We have addressed your review comments (11-14-2014)within the attached plan set with the exception of three items-soil borings, compensatory storage, and an inspection and maintenance agreement. The soil borings are currently scheduled and we will pass on the results once they have been drilled and analyzed. It is my understanding based on a City staff meeting (December 8, 2014), that if MNDOT approved our drainage plan, the City of Oak Park Heights would be ok with vacating the existing drainage easement and therefore the compensatory storage requested by the MSCWMO would not be needed or required. We request that the MSCWMO and/or the City of Oak Park Heights provide a generic or previous project's inspection and maintenance agreement to review and use for the basis of our agreement. The permit holder must comply with all applicable laws and regulations,including Worker's Compensation laws. 2. If work to be done lies within a city or platted town,permission must also be obtained from such city or town. 3. Where work on or near the traveled roadway is necessary,proper traffic signs,channelizing devices,warning lights, and barricades shall be erected to protect traffic,employees,and pedestrians. All traffic control devices and methods shall conform to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts,Minnesota Manual on Uniform Traffic Control Devices(MMUTCD),Minnesota Standard Sign Manual,and the appropriate provisions of Standard Specification 1710. 4. Unless adequately protected by a traffic barrier,there shall be no work within the clear zone,nor shall pipe materials,equipment or other objects be stored within the clear zone as determined by the MnDOT and as defined by the latest edition of AASHTO's"Guide for Selecting Locations,and Designing Traffic Barriers". 5. Excavations must be cribbed when necessary,depending upon type of soil,in order to prevent cave-ins. All excavations,trenching and/or jacking and boring pits shall be shored or sloped in accordance with OSHA requirements. 6. No guys,stays,or any structures are to be attached to trees on trunk highway right of way. 7. No poles,anchors,anchor braces,or other construction shall be placed on the roadway shoulder or within the prescribed clear zone. 8. Installation of pipe under concrete or bituminous pavements shall be done by jacking or boring or other approved methods. 9. When open trenching or excavating in existing roadways,all subgrade,base,and surfacing materials shall be replaced with the same type,depth,and density of materials which were removed,unless approved by the Area Maintenance Engineer. 10. All work that involves trenching,backfill,or compaction must be done to MnDOT's Standard Specifications for Construction.Depending on the construction work to be performed,use of one or more of the following specifications may be needed:Excavation and Embankment 2105,Aggregate Base 2211,Aggregate Shouldering 2221,or Structural Excavation and Backfllis 2451,Subgrade Preparation 2112. Compaction methods must be approved in advance by the District Permit Office 11. If pavement or roadway is damaged,same shall be restored to a condition as good as or better than the original condition. 12. All pavements shall be replaced in accordance with State specifications. 13. If settlement occurs or excavation caves In so that replaced materials settle(bituminous mat or concrete base), same shall be restored to a condition as good as or better than the original condition, 14. No lugs shall be used on equipment traversing the road which will damage the road surface. 15. No driving onto highway from ditch or driving on shoulders will be permitted where damage will occur. 16. No foreign material such as dirt,gravel,or bituminous material shall be deposited or left on the road during any construction activities. 17. Roadside shall be cleaned to original status upon completion of work. 18. Underground construction must be so constructed as not to harm or unnecessarily destroy the root growth of specimen trees. 19. Cutting and trimming of trees within the right of way and removal of resulting stumps require prior approval of the Area Maintenance Engineer or his authorized representative. 20. If MnDOT shall make any improvements or changes upon,over,under,or along the trunk highway,then and in every case the applicant herein named shall after notice from MnDOT proceed to alter,change,vacate,or remove from trunk highway right of way said works necessary to conform with said changes without cost whatsoever to the State of Minnesota. 