission. 14. Except for willful or knowingly negligent acts on the part of the City,the City is not responsible for any damages to the VENDOR'S property.The VENDOR does hereby indemnify,will defend and holds harmless the City and its agents from any loss or liability sustained as a result of the use of the property by the VENDOR.The City makes no warranty or guaranty of suitability for the placement of any machines. Use of City locations is at the VENDOR'S own risk. 15. If any term or portion of this Agreement shall be deemed invalid or unenforceable,the remainder of this Agreement shall not be affected. No waiver by VENDOR of any breach by City hereof shall be construed as a waiver of any other breach.This contract is binding upon the heirs,successors and assigns of both parties.This contract shall be construed under the laws of the State of Minnesota.