21. After work on a project is completed,the permit holder must notify the Area Maintenance Engineer or his authorized representative that such work has been completed and is ready for final inspection and acceptance by MnDOT. MnDOT Form 1723 Standard Conditions of Miscellaneous Work Permit(7-15-2013) Page 2 of 2 M-US-15-65666 C.S. 8214 T.H. 36 TIC Investments THIS PERMIT IS SUBJECT TO THE FOLLOWING CONDITIONS: The installation authorized in this permit will be inspected by Rod Clark, MN/DOT Roadway Regulation Inspector 651-234-7915. The applicant or its contractor will notify Mn/DOT's inspector at least two days prior to starting the installation. Any questions the applicant may have pertaining to Mn/DOT's storm water facilities shall be presented at this time. Mn/DOT's inspector will approve all highway materials prior to placement, and the total installation must meet with his/her satisfaction. Attached is a drainage map that satisfies the requirements for Mn/DOT storm water utility locates per Minnesota Statutes 216D and Minnesota Rules 7560.0250. By acceptance of a permit from Mn/DOT, the applicant agrees that it, and all of its agents or contractors, shall use Mn/DOT's drainage map to identify the location of Mn/DOT drainage facilities as satisfaction of the requirements of Minnesota Statutes Ch. 216D and Minnesota Rules 7650.0250 with respect to Mn/DOT's storm water drainage facilities. This permit authorizes the applicant to tap into an existing water main in TH 36 right of way, 80' west of Oxboro, in the city of Oak Park Heights as shown on applicant's plan sheet(s). Any lane closures shall be approved by this office at 651-234-7915, 24 hours prior to the lane closure. The hours of the lane closure shall be determined by this office. The applicant shall provide in-house inspection at all times while working on trunk highway right of way. The applicant shall furnish, install and maintain all required traffic control devices according to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts (see web page @ www.dot.state.mn.us/trafficeng/),while performing the construction authorized by this permit. Due to the Twin City rush hour restrictions, no work involving interference with or causing a distraction to traffic will be allowed from 6:00 AM to 9:00 AM. or from 3:00 PM to 6:00 PM. unless authorized by the MN/DOT Permit Office at 651-234-7915. If the temporary traffic control zone is to remain in one place for more than 3 days or involves a detour, road closure or a situation where the typical layouts do not apply, the applicant shall prepare a specific Traffic Control Plan for approval by Mn/DOT prior to start of any construction. Temporary lane restrictions will be permitted as detailed at the following link: http://www.dot.state.mn.us/metro/trafficena/laneclosure/index.html All persons while performing authorized work on Mn/DOT Right of Way shall be required to wear a Mn/DOT approved High Visibility Safety Vest and Soft Cap/Hard Hat. Any authorized night work requires all personnel to wear a Mn/DOT approved full night safety suit (pants and jacket). { M-US-15-65666 C.S. 8214 T.H. 36 TIC Investments It shall be the responsibility of the applicant to utilize the "Gopher State One Call" excavation notice system as required under Minnesota Statute Chapter 216D, 48 hours prior to performing any excavation (Phone 651-454-0002 Twin Cities Metro Area or Toll Free 1-800-252-1166). The Excavator shall mark proposed excavation with paint and flags or in lieu of flags stakes may be used. All flags and stakes shall display the name and phone number of the Excavator. All areas of proposed excavation shall be considered "practical"for the use of white markings, pursuant to Minnesota State Statute 216D.05 (2). The Excavator shall acquire a Positive Response confirmation from Mn/DOT for all proposed excavations when the Gopher State One Call has indicated Mn/DOT utilities may be affected. The Excavator may call Mn/DOT Electrical Services Section (ESS) Dispatch Locating to confirm the status of Utility infrastructure owned by Mn/DOT. Mn/DOT Electrical Services Section (ESS) Dispatch Locating can be contacted at the following phone numbers; (651) 366 -5750 or(651) 366-5751. The Excavator is required to comply with the provisions of Minnesota Statutes chapter 216D when performing Excavation as defined in Minnesota Statutes §216D.01 (subdivision 5), and will be responsible for damages to facilities in accordance with Minnesota Statutes §216D.06. No material shall be deposited on the traveled roadway. All areas disturbed by the applicant shall be restored with a minimum of 6" of topsoil (according to MnDOT Standard Specification 3877 Table 1 Common Topsoil Borrow), then sodded or seeded. Seed or sod should be the same as/or compatible with the existing turf cover. If the areas are to be seeded, a MnDOT seed mixture comparable to the existing turf along with Category 3 blanket with all natural netting and stitching shall be used according to MnDOT Specification 2575. When frozen conditions prevent the applicant from completing turf restoration the applicant must temporarily stabilize the disturbed area. Use seed mix 22-111 following the winter seeding method and type 1 mulch following the winter mulching method in the 2014 MnDOT Standard Specification for Construction section 2575. The applicant is responsible for competing final turf restoration prior to May 15 of the following spring. All areas disturbed during construction within State right-of-way shall be restored to original or better condition. The applicant shall perpetuate all existing drainage. The applicant shall relocate and reconstruct the in-place drainage ditch along the highway as necessitated by the construction authorized by this permit. The new ditch shall match the grades and contours of the in-place drainage ditch. The applicant is required to preserve all existing survey monuments. If Mn/DOT determines that monuments have been disturbed or destroyed during construction activities, the applicant shall M-US-15-65666 C.S. 8214 T.H. 36 TIC Investments accept full responsibility for all costs incurred in the re-establishment of the monuments. Connecting drains to highway drains. When the course of natural drainage of any land runs to a highway,the owner of the land shall have the right to enter upon the highway for the purpose of connecting a drain or ditch with any drain or ditch constructed along or across the highway,but before making the connections,shall first obtain a written permit for the connections from the road authority having jurisdiction. The connections shall be made in accordance with specifications set forth in the permits. The road authority shall have power to prescribe and enforce reasonable rules and regulations with reference to the connections. The highway shall be left in as good condition In every way as It was before the connection was made. Subd.3.Installing drain tile along or across highway. When the course of natural drainage of any land runs to a highway,the owner of the land who has been granted a permit as provided in subdivision 4 may install drain tile along or across the highway right-of-way along the general course of the natural drainageway,provided further that there will be no diversion of drainage waters away from the natural receiving drainageway immediately downstream from the highway. Any Installations shall be made in accordance with specifications set forth In the permit and any rules that apply to the installations. When any installation is made pursuant to this subdivision the highway shall be left in as good condition In every respect as it was before the installation was made. Subd.4.Conditions (a)A road authority may accept applications for permits for Installation of drain tile along or across the right-of-way under its Jurisdiction. The road authority may adopt reasonable rules for the Installations and may require a bond before granting any permit. Permits for installation along a highway right-of-way must ensure that the length of the installation is restricted to the minimum necessary to achieve the desired agricultural benefits. A permit must not allow open trenches to be left on the right-of-way after installation of the drain tile is completed. A road authority that grants a permit for drain tile Installation is not responsible for any damage to that installation resulting from the action of the authority or any other permittee utilizing the right-of- way. (b)A person who installs drain tile along or across a highway right-of-way without obtaining a permit as provided in this section is guilty of a misdemeanor. (c)The commissioner shall take no action under this section which will result in the loss of any federal aid for highway construction in the state. (d)For the purpose of this section,"highway"means any highway as defined in section 160.02 which is located outside the corporate limits of a home rule charter or statutory dty. SPECIFICATIONS AND PERMIT REQUIREMENTS • All construction details shall be entered on Form TP30795-02 or supplemental sheets as required. • Installations shall be in accordance with Specification 2502 of the Minnesota Standard Specifications for Construction. • Where work on or near the traveled roadway is necessary,proper signs,channelizing devices,warning lights,and barricades shall be erected to protect traffic,employees,and pedestrians.All traffic control devices and methods shall conform to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts,Minnesota Manual on Uniform Traffic Control Devices(MMUTCD),Minnesota Standard Sign Manual,and the appropriate provisions of Standard Specification 1710. • Allowable materials for longitudinal installations shall be: o Corrugated metal pipe(Std.Plate 3040) o Reinforced concrete pipe(std.Plate 3000) o Thermoplastic pipe(Spec.3245) • Connections of field tile to allowable longitudinal Installation shall be made a minimum of three feet beyond the highway right of way line using an inspection tee.(Std.Plate 3143) • All casings shall be jacked or bored. • AN system Installations shall be at a minimum of three feet below existing ground. • No installations will be permitted In the shoulder or inslope of the roadway. • The owner,his successor or assigns,shall maintain the installation in perpetuity. • If drainage work to be done lies within the limits of any city,village or watershed district,permission must be obtained from the local governing authority involved.If drainage work to be done involves county,Judicial,or group drainage systems,permission must also be obtained from the authority involved. • The applicant shall comply with all rules and regulations of the Minnesota Environmental Quality Board and any other affected governmental agencies. • The applicant shall furnish,install and maintain an approved culvert marker post at outlet of drainage tile. • The drainage work shall not interfere with any existing utility facilities on the trunk highway right-of-way. • Removal of trees or shrubs within the right of way requires prior approval of the Area Maintenance Engineer or his authorized representative. • No equipment will be permitted to operate on or across the roadway which will damage the roadway or shoulder surface. • The State reserves the right to remove or repair,with Its own forces but at the expense of the applicant,any tile outlet which is not maintained and causes damage to adjacent right-of-way.Applicant must obtain a permit to do maintenance work on the drainage system covered by this permit. • If the Minnesota Department of Transportation shall make any improvements or change on all or any part of its right of way upon,over,under or along the trunk highway,then and in every case the applicant herein named shall,after notice from the Commissioner of Transportation or his authorized agents,proceed to alter,change,vacate or remove from trunk highway right of way said works necessary to conform with said changes without cost to the State of Minnesota. • After work on a project Is completed the applicant must notify the Area Maintenance Engineer or authorized representative that such work has been completed and Is ready for final inspection and acceptance. • Issuance of this permit is subject to the provisions of Chapter 103B of the Minnesota Statutes. SECURITY DEPOSIT may be required to insure proper restoration of highway surfaces and to cover payment for any damage to highways or State property. Additionally,any expense incurred by the Minnesota Department of Transportation above the posted deposit will be assessed against the applicant. M-D-15-65668 C.S. 8214 T.H. 36 TLC Investments THIS PERMIT IS SUBJECT TO THE FOLLOWING CONDITIONS: The installation authorized in this permit will be inspected by Rod Clark, MN/DOT Roadway Regulation Inspector 651-234-7915. The applicant or its contractor will notify Mn/DOT's inspector at least two days prior to starting the installation. Any questions the applicant may have pertaining to Mn/DOT's storm water facilities shall be presented at this time. Mn/DOTs inspector will approve all highway materials prior to placement, and the total installation must meet with his/her satisfaction. Attached is a drainage map that satisfies the requirements for Mn/DOT storm water utility locates per Minnesota Statutes 216D and Minnesota Rules 7560.0250. By acceptance of a permit from Mn/DOT, the applicant agrees that it, and all of its agents or contractors, shall use Mn/DOT's drainage map to identify the location of Mn/DOT drainage facilities as satisfaction of the requirements of Minnesota Statutes Ch. 216D and Minnesota Rules 7650.0250 with respect to Mn/DOT's storm water drainage facilities. This permit authorizes the applicant to modify the existing drainage pattern to TH 36 right of way, near the intersection with Oxboro Ave, in the city of Oak Park Heights as shown on applicant's plan sheet(s). Any lane closures shall be approved by this office at 651-234-7915, 24 hours prior to the lane closure. The hours of the lane closure shall be determined by this office. The applicant shall provide in-house inspection at all times while working on trunk highway right of way. The applicant shall furnish, install and maintain all required traffic control devices according to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts (see web page @ `! www.dot.state.mn.us/trafceng/),while performing the construction authorized by this permit. Due to the Twin City rush hour restrictions, no work involving interference with or causing a distraction to traffic will be allowed from 6:00 AM to 9:00 AM, or from 3:00 PM to 6:00 PM. unless authorized by the MN/DOT Permit Office at 651-234-7915. If the temporary traffic control zone is to remain in one place for more than 3 days or involves a detour, road closure or a situation where the typical layouts do not apply, the applicant shall prepare a specific Traffic Control Plan for approval by Mn/DOT prior to start of any construction. Temporary lane restrictions will be permitted as detailed at the following link: http://www.dot.state.mn.us/metro/trafficenc/Ianeclosure/index.html All persons while performing authorized work on Mn/DOT Right of Way shall be required to wear a Mn/DOT approved High Visibility Safety Vest and Soft Cap/Hard Hat. Any authorized night work requires all personnel to wear a Mn/DOT approved full night safety suit (pants and jacket). M-D-15-65668 C.S. 8214 T.H. 36 TLC Investments It shall be the responsibility of the applicant to utilize the "Gopher State One Call" excavation notice system as required under Minnesota Statute Chapter 216D, 48 hours prior to performing any excavation (Phone 651-454-0002 Twin Cities Metro Area or Toll Free 1-800-252-1166). The Excavator shall mark proposed excavation with paint and flags or in lieu of flags stakes may be used. All flags and stakes shall display the name and phone number of the Excavator. All areas of proposed excavation shall be considered "practical"for the use of white markings, pursuant to Minnesota State Statute 216D.05 (2). The Excavator shall acquire a Positive Response confirmation from Mn/DOT for all proposed excavations when the Gopher State One Call has indicated Mn/DOT utilities may be affected. The Excavator may call Mn/DOT Electrical Services Section (ESS) Dispatch Locating to confirm the status of Utility infrastructure owned by Mn/DOT. Mn/DOT Electrical Services Section (ESS) Dispatch Locating can be contacted at the following phone numbers; (651) 366 -5750 or(651) 366-5751. The Excavator is required to comply with the provisions of Minnesota Statutes chapter 216D when performing Excavation as defined in Minnesota Statutes §216D.01 (subdivision 5), and will be responsible for damages to facilities in accordance with Minnesota Statutes §216D.06. No material shall be deposited on the traveled roadway. All areas disturbed by the applicant shall be restored with a minimum of 6" of topsoil (according to MnDOT Standard Specification 3877 Table 1 Common Topsoil Borrow), then sodded or seeded. Seed or sod should be the same as/or compatible with the existing turf cover. If the areas are to be seeded, a MnDOT seed mixture comparable to the existing turf along with Category 3 blanket with all natural netting and stitching shall be used according to MnDOT Specification 2575. When frozen conditions prevent the applicant from completing turf restoration the applicant must temporarily stabilize the disturbed area. Use seed mix 22-111 following the winter seeding method and type 1 mulch following the winter mulching method in the 2014 MnDOT Standard Specification for Construction section 2575. The applicant is responsible for competing final turf restoration prior to May 15 of the following spring. All areas disturbed during construction within State right-of-way shall be restored to original or better condition. The applicant shall perpetuate all existing drainage. The applicant shall relocate and reconstruct the in-place drainage ditch along the highway as necessitated by the construction authorized by this permit. The new ditch shall match the grades and contours of the in-place drainage ditch. The applicant is required to preserve all existing survey monuments. If Mn/DOT determines that M-D-15-65668 C.S. 8214 T.H. 36 TLC Investments monuments have been disturbed or destroyed during construction activities, the applicant shall accept full responsibility for all costs incurred in the re-establishment of the monuments. RE: Oak Ridge Memory Care Addition Dear Mr.Johnson, The Middle St. Croix Watershed Management Organization (MSCWMO) received required submittal items on October 24, 2014 for the proposed Oak Ridge Memory Care Addition, located within MSCWMO boundaries and in the City of Oak Park Heights.The proposed project qualifies for full review under the MSCWMO 2006 Watershed Management Plan (WMP). The project, as submitted, does not meet the Policies and Performance Standards contained within Section 5.0 of the MSCWMO WMP. The MSCWMO Board did not approve the project at their regular board meeting on November 13, 2014. The following conditions must be met before the project can be reviewed for compliance with MSCWMO performance standards: Drainage Easement Compensatory Storage • Demonstrate compensatory storage of.985 acre feet for the prosed filling in the drainage easement.The plan proposes to fill the existing drainage easement that provides 1.46 acre feet of surge storage. The proposed plan fills 0 .985 ac-ft.of surge storage. Compensatory storage of.985 ac-ft.must be demonstrated. Permits • Submit permission to construct on MnDOT property. Surface stormwater conveyance is proposed to be diverted onto MnDOT right of way. Grading and utility work on MnDOT right of way is proposed to meet minimum rate control standards. Dry Detention Pond • Add the weir wall in outlet structure 1 to the HydroCad calculations. • Identify and document the emergency over flow of dry detention basin 1P. • Add a floating debris filter to the outlet of dry detention basin 1P. Underground Infiltration Basin • Provide soil borings,boring logs to verify soil conditions at underground system location. The infiltration system is located in primarily fill soils.The bottom of the proposed underground system is at 871.5. 1985 pre development contours indicate a native soil elevation of 872. • Provide a minimum of 202 cubic feet of retention storage to meet the minimum volume control requirement. • Add an inspection well to the underground infiltration system. Inspections and Maintenance • Provide an inspection and maintenance agreement for the underground infiltration system and dry detention basin 1P.
